Request:
1. There are no plans to expand the Schweitzer Basin
Water LLC (SBW) in the future.
2. Water was first delivered to SBW customers in October
1964 when Dr J Fowler started SBW. Mel Bailey purchased
the SBW in August 1989 and continued to deliver water to the
same 58N, R2W, Boise Meridian Section 20, SE % in Bonner
County and to the same customers.
3. Service line sizes are generally 1 or 1 Tz inch for single-
family homes and either 2, 4 and 6-inch for multi family
buildings. lf the Fire Chief required a fire hydrant be installed
on their property, a 6-inch line was used. See the attached
customer database, Attachment 3, for the service line size per
customer.
4. Total annual power costs lor 2012,2013 and 2014.
Well 1, well 2, well 3 and pump 5 are all on the same power
meter. Copies of the electric bills for 2012,2013 and 201 4 are
in Attachment 4.

5. 1) Total Well Production Data
Water from well 1, well 2, and well 3 all flow through the
meter in reservoir 1. ln the original application Attachment 17
gives the water production by month for 2013 and 2014. The
yearly well production data in gallons for 2012, 2013 and 2014
are below:

2) The IDEQ has not prepared a Source Water
Assessment Report for the well 4.
3) The SBW does the following to protect our water
sources:
Property has been purchased to provide protection around the
spring source and all wells as illustrated in the source water
protection plan and maps.
Yearly we extensively remove all brush near the wellheads,
limit access with no trespassing signs, and there are limited
access roads.
The water and soil are non-corrosive. After 50 years there are
no visible signs of corrosion to the casing, surface seal and
sanitary seal.
There is no industrial, commercial or agricultural activity within
several miles. No septic or sewer lines are within 500 feet of
the wellheads.
6. 1 ) Attachment 15 in the original application is provided
again as attachment 3 to this document.

There are 431 residential customers. ln addition there are
7.5 rentals that customers are charged for. The total
Equivalent Residential Units (ERU's) is 439, rounded up.
There is only one customer entry (treasurer) per building
regardless of the number of units. lncluded now in the
customer data base are
a. The service line size to each customer (building)
as part of request 3 herein,
b. The number of units in each building
c. The rate charged (less than or greater than 500 sq
ft, additional units in a building)
d. There are no commercial customers
e. The approximate occupancy in number of DAYS
per year. The average home/condo owner that
has two or three homes uses the second and third
homes on weekends and holidays in the winter, or
about 20 days per year. For multi unit buildings, if
one or more unit is used as a full time home the
Occupancy Column states how many units are fu!!
time (365 days per year - dpy). The remaining
units for that building are at 20 dpy. The
occupancy is very dependant on the snowfal! and
depth of snow. ln early December occupancy is
low (snow depth is just starting) but over
Christmas to New Year the occupancy is greater
than 50o/o (if there is new snowfall). February has
President's Day weekend which also has a large
percentage of occupancy.
2) There are no unserviced, stand-by accounts included
in the SBW system.
7. 1) The SBW has only class of customers, residential
living unit. There are no commercial customers. Residential
living units are used by the owners the same regardless if they
are a stand alone home (single family) or a multi family
residence (condo). The ERU's are independent of the number
of bathrooms and the number bedrooms. The size and
number of bed and bathrooms of the living unit does not seem
to control how many people can occupy a living unit during the
Christmas to New Year's holiday season.
Based upon the production records and current hookups, the
maximum current use per ERU is as follows:

