It should be noted that you were not in attendance at that meeting. Durng the meeting DEQ discussed the compliance status of santar surey significant deficiencies, as well as the October 25,2007 Consent Order between the Deparent and Mornng View. Your October 21, 2008 letter listed several signficant deficiencies identified by the Deparent during santar sureys. In the futue you can request status updates of the sanitar surey corrective actions from the drnking water staff in the Idaho Falls Regional Offce. Your contacts are listed at the end of this letter. The status of these deficiencies and the corrective action taken is listed below in the order listed in your letter. 1. Hazardous and toxic materials stored around the well lot have been removed. 2. Well NO.1 has a brand new sanitar seal. 3. Well NO.2 has a brand new santar seaL. 4. The well vents have been adequately screened. 5. The sample taps located in the pump house are now equipped with backflow preventers to protect the water supply. 6. The sand separator's discharge pipe has been extended and discharges onto rocks to protect agaist erosion. 7. All toxic and hazardous materials have been removed from the pump hoúse. 8. Pump house has been cleaned and is in good repair. 9. Locks have been installed. P r i n ted 0 n R e eye led Pap e r . Carol Hasselstrom November 24, 2008 Page 2 Management Deficiencies: 1. Morning View provided quarerly public notice to water users during the 3rd quarer of 2008. 2. Morning View has paid annual ,drinkng water fee. 3. Item 3 addressed below - Cross Connection Control Program. 4. Item 4 addressed below - Auxilar Power. 5. Pressure monitoring has been completed and documents 40 PSI in the non irrigation season. See number 1 below. 6. Morning View provided evidence of the installation of a flushing valve on the dead end. 7. Substitute Licensed Operator is not required if the Responsible Charge Operator certifies availabilty. . Regarding the actions and steps taken during the compliance conference on October 17, 2008 the items listed below were agreed upon during that meeting. The Morning View Water Company confirmed these actions in an October 28th letter issued by their engineer to the DEQ. DEQ has responded to the October 28th letter. Copies of both letters are attached. 1. The Department agreed to record water system pressure data at a water user's service line during November. DEQ has completed the process of recording pressure data. This new data as well as existing pressure data wil be used by Morning View to develop a formal pressure correction action plan to be submitted to the Deparment by January 2,2009. Adjustments to the pump controls wil be immediately conducted in an effort to maintain minimum pressure. 2. Water meters wil be installed on each service connection by March 15,2009 before irrigation season. 3. An application for a tiered rate structure based on metered water usage wil be submitted to IPUC. 4. If the above items cannot maintain minimum pressures of 40 psi within the distribution system, the following measures wil be implemented: a. Morning View shall install variable frequency drives before the peak irrigation season. b. Morning View wil install pressure monitoring stations to document distrbution system pressures. c. Since the number of service connection has increased by 35% since 2002; an additional well to provide peak hour demand with the larger well out of service as required by IDAPA 58.01.08.513, wil be needed. The Deparment is aware that Morning View Water Company has applied for but not received additional water rights by the Idaho Deparment of Water Resources. The Water Company expressed the commtment to add an additional source upon securing the water right. The new well shall have sufficient dedicated on-site standby power, with automatic switch-over capabilty, so that water may be supplied to pressurize the entire distribution system during power outages. .. The proposed Januar 2009 plan to be submitted to the Deparent wil be incorporated into a fialized facility planng study as well as our September 2, 2008 and November 24, 2008 comment letters. When Morning View achieves compliance with the Consent Order and Idaho Rules for Public Drinking WaterSystems, the water system is eligible for fuding water system improvements with the Deparent's loan and grant programs. Your questions regarding the water company's revenue and expenditues are best replied by the Idaho Public Utilities Commission, who have regulatory oversight of privately owned utilities that provide water service. I have forwarded a copy ofthis correspondence and your letter to the Commission. Box 595 Rigby, ID 83442 Certified Mail: Morning View Water System PWS# 7260063 Dear Mr. Gneiting: This letter is in regard to October 28,2008, letter prepared by your engineer, Ryan Loftus of Aspen Engineering. Due to an errant email address, I spoke to Ryan on November 7, 2008 and subsequently received an email with the October 28, 2008 letter on November 72008. Ryan's letter discussed Morning View's plan to address inadequate water pressure within the distribution system as stated during our October 17, 2008 compliance conference. In summary, the October 28th letter outlines the following pressure correction action plan: I. The Deparent agreed to record water system pressure data at a water user's service line during November. We have completed recording pressure data and have provided it to you and Ryan. AI i of the pressure data will be used by Morning View to develop a formal pressure correction action plan to be submitted to the Department by January 2, 2009. The pump controls wil be adjusted to assure minimum pressure. You need to follow your engineer's recommendations on pump control settings. 2. Water meters will be installed on each service connection by March 15,2009 before irritation season. Please provide documentation of the meter type and installation when available. 3. An application for tiered rate structure based on metered water usage will be submitted to IPUC. Please provide a copy when available. 4. If the above items cannot maintain minimum pressures of 40 psi within the distribution system, other measures including installation of variable frequency drives, pressure monitoring stations and other capitol improvements wil be required. Specifically, the Department understood the following during the compliance conference: a. If minimum pressures of 40 psi within the distribution system cannot be maintained, Morning View shall be prepared to install variable frequency drives before the peak irrigation season. b. Pressure monitoring stations wil be installed to document distribution system pressures. c. The number of service connection has increased by 35% since 2002; an additional well to provide pek hour demand with the larger well out of service as required by IDAPA 58.01.08.513, is needed. The Department is aware Morning View Water Company has applied for but not received additional water rights by the Idaho Departent of Water Resources. The Water Company expressed the commitment to add an additional source upon securing the water right. Additional design elements may be needed as part of the plan and specification submittaL. The new well shall have sufficient dedicated on-site standby power, with automatic switch-over capability, so that water may be supplied to pressurize the entire distribution system during power outges. d. Morning View needs to submit and implement a writtn cross connection control program. The plan is due January 2009. e. Morning View provided evidence of the installation of a flushing valve on the dead end, thus satisfying Item 9.h. ofthe Consent Order. f. Morning View provided a copy of the 3"l: quarter public notice on September 24, 2008. The notification for the 4th Quarter of2008 must be submitted no later than December 31, 2008. The proposed January 2009 plan to be submitted to the Department wil be incorporated into a finalized facility planning study as well as our September 2, 2008 letter comments.
