Since I have not yet received a letter from you as promised in your email below, I find I must inquire as to the status of your
intentions regarding water service to Kastera s )"railhead development. As you know, at Kastera s request, United Water
Idaho filed a request with the Idaho Public Utilities Commission (PUC) for an expansion of our service territory to include
the Trailhead project. Subsequently, the City of Eagle intervened in that proceeding because they indicated Kastera was
seeking annexation into the City of Eagle and that the City would be providing Kastera s water service needs. Additionally,
in follow-up phone conversations with Wayne Forrey, Iwas assured that Kastera wished water service from United Water.
Two days ago, after again talking with Wayne, I received a copy of the draft MOU that Kastera presented to the City of
Eagle on July 14. in which it appears that Kastera still has some interest in receiving service from Eagle. At no time did
Wayne mention anything about the MOU. I would like to reiterate that United Water is very interested in providing water
service to your Trailhead project and we stand ready to proceed immediately upon your request. However, if Kastera does
not wish to receive water service from United Water, I would appreciate receiving a communication to that effect. If your
intention is to move forward with United Water, please say so and we will expedite your request If your intention is to
proceed with water service from Eagle, please let me know. If the latter is your intention, please be advised that United
Water will be seeking reimbursement from Kastera for all costs and expenses incurred in our service territory filing and
proceedings before the PUC in this matter.

Thank you for taking time out of your busy schedule to discuss water service issues with
me. I appreciate and understand that water is a high priority with all developers in the
Treasure Valley and you and your staffs' expertise in this matter is very helpful.
Per our February 20 2007, telephone conference, Kastera LLC is submitting to United
Water in writing a request for water services to Kastera s Trailhead Community in the
North Ada County Foothills. Kastera LLC will be making application with Ada County
for development of this project. We desire United Water service for our Trailhead
Community.
Kastera LLC was in negotiation with the City of Eagle and surrounding rueighbors to the
Trailhead Community for an annexation path. This path did not materialize and as such
the City of Eagle is not able to provide water service to our project. Kast-era LLC has
requested, in a letter dated February 15 2007, to the City of Eagle, a withdrawal of both
our Annexation and Rezone Applications immediately (letier to Eagle is included as an
attachment to this letter).
For the benefit of all parties involved, Kastera LLC will not discuss any annexation or
water service requests from the City of Eagle, Idaho for this specific project. We realize
that United Water has requested an expansion of its service area to include Kastera
Trailhead Community from the Idaho Public Utilities Commission and as such Kastera
agrees that it makes sense to coordinate with United Water on providing water service to
our project.
Again, we thank you for your time on this matter and we look forward to moving forward
with United Water on this exciting project.

Dear Mr. John Lee:
On behalf of Kastera Homes and Mr. Gregg Olsen, I am writing to formally restate our request
for extension of water mains and water service facilities to serve our 660 acre property in the
foothills north of Eagle, Idaho. It is our desire to have water service to our property via United
Water Idaho facilities because United Water has the ability to provide immediate water service.
Because a portion of this property is within the Eagle Area of City Impact, we have conceptually
discussed possible annexation of this property with Eagle City officials. No commitments have
been made. (Please see vicinity map for reference.
At this point, it is undetermined if we will ever be annexed
into the City of Eagle. Annexation may happen in the
future,..and it may not. However one thing is certain; we
need water service immediately and United Water is the
only water service provider that can meet our time
schedule. Therefore, we are requesting water service
from United Water to serve our property outside of the
Eagle Area of Impact Boundary.
If you need any additional information from Kastera Homes
or Gregg Olsen, please let me know. We appreciate your efforts to anticipate growth in the

Dear Mr. John Lee:
On behalf of Kastera Homes and Mr. Gregg Olsen, I am writing to formally request extension of
water mains and water service facilities to serve our 660 acre property in the foothills north
Eagle, Idaho. It is our desire to have water service to our property via United Water Idaho
facilities.
Mr. Gregg Olsen is the property owner and Kastera Homes is in the process of acquiring the 660
acre Olsen ranch. 520 acres of the Olsen ranch is within Ada County. The southerly 140 acres
is within the Eagle Area of City Impact boundary. (see vicinity map below.I have the
authority to make this request on behalf of Mr. Olsen.
The initial development concept for this property is a
clustered community including 104 homesites plus an
equestrian center to be developed in accordance with the
non-farm ordinance of Ada County. In the future, there
mayor may not be additional homesites developed,
depending upon ordinance requirements. The
development concept for the land within the Eagle Area of
City Impact is undefined at this time.
I have attached a legal description of this property so you can commence your new service
request process. If you need any additional information from Kastera Homes or Gregg Olsen

Dear Commissioners:
Kastera Homes has recently acquired additional property in Ada County that is positioned
for major community development. Consequently, we have expanded our professional
staff and reorganized our internal project assignments to meet our business needs.
Thomas Fassino, one of our senior Project Managers, has been assigned full project
management responsibilities for our proposed Trailhead Planned Community. As you
communicate with Kastera Homes, please direct your inquires to Thomas Fassino.

planned community we are proposing near northwest Boise. This new community that

current status of our coordination with the City of Eagle and United Water Company.