ln 1978 Welch Engineering of Sandpoint ldaho completed an
evaluation of the systems optimum hookups (Attachment
7.1)). This evaluation used a higher peak demand, MDD, of
150 gpd per living unit or almost 2 times the actual MDD. A
safety factor of 1.5 was then added to the 150 gpd to equal
MDD of 225-gpdlliving unit or 2.9 times the actual MDD. This
safely factor is very conseryative but correlates to peaking
factor multipliers of 2.5. The value of 225 gpd/ERU has been
used as the bases for providing water since SBWLLC was
established.
The total water available, 150.5 gpm, minus the largest
source, W1 47 gpm, is 104 gpm. The number of ERU's that
SBWLLC could serve was:
104 gpm x 1440 mpd = 149760 gpd
149760 gpd I 225 gpd/ERU = 665 ERU's
The estimated demand per ERU is not expected to change in
the next 20 years. There will be a reduction in per capita use
as more reduced water flow devices are retrofitted into
existing homes and installed in new homes that are built to the
Uniform Building Code requirements. The SBWLLC rules and
regulations also require these low flow devices. Customers
have become much more concerned about the environment
and the conservation of limited resources. This awareness
has been demonstrated by a reduction in the amount of water
each home consumes.
It took 50 years for the number of full time residents to reach
37 . Because of the difficulty in managing snow (high snow
levels in driveways, on roofs and around houses), short
growing season, very low temperatures and lack of community
activities and services, the area served by SWLLC is expected
to have a very slow increase in the number of full time
residents or retirees.
lnitially the water system was a transient, non-community
system, with Iess than 25 full time, year round residents. ln
2009 the water system was reclassified as a community water
system when there were approximately 37 full time residents
with a transient population of 900 in the winter months. lt took
45 years to change from a transient to a non-transient system.
There is no homeowners association controlling the density of
housing on the lots. The Bonner County Planning and Zoning
(P&Z) regulations apply to most lots within the area served by
SBWLLC. The current P&Z regulations require 12,000 sq ft
of land for a home or the first condo to be built, and 3,000
additional sq ft for each subsequent unit to be built on a lot.
Some lots are less than 12,000 sq ft. These are grand
fathered to one unit. There is an uncertainty about the
number of units to be built because it is based upon the
square footage of a lot and how owners combined and/or
divided Iots to change the density.
Because the Schweitzer homes are second and third homes
for the owners, construction is very dependent on the
economy. Many lots were purchased as investments, never
intending to be built on by the current owner. The remaining
lots are the lots that are more difficult, and more expensive, to
build on because of their steeper terrain.
From 1965 to2013 only 43o/o of the lots were built on, or 431
units. Only 139 lots remain to be built on. The actua! number
of living units can vary as owners combine or divide lots and
obtain Conditional Use Permits for multi unit dwellings.

more ground than was used in the 1960's and 1970's. This
will limit the number of multi unit buildings, wlth most new
buildings being single family. Projecting on the high side,
between 2013 and total build out in 2050, between 140 and
180 additional new living units wil! be built. This is a maximum
total of 612.
ln the 1980's the Schweitzer Ski Resort developed the Crystal
Springs area providing the first competition to Dr J Fowler's
housing lots. Schweitzer Ski Resort also developed the lots
next to the Musical Chairs ski lifts in the 1990's and North of
the area served by SBWLLC. ln the 2000's The Ridge, The
Spires and The Trappers Landing developments all created
competition with desirable building sites. The new
developments opened new land area that offer better ski in-ski
out, have flatter terrain, community amenities, etc. The
development of lots served by SBWLLC is expected to show a
continued slow down in the next 50 years, certainly slower
than the first 50 years.

Based upon the above table and the slower home
construction rates, the projection for 2014 to 2020 is 7 homes

per year or a total of 49 homes. Assuming the economy
improves, the rate is projected to be t homes per year for
2021 to 2030, or a total of 90 homes. Beyond 2030, the rate
is projected to decrease because the remaining few lots are
very steep and very expensive to build on. There are too
many other desirable, and cheaper lots to build on. The rate
beyond 2030 is projected to be 3 homes per year. lf 2050 is
considered as the year when total build out of the area served
by SBWLLC occurs, then there would be 612 ERU's.

The water sources, minus the largest producing source, can
provide water for 665 ERU's. This is greater than the
projected number of 612 ERU's in 2050, build out. Thus
allowing SBWLLC a safety factor of 1.3 for the uncertainty in
the projection of future growth.
2) The current SBW system can serve 612 ERU's since
the 2006 addition of the R3 (137,000-gallon tank) and W4
(well 4). No additional capital improvements are required to
serve the 612 ERU'S. A new well could be added to improve
system reliability due to heavy winter snow, which makes
repairs of wells very difficult or impossible.
3) The system has no expansion plans. The area
served by the SBW has not changed since it was started in
1964 and does not expect to change.
4) There are no common property areas served or
anticipated to be served by the SBW. The area is populated
in the winter and kept in the natural state (when no one is
there) in the summer.

5) There are no commercial accounts expected.
8. SBW Schedule of Current Rates for Water Service and
Connection Fees
Correction to 1.3, replace with.
1.3 A single unit with a guesthouse or
attached living unit (no kitchen) which
can be rented shall be $20.50/mon
Smaller units (less than 500 sq ft) should use less water
than larger units (greater than 500 sq ft). That is the reason
for the two rates. lf you have an additional area added to your
home for rental with a kitchen, it is adding another ERU. So
the customer pays the same rate for another living unit. For
an additional living unit without a kitchen, the water usage
should be less than a rental home with a kitchen so the rate
was divided in half, to $20.50 /month.
2) No, monthly rates are not based upon the number of
bathrooms. Monthly rates are just based upon living units.
3) When SBW was purchased in 1989 by Mel Bailey all
lots had been sold. Mel Bailey owned NO lots. As purchased
the SBW system water sources, distribution lines and
reservoirs supported 340 ERU's with 300 ERU's connected.
(See Welch Engineering document in Attachment 7.1))
At our cost, SBW added
three new wells (W1, W3, and W4),
fractured W2,
installed new pumps,
built reservoir R3,
upgraded reservoirs R4 and R5,
reservoirs R1 and R2 were rebuilt to eliminate leaks,
almost 2 miles of distribution lines were upgraded, and
service connections were added to all lots.
We have improved system capacity to allow all lots
within our service area to have water for their future homes.

