HomeMy WebLinkAbout20170110min.pdf IDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING January 10, 2017 – 1:30 P.M. In attendance were Commissioners Paul Kjellander, Kristine Raper and Eric Anderson. Commissioner Kjellander called the meeting to order. The first order of business was APPROVAL OF MINUTES FROM PREVIOUS MEETING on Tuesday, January 3 and Tuesday January 10, 2017. The Commission voted unanimously to approve the minutes as written. The second order of business was approval of the CONSENT AGENDA: 1. Brandon Karpen's January 06, 2017 Decision Memorandum re: Application of Idaho Power for Authority to Revise Tariff Schedule 91 -- the Energy Efficiency Rider, Case No. IPC-E-16-33 2. CChristen/DHuang's January 06, 2017 Decision Memorandum re: Idaho Power Company's Request for Authority to Increase Its Rates for Electric Service Due to Revised Depreciation Rates for Electric Plant-in-Service, and to Recover Costs Associated with the North Valmy Plant, Case Nos. IPC-E-16-23 and IPC-E-16-24 3. Camille Christen's January 06, 2017 Decision Memorandum re: Idaho Power's Application to Approve First Amendment to Its Energy Sales Agreement with Orchard Ranch Solar, LLC, Case No. IPC-E-16-37 4. Kevin Keyt's January 05, 2017 Decision Memorandum re: Approval of Modifications to Avista Corporation Natural Gas Tariffs; Tariff Advice No. 17-01-G Regarding item 1, Commissioner Raper asked Mr. Karpen about meeting a March 1, 2017 effective date when asking for a 21 day intervention that will take on a 7 day reply; since it would still require a comment and reply period after that. Mr. Karpen said he did not anticipate many comments so he thought he could shorten the dates from 21 days to 14 days. Commissioner Raper said she would recommend suspending the March 1 effective date. Raper made a motion on IPC-E-16-33 that the commission issue a notice of application, set a deadline for a 14 day deadline for intervention that also includes a seven day reply that directs the parties to develop a schedule and suspends the March 1, 2017 effectively. There was no further discussion. A vote was taken on the motion and it carried unanimously. Regarding item 2, Commissioner Raper had questions for Ms. Huang and Ms. Christen about the effective dates on Cases IPC-E-16-23 and IPC-E-16-24. The company originally requested an effective date of April 1, 2017. Raper stated that the acknowledgment in the memo is not actually going to be met; but there is no request for suspension of the effective date in the memo. Ms. Huang said that in discussions with staff, the staff believed the effective date could be met but trying to get out the order as soon as the company had requested, would cut down on staff’s ability to review the case before submitting comments. Raper stated that she was fine with the commission decision, however she is not in favor of the commission not getting orders out as quickly as we can. Ms. Christen stated the April 1 effective date was at the company’s request. Commissioner Kjellander stated that the order date that was referenced in the decision memo was not part of the commission decision piece. Commissioner Raper agreed, that with that stated she okay with the commissions decision of the memo. There were no further comments or questions and Commissioner Kjellander made a motion to approve Staff’s recommendations for items 2 through 10 on the Consent Agenda. A vote was taken on the motion and it carried unanimously. The next order of business was MATTERS IN PROGESS: 11. Re: Motion for Procedural Relief, Case No. AVU-E-16-06. [Camille Christen, Attorney] Ms. Christen stated that as it states in the motion, Staff in reviewing the application found discrepancies in dates in the application. Staff is asking to suspend the comment schedule and allow for the parties to resolve the questions, once the questions are resolved staff will come up with a new comment schedule. There were no further questions and Commissioner Kjellander moved to grant the motion to suspend the January 31, 2017 comment and the February 21, 2017 deadlines that are referenced in the decision memo. A vote was taken on the motion and it carried unanimously. The next order of business was FULLY SUBMITTED MATTERS: 12. Deliberation re: Idaho Power's Application to Approve the Sale of Assets to McCain Foods, Case No. IPC-E-16-31. [Daphne Huang, Attorney] Commissioner Kjellander announced that items 12 would be deliberated privately.