RE: Request for Water Service in Foothills area north of Eagle, Idaho
Dear Commissioners:
My name is Wayne S. Forrey and I am the Director of Planing and Development with
Kastera LLC ("Kastera ). Kastera is developing the Trailhead Subdivision within Ada
County in the foothills north of Eagle, Idaho. We have not yet submitted an application
with Ada County for development approval of our project, but we are within weeks of
being able to do so.
In order to develop our Trailhead project, we need water. We initially approached both
the City of Eagle and United Water Company in an attempt to detemline which entity
could best provide us with the water necessary for development. We met with the City
of Eagle and learned that Eagle would not be able to provide water for at least 2 to 3
years. On the other hand, United Water Company assured us that they had capacity and
could immediately provide water to our property. Based on that infonnation, and our
need to have a commitment for immediate water, we requested that United Water
Company provide us with water service. Perhaps you have seen the letters I have written
to United Water Company regarding this request.
The City of Eagle recently informed us that they can now provide water to our property
within 6 months. However, various engineers and water managers have told us that the
Eagle water system cannot be expanded to meet this 6 month schedule. Eagle has
informed us that we '1annot be annexed unless we connect to their water system
would be foolish for us to annex our property into the City Eagle and then wait 2 to 3
years for water service.
Various water professionals have also told us that United Water Company can in fact
provide immediate water service to our property.

It would help us greatly if you could verify Eagle's ability to provide water service to our
property. Eagle s water engineer originally said it would take 2 to 3 years for water
service, now they have changed to say 6 months to 1 year for water service. What is the
real water situation in Eagle'??? Does Eagle have the ability to serve our property within
6 months?
We are considering annexation into Eagle. However, if Eagle cannot provide water
\vithin a 6 month time frame, then we would likely have United Water Company serve
our property. As stated, we are at this time attempting to verify both Eagle s and United
Water s ability to perfonn as claimed. We would welcome any insight that your
commission might have regarding Eagle s water system.
We regret any confusion that we may have caused. We understand that our decision
may have some service ramifications as both United Water Company and the City of
Eagle would like to provide water to developments in our area. We are just trying to
determine who might be the best party to provide water service, given our time line fordevelopment. Please feel free to contact me if you have any questions or if you would
like to invite us to a future Commission meeting to discuss this issue.

REQUEST NO.: Please provide a copy of any water needs assessments for the
Trailhead Community development.
RESPONSE TO REQUEST NO.United Water objects to this request because the
phrase "water needs assessments" is undefined and unclear. United Water, however, responds as
follows:
As part of its ongoing planning process, United Water prepares and periodically updates a
20 year Master Plan. Water demands on a system wide basis were developed in the Master Plan.
For Trailhead planning purposes United Water assumes, based on historical consumption records
for non-alternate irrigation foothills development type of users, peak day demand 1.1 gallons per
minute per customer. The 500-700 customers estimated to be connected in the Trailhead
development results in 550-7700 gallons per minute of peak day demand at full build out.
Based on projections in the 20 year Master Plan, United Water has adequate source of supply
capability to serve the development.
A copy of the Master Plan is in the custody of counsel for United Water and
arrangements for review of the Master Plan may be made by contacting counsel for United
Water.

REQUEST NO.: Please provide a copy of all engineering design and cost estimates or
budgets for construction and development schedules for all facilities that will be needed for OWl
to serve the Trailhead Community development.
RESPONSE TO REQUEST NO.: Detailed design and cost estimates have not been
developed. The only facilities required to extend service to the Trailhead development are an
extension of United Water s existing main line through existing right of way in Eagle Road. As a
general estimate, construction cost of 12" mainline is in the range of$50/ foot. The extension of
2 ~ miles thus has an expected cost in the range of $600 000. Depending on the eventual design
of the development, a storage reservoir and booster station may be required in the future. The
expected cost of a booster station could be in the range of $250 000 and the expected cost of a
reservoir could be in the range of$350 000.

REQUEST NO.: Please identify and provide a copy of all water rights that OWl will
use or propose to use to supply the Trailhead Community development.
RESPONSE TO REQUEST NO.: Because United Water s system is fully integrated
service to a specific area is usually not tied to specific water rights. In order to maintain
reliability and redundancy, different sources can and will be used depending on demand and time
of year. For example in the winter the Marden Plant provides the majority of the source of
supply for the east main service level, west main and Floating Feather. Floating Feather well and
Redwood Creek well are also used as demand increases in the summer. Some ofthe more