At SBW expense, a new reservoir R3, and well W3,
system were constructed. The cost of R3 (137000-gallon
reservoir), well 3 and all water and power connections, built in
2006 is the basis for our hookup fees:
This additional water source allowed 100 more ERU's on the
SBW system and provided an additional water supply for fire
protection. Cost per ERU = $6951 48 I 100 = $6950
For an additional guesthouse or rental with no kitchen or
laundry, but with a bathroom, the fu!! rate was divided in half.
Or the rate would be $3475.
4) Curb stop to property corner:
LID-1-93 paved all secondary roads at Schweitzer.
There were no service lines installed by the developer (J
Fowler) in the 1960's, 1970's or 1980's. ln 1994 SBW
installed service lines to 147 lots that were on existing main
lines at an investment cost of $124,950. Or a cost of $850 (in
1994 dollars) per lot. At an interest rate of 57o, compounded,

the 201 1 (17 years) cost is approximately $ 1948 per lot (we
charge $2000 per lot), see attachment 8.4). This is called the
TAP FEE.
Water Tap fee and Line Extension for lots of Fall Line:
LID-1-93 paved all secondary roads at Schweitzer and
had a Tyear no cutting of pavement clause. This area was
only served by utility lines coming to the properties from the
road above. To correct this problem the utilities work together
to install approximately 2400 feet of joint ditch along Telemark
road. The cost for installing this main was reduced to $18 per
foot for the water main due to the joint effort of all the utilities
working together. The cost for the main was $43200 lor 32
lots or $1350 each plus the tap fee of $850 dollars per lot. The
extension and tap fee to each lot was $2200 in 1994 dollars.
Compounded at 5o/o interest rate, this is $5042 in 2011 dollars.
See attachment 8.4). The lots on Telemark are charged $3000
instead of $ 5042 because it is felt by the SBW owner that the
cost would be too high and restrict development.
Water Tap fee and Line Extension for lots of Ullr Dr:
This is a misnomer. There is no charge for the TAP
FEE only the line extension.
ln about 1999, a developer developed the lots on the
end of Ullr. The developer extended a main line and put in the
service Iines to the Iots. However, the extension had no water
source (it was higher than R4 that serviced the rest of Ullr).
SBW put in 900 feet of 8-inch main line in 2000 from R2 to the
end of Ullr to provide water for 8 lots at an investment cost of
$27000. The cost per Iot was $3375 in 2000 dollars. (At 5%
compounded to 2011 that would be $5772, see attachment
8.4).) The lots on Ullr are charged $3500 instead of $ 5772
because it is felt by the SBW owner that the cost would be too
high and restrict development.
5) The $500 per fire hydrant fee is for work performed by
SBW in preparation for a new fire hydrant. This fee has never
been charged as we feel fire hydrants help the community.

All the fire hydrants are privately owned. The $500 fee
includes the following:
9. There are no bulk water sales for the SBW, not even for
fire hydrant testing.10. 1 ) See the attached map of the fire hydrant
locations, Attachment 10.1). The SBW was designed
for only residential use; fire flows were not included.
The system is not required to provide fire flows that
meet the lnternational Fire Code because the SBW
system is grandfathered to its original design in 1964.
IDEQ accepts the Iowest pressure for water to delivery

commissioners (in 1990) asked the SBW to allow fire
hydrants be added to the system even though we knew
the fire hydrants could not meet the lnternational Fire
Code standards. The SBW let private fire hydrants be
added to its system as a benefit to the customers. The
SBW does not own any fire hydrants. See attachment
10.1) for the history of fire hydrants on the SBW system.

