Dear Mr.Costigan:
I am writing in response to your letter of Dec.20 to Commissioner Mack Redford.Thank you for
your letter.I sincerely apologize that you did not receive a response to your letter of October
27.We do our best to respond to every customer and you clearly deserved a timely response.
You may not have heard that our Commission staff made an error in the calculation of the tariff
for use over 10.7 hundred cubic-feet.Instead of $3.11 for every ccf over 10.7 ccl,the correct
tariff is $1.74.That is quite a difference and I hope will provide you some relief.I will attach a
copy of the revised tariff.
We will keep you apprised of the report the Company is to issue within six months regarding
fire hydrants.I have put a notice in my calendar to remember to send you that report when we
receive it.However,do not hesitate to call me if you haven’t heard from me by May.The toll-

I have also enclosed the document you provided Gerry Galinato.
Regarding your comment that the Company’s water rights are solely within Kootenai County,
thus excluding the 65 five-acre lots in the Treeport Subdivision and that the Company’s water
right allows for only domestic use,our staff reviewed the water rights records obtained from
the Idaho Department of Water Resources and the plat map served by the system and found
the following:1)The combined water rights allow for in-house use for a total of 366 homes and
49.5 acres for irrigation.The total number of lots is 365 (313 in Spirit Lake East and 52 in
TreePort.)No data is currently available on how may total acres are being irrigated.2)The

water rights adjudication claims filed by the Company on July 22,2009,included a request to
change the type of beneficial use from “domestic use and irrigation use”to “municipal use.”
