Dear Mr. Gneiting:
I represent the Departent of Environmental Quality ("Departent") and I am writing
about the October 25, 2007, consent order that Morning View Water Company
("Morning View") entered into with the Department. According to our records Morning
View has failed to comply with the consent order as of the date of this letter.
The Department has referred the matter to the Idaho Attorney General's Offce for
further enforcement. On behalf of my clients, I am writing to notif you that the
Department wil begin the process of filing a complaint in district court and request a
permanent mandatory injunction under I.C. § 39-108 to compel Morning View to comply
with the terms of the October 25, 2007, consent order. The Department may also
request payment of additional penalties and attorney's fees.