3) Correspondence with Fire Marshall, DEQ and ldaho
Survey and Rating Bureau (ISRB)
ln 2014 there were phone communications with the
ldaho Fire Marshal and SBW regarding adequacy of the fire
response system. Since he retired in November 201 4, Fire
Marshall Mark Larson has written SBW a letter dated April 8,
2015, stating that the current lnternational Fire Codes do not
apply to the SBW, see Attachment 10.3). The Schweitzer Fire
District tried to take SBW to a contested hearing because the
fire flows from the fire hydrants do not meet the lnternational
Fire Code. (The SBW was built in the 1960's for residential
use only not fire flow, is grand fathered to 20 psi, does not
own any of the fire hydrants and the Fire District does not
have jurisdiction over a water company). (See Request No.
12 below). There are numerous letters related to the SBW
having acceptable fire hydrants on its system from Schweitzer
Fire District (SFD), IDEQ and the ISRB. The ISRB accepts all
fire hydrants and their flows in the insurance rating
calculations. The area is currently rated 5. See Attachment
10.3) for letters from DEQ, ISRB, Sewell Engineering and
SFD.
4) There are no other fire services provided by SBW.
11. There have been no water quality or water system
issues/violations identified since the completion of the
Sanitary Survey. ln March 2014 there was a depressurization
of a portion of the SBW system when a leak occurred. A letter
was posted on each door of all effected customers notifying
them of the leak and the Ieak repaired. Bacteria samples
were negative.
12. There have been no service related complaints in the
Iast three years other than from the Schweitzer Fire District
(SFD). The firehouse is not on the SBW system. The
complaint from the SFD is that there is insufficient flow from
the fire hydrants per the current lnternational Fire Code. The
SFD initiated a contested hearing on March 20,2015. A
District Court Judge's ruling stopped this hearing. The Judge
stated that the ldaho Code quoted by the Fire District does not
apply to water flow and the water system. Mediation is

scheduled for June 15,2015 and a trail to review the
jurisdiction of the SFD over the SBW is scheduled for July 10,
2015. Attachment 12 is the SFD Notice of Violations and the
District Court Judge's Ruling from Show Cause Case No. CV
2015-434.
13. The water quality tests for all water sources (wells). The
IDEQ Monitoring Schedule for SBW from 2015 to 2023
is Attachment 13.

building. The meter is postioned near the front door so it is
accessible when the snow banks are high. These meters are
never used for billing.
Unaccounted for water is water lost through leaks in the
system. With a current minimum usage of less than 2500 gpd
it is demonstrated that the loss rate in the distribution system
can be very low. Water usage is regularly monitored to
ensure early leak detection. Small, slow leaks can occur. ln
the spring and fall, when there are no water customers on the
system, the operator's pressure check each leg of the
distribution system. Each Ieg is valved to maintain a static
pressure; if the pressure drops there is a leak and the
operators look for the source of the leak. This is easily
accomplished because of the limited occupancy at this time of
year.
Normally leaks occur either in the unoccupied homes or
service Iines. Most homes are only occupied a few weekends
a year. With no one home to notice furnaces shut
themselves off when the flue vent is blocked by snow, drafts
of cold air infiltrate normally warm areas freezing pipes,
friends using homes turn off the main electrica! breaker or
leave garage doors/windows open, basement vents are not
closed for winter allowing pipes to freeze, etc. Valve failures,
leaking toilets, poor home maintenance and repairs on
plumbing systems have caused leaks in homes, that when the
home is left unoccupied go unnoticed for a long period of time.
One leaking toilet can leak Tz gallon per minute; this is 21,600
gallons per month. Routinely SBW sends out a newsletter to
homeowners prior to winter season asking people to check for
potential problem areas. The program has been very
successful by creating awareness of the damage that can be
caused by water leaks and educated people to turn off their
water when they leave, thus reducing leaks in homes.
Curb stops are another typical source of leaks. They are
located at property corners that can be near the paved road or
still in the right-of-way but20-25 feet from the pavement. The
curb stop is 5 feet down with a riser to the surface. Usually

the curb stop is about 10 to 15 feet from the pavement. lf the
curb stop riser extends above the ground surface the riser is
likely to be hit and broken or pushed over by snow plows. lf
the top of the riser is buried it is difficult to locate under frozen
ground in an emergency.
Home relief valves and curb stops are also sensitive to water
hammers caused by improper shut off of valves or fire
hydrants. Water hammers may cause damage to home piping
or appliances.
Leaks occur but with this aggressive leak detection program
unaccounted for water is minimized.
The water loss per month cannot be calculated because of the
large variation in the demand. Ski season vary alot from year
to year depending upon when the snow falls in the season,
the total snow depth, how recent the snow fall is and when it
occurs relative to the weekend, amount of snow and the
temperatures in the populated areas (Spokane Couer
d'Alene), etc. Summer months can also vary due to weather.
When the water usage is taken and the daily demand
calculated, the number of customers on the mountain is
reviewed. Does the gpd relate to the customers? Then we
monitor usage for a few days, weeks to look for a trend.

Notes: Many residents, when they return after being gone for
weeks, find leaks in their homes. They repair these leaks,
some of these leaks are major over 200,000 gallons, without
notifying the water company because they think SBW is going
to charge them for the water. They are never charged for

19. The SBW Profit and Lost Statement for Calendar Year
ended 2014 does not include any expenses for bad debts or
uncollectable accounts.
24. The Balance Sheet for the Year Ended 2014 Long Term
Liability of $209067 is for employee housing. The source of
the liability is Mel Bailey, the interest rate is 4.5000%, the loan
term is for 360 months and the scheduled payments are $
1494.72. The loan/liability agreement and lender's
Amortization Schedule are in Attachment 20.
21. The asset list is in Attachment 21.
22. The $34 ,022 in Account 390 on the deprecation
schedule in April 2013 is for roadwork performed by Lippert
Excavation and Pipeline. The invoices are in attachment22
23. The $1 1,715 for Fire Flow lmprovement listed in the
deprecation schedule for December 2011 was for the
pressure reducing station added below the R5. The invoices
in Attachment 23 are for Lippert Excavation and Pipeline,
Wood's Crushing & Hauling, Lance Miller, P.L.S., Monks
Hydro Geoscience, Consolidated Supply and GC Systems.
The 2-inch and 6-inch Cla-Val valves and two 6-inch gate
valves were taken from SBW inventory. We did not replace
the Cla-Val valves.
24. The employee housing has 5 bedrooms, 3 and lzbaths,
one cooking area and 8 rooms total. The total square footage
is 3182. The refrigerator, stove and trash compactor were
included in the purchase price.

25. Employee housing is part of the water system because
cost of housing in the area is high. Employees must Iive in the
area so that they can respond to emergencies 34/7/365.
26. There are no Aged Accounts Receivable for the
calendar years 2012, 2013, and 2014.
27 . ln 2014 Mel Bailey and Marsha Bell were the SBW
employees. They are owners, Mechanical Engineers and
license operators. They did not take a salary so there were no
payroll taxes, unemployment insurance paid for them. Their
insurances premiums of $ 109 per month per person were
paid for them for a total of $ 2616 in 2014.
28. There was no sale between Schweitzer Basin Water
Company and Schweitzer Basin Water LLC. lt was a change
in the State of ldaho registration to protect the owners.

Fire Hydrants at SchweiEer Resoft and Their Consequences on the Relationship
between Schweitzer Basin Water LLC (SBWLLC) and the SchweiEer Fire District

HISTORY
In 1989 Melvyn Bailey purchased the SchweiEer Basin Water LLC (SBWLLC). At
this time there were no standard flre hydrants at the resoft. A few condos had
two inches or less water valves for local protection.
In late 1990 a fire district was formed with Tim Hinderman, CEO of SchweiEer
Resort, William Heller, a SchweiEer resident, and Dean Fiedler, a SchweiEer
resident and employee of Schweitzer, as the first fire commissioners. The
commissioners appointed Wayne Benner, a SchweiEer employee, as Fire Chief.
During formation, the Fire District, Resoft Water and SBWLLC worked to improve
fire protection. The main objectives were to increase the amount of water
available and to have fire hydrants installed throughout the area. An
implementation plan was written to try to acquire and install fire hydrants
through grants from the Idaho Depaftment of Commerce and the Economic
Development Administration. It was determined that no funds were available
from these programs. Resort Water and SBWLLC, the two water companies at
Schweitzer, also reviewed their water systems capacity for fire protection.
SBWLLC had adequate water storage capacity but the system, being designed
for resldential water use only in the 1960's, was not designed for fire flows (flow
requirement was 500 gallons per minute per SFD letter October 13, 1996). The
Fire Commissioners, homeowners, water system owners and everyone involved
felt that having hydrants and water available was impoftant for fire fighting. At
this time, SBWLLC wrote into its rules and regulations that the SBWLLC system
was not designed for fire flows but would permit hydrants to be connected to the
system as a public seruice. The results of the Resoft Water systemb evaluation
determined that the Resoft Water had flows higher than SBWLLC but lacked
adequate water storage capacity.
A second reason for establishing a fire district was SchweiEer property owners
had problems with insurance companies charging very high rates for insurance or
not willing to provide insurance at any price. The Fire District worked with
property owners to have propefi owners install their own fire hydrants at the
homeowners' expense.
The Insurance Rating Bureau establishes fire ratings based upon the number and
location of fire hydrants that flow a minimum of 250 gpm, total volume of water
available and capability of the fire district. With the newly available fire
hydrants, sufficient water volume and the newly established fire district, the
Insurance Rating Bureau reduced SchweiEer fire rating from a 10. Insurance
companies now provided insurance at reduced rates, which paid for the fire
hydrant purchase and installation costs within a few years.
During this same period a Limited Improvement District (LID-93) was established
at SchweiEer to pave roads. LID-93 did not allow any pavement cuts for a
period of seven years. LID-93 was the catalyst for the installation of many of the
fire hydrants.
Resoft Water and SBWLLC also worked to improve their ability to provide water
for fire protection. An emergency water main was designed and built between
SBWLLC and Resoft Water to provide Resort Water with an emergency water
supply in case of fire or other emergency. Resort Water has since added
additional reseruoir capacity to meet future growth and fire protection. The
emergency connection is maintained in case of a major fire.
SBWLLC has improved its system by connecting water mains through loops to
provide water from two directions to increase fire flow and has removed
unneeded valves and components, which restrict water flow. The company has
also added a 110,000 gallon reseruoir along with an additional well to increase
the amount of water available. In the future two additional loops are planned
along with a bypass line for a low-pressure area and the modification and
relocation of a pressure reducing station.
As a condition of the SchweiEer Fire Districts approval of multifamily unit
Conditional Use Permits (CUP), the SchweiEer Fire District requires the
installation of a fire hydrant. These hydrants and all other hydrants on the
SBWLLC system are owned by the property owner and are the responsibility of
the propefi owner, as stated in the SBWLLC rules since 1990. SBWLLC does
provide water to the hydrant as a benefit to the hydrant owner but is not
responsible for flow rates and maintenance of the hydrant, which is also stated in
the rules.
At this time no schedule can be established for the additional water
infrastructure. Lot density is determined by Bonner County density rules, which
are dependent on lot size. Developers frequently buy and combine lots to
change and increase density. Prior to installation of water mains, property
owners must first establish their water needs and locate where water mains are
to run on their propefi. When the property owner's development plan is
approved, infrastructure improvements can be installed.
REQUESTED WATER SYSTEM CHANGES FROM THE SCHWEITZER FIRE
DISTRICT
The current Schweitzer Fire Chief is taking legal action to require
SBWLLC to change its water system to bring it up to current code
standards for fire flows (1000 to 1500 gpm).
The SBWLLC was never designed nor built for fire flows. This is not unusual.
Many small water systems in the state have no fire protection at all. Other
systems in the state are old systems, designed and built to earlier, lower flow
requirements. Even those systems that have been designed for fire flows do not
always meet the flow requirements.
Water systems cannot easily change their distribution system, ceftainly not every
time the code changes. The codes are always for new systems, older systems
are grand fathered to the requirements in effect when they were designed and
built. SBWLLC was designed and built as a residential water system, not to
provide fire flows. We, the SBWLLC owners, have worked with our regulating
organization, the Idaho Department of Environmental Quality (DEQ), to provide
higher flows without damaging the system or affecting public health and safety.
A May 6,20t4letter from DEQ suggests that an alternative for resolving the fire
flow issue would be to remove the fire hydrants from the distribution system,
However, this would not be in the best interest of the SchweiEer propefi
owners.
SBWLLC worked with the first commissioners to establish water volume, a fire
district and fire hydrants at Schweitzer to help protect property at SchweiEer.
The goal to reduce the fire rating had been accomplished with the support of the
community, the fire district and the water companies. The current fire chief has
an unrealistic approach to fire flows and is using the fire code in ways that it was
never intended. Spending taxpayer money to prosecute a water company is
wasteful use of public funds.
The Insurance Rating Bureau has given SBWLLC credit for all of the hydrants on
its system. The current fire rating at SchweiEer is 5. This is similar to the rating
in Sandpoint (4), Ponderay (5), Kootenai (5), Dover (5), and most other fire
districts with similar issues. Improving the water fire flows would not change the
insurance rating nor reduce the insurance rates by a noticeable amount.
We do not have a good relationship with the fire chief. At the request of DEQ
we have had to stop the fire depaftment from using fire hydrants for obtaining
water or flow testing the hydrants. Fire hydrants can be used for a fire
emergency only. This unfortunate condition was brought about due to damage
to hydrants; fire trucks not equipped with backflow preventors and potential
health issues due to improper operation of hydrants. We have offered to work
with the SchweiEer Fire Chief regarding proper hydrant operation and use of
back flow prevention equipment on their trucks. We have not had any response
from the fire chief other than receiving letters from attorneys requiring SBWLLC
to show why the fire flows cannot be changed to meet current flow
requirements.
CONCLUSION
The Insurance Rating Bureau method of determining a fire rating is to evaluate
the number, location and minimum flow from fire hydrants, total water storage
available and fire district capability. Even if possible, increasing water flow from
the fire hydrants to the current code requirement of 1000-1500 gpm, would not
affect the rating. (Credit is given when the flow is greater than 250 gpm).
If SBWLLC knew the fire chief's response to our willingness to provide water to
private fire hydrants, we would have reconsidered our involvement. Providing
water to fire hydrants that the system was not designed to provide stafted out as
a great program for the community and promoted growth. With the current
legal action by the fire chief SBWLLC may not be able to allow hydrants to be
installed unless the district agrees that the flows are acceptable per Idaho Code
IDAPA 58.01.08.501.18. If the SchweiEer Fire Chief cannot work using the code
its actions may limit growth and building at Schweitzer.
By reverting to legal action the SchweiEer Fire Chief will create a distrust of the
SchweiEer Fire District and have a long-term affect on how other water
companies work with fire districts. This could also create problems with
insurance companies insuring propefties at SchweiEer because of actions by the
SchweiEer Fire Chief. There is only one regulating authority for water systems,
IDEQ. No other authority can regulate water systems in the State of Idaho.

Yes the first number is normal water level in gpm. For fire insurance purposes fire flow duration for 2
hours for needed fire flows for upto 2500 gpm, Three hours from 2501to 3500 gpm and four hours for fire
flows greater than 3500 gpm.
The Basin Water System represents 31 percent of the water credited for Schweitzer Fire District. The
point of the 40 points = 5.47 point
Total Water Credit in this grading is 23.85
Total points for the fire protection class is 57.58
Class 5 range is 50.00 points to 59.99 points.
To get to the next class would take 2.42 points. The things you have been doing to the water system sure
helps but I do not think that in its self would get to the next class,
Not sure how much insurance savings there would be if it went to a class 4.

This item was deleted from the body of the Idaho
adopted code through the administrative rule procedure (IDAPA 18.01.50). The State
Fire Marshal deleted this section as it was more restrictive than the language in the
previously used editions of the UFC. New editions of the IFC have been adopted on a
three year cyde since the adoption of the 2000 IFC. The currenUy used edition, the
2012 IFC, maintains the llmitations on the applicabiliff of new provisions being applied
to exlsting conditions. The revisions to the adopted model codes are dealt with through
the negotiated rule making process mandated for use by state agencies. Any changes
to the model codes must be approved by the Idaho Legislature mandated by the Idaho
Administrative Procedures Act (IDAPA).

This letter is in response to your request on March 26,2A15 at the Department of Environmental
Quality (DEQ) office for clarification on the Department's regulatory authority over Schweitzer
Basin Water LLC public water system.
The Idaho Legislature has given the Idaho Board of Environmental Quality the authority to
promulgate rules goveming quality and safety of drinking water, pursuant to Title 37, Chapter 21
and Title 39, Chapter l, Idaho Code. The Idaho Rules for Public Drinking Water Systems
(58.01 .08) are intended to control and regulate the design, construction, operation, maintenance,
and quality control of public drinking water systems to provide a degree of assurance that such
systems are protected from contamination and maintained free from contaminants which may
injure the health of the consumer.
During our previous meeting at the DEQ office on November 19,2013 to discuss fire flow
pressure and potential issues maintaining required pressure during hydrant flushing and fire
events, it was agreed by all parties that although there may be pressure deficiencies when
flushing the hydrants or in the event of a fire, it is preferable to keep the hydrants in place for the
safety and protection of the residents and their property. The Department is not recommending
the removal of the existing fire hydrants in order to reduce or correct any frre flow issues during
flushing or fire events.
Also, it was discussed that the Schweitzer Basin Water Company was built in the 1960's prior to
DEQ drinking water regulations and the Rules currently require that any drop in pressure below
20 psi in distribution must immediately provide public notification, disinfect the water system,
and notify the DEQ.
lf the Schweitzer Basin Water Company plans to "substantially modifli" or add new service
areas, these projects would trigger the requirement for maintaining a minimum 40 psi pressure
during peak hour demand, excluding fire flow.

This letter is in response to your request for information pertaining to Schweitzer Basin Water LLC (SBWLLC)
distribution system pr€ssue and fire flow requirements. To address pressure issues when hydrants are
exercised for planned purposes, the SBWLLC developed a Policy for the Operation and Control of Fire
HydrantsinNovember20l3whichwassenttoyouNovemberl,20l3. Acopyisenclosedwiththisletter.
Mel Bailey and Manha Bell of the SBWLLC met with the ldaho Departrnent of Environmental Quality (DEQ)
on November 19, 2013 to discuss their water system, fire flow pressure and potential issues maintaining
minimum required pressure during hydrant flushing and fire events. It was discussed that the current main
pressures can drop below 20 psi when firp hydrants are being flushed or when maintenance work is doae. It is
ageed by all parties that though there may pressure deficiencies when flushing the hydrants or even if there was
a fire, it is preferable to keep the hydrants in place. Also discussed was an alternative to correct the fire flow
pressure issue, which would be to remove the lire hydrants within the distribution system. However, this may
not be the in the best interest of the water users on the SBWCLLC system for protecting life and property.
For your reference, the SBWLLC water system was built in the 1960's prior to the frst DEQ drinking water
regulations. At this time the water system must maintain a minimum pressure of 20 psi in distribution, and if at
any time the pressure drops below 20 psi, system staffmust provide public notification to water users, disinfect
the water system, and notify DEQ. If the SBWLLC plans to "substantially modi$" or add new service areas,
these projects would trigger the requirement for maintaining a minimum 40 psi pressure during peak hour
demand, excluding fire flow.
It is DEQ's understanding that SBWLLC and Schweitzer Fire District will work together to coordinate the
hydrant flushing and work within the existing water system desrgn to keep the pressure within the mains at or
above the minimum required pressure of 20 psi.

Operation and Control of Fire Hydrants
Poliry for Operation of Fire Hydrants with water provided from
Schweitzer Basin Water LLC (SBWLLC).
This policy is in place to safeguard SBWLLC drinking water supply and
customers from contamination along with protecting the water supply
infrastructure, water mains and customer's fire hydrants, plumbing and
appliances, from damage due to the improper operation of fire
hydrants.
Water to be used for purposes other than extinguishing fires may be
withdrawn from fire hydrants only if a permit authorizing the special
use for which such water may be withdrawn shall have been issued by
SBWLLC. Permits shall be valid only during the dates specified therein
and shall be returned to SBWLLC when the work is completed or the
permit has expired.
Requirements for operation of fire hydrants that SBWLLC provides
water for:1. Permits must be requested a minimum of 3 working days prior
to operation of the hydrant. Permits will not be approved
during the winter months, during holidays, or when
maintenance work is to be pefformed on the water system.2. Permits shall be issued for each fire hydrant used and must be
in the possession of the user when operating the fire hydrant.3. The applicant shall describe the purpose for the operation of
the hydrant and estimate the amount of water to be used.4. Any activity that takes water from a hydrant and places it in a
tank or container shall have an approved backflow preventor,
which has a current test performed by a licensed backflow
tester, or be equipped with an air gap device. Note during a
fire emergency: lf the fire truck is not equipped with a back-
flow device the fire depaftment can fill their trucks or
containers without using a back flow preventor or a meter.
An estimate of the water used to fight the fire shall be
provided to the SBWLLC within 5 working days.
A calibrated meter shall be used to determine the amount of
water used to fill the tank or container. The meter reading
before and after the water has been withdrawn shall be
recorded on the permit.
If the fire department is testing fire hydrants, an approved
test procedure shal! be used and followed. Only test
equipment that has current calibration shall be used during
these tests. Personnel shall be trained in testing and in the
operation of fire hydrants and understand the safe operation
of such equipment. The discharged water shall be directed to
not cause damage or endanger personnel. An estimate of
water used shal! be recorded on the test form.
No quarter turn valves shall be used when testing hydrants,
filling tanks or containers or using water. The only type of
auxiliary valve that is approved shall be a multi turn valve to
minimize water hammers.
Following is a form to be completed and fill out prior to any non-
emergency operation of a fire hydrant and approved by SBWLLC prior
to fire hydrant operation. At the end of the test or tank filling the form
will be returned to SBWLLC. For emergency operation of fire hydrants,
this form shall also be filled out and returned within 5 days.
The permit holder is responsible for any water use through his hydrant
meter or any damage that may occur to the hydrant specified on the
permit.
Cost of water usage will be $10 per 1000 gallons used, with a
minimum of $30.00. The charge will be waived for fire emergency
use unless covered by insurance.

To better protect our customer's health and safety and meet the requirements of DEQ
we have initiated the attached procedure for the use of fire hydrants with water supplied
by SBWLLC. Any use of fire hydrants, including use by the fire department, requires
compliance with this procedure. The procedure will also help eliminate damage to fire
hydrants, to SBWLLC water supply system, and homeowner's water systems. It will also
help SBWLLC's ongoing monitoring program to understand water usage.
In September, SBWLLC was notified by the Superintendent of the IHD that a large
amount of water was flowing down a driveway. SBWLLC responded and found water
flowing (approximately 20 gallons per minute) from below a fire hydrant owned by the
condominium. The fire department had left a phone message that they were going to
test hydrants. SBWLLC turned off the valve supplying this hydrant and the water
immediately stopped flowing. A significant problem was eliminated by the timely
notification by the IHD superintendent. The hydrant could have undermined the thrust
block, separating the hydrant from the main, causing signiflcant propefi and water
main damage. This event did cause a loss of 19,000 gallons of water. Immediately
afterwards the water company evaluated other fire hydrants and found another hydrant
close to this location with both caps off and the hydrant unattended.
The attached procedure will help eliminate problems as described above. SBWLLC is
more than willing to participate in the testing of hydrants to minimize potential damage,
protect the system and public from health hazards and assure the correct operation of
the hydrants.
Please start using this procedure immediately. Please respond to SBWLLC on how you
are going to implement this procedure; we are available to help with this
implementation.
