Dear Mr. Gneiting:
The final due date August 15, 2007 to submit in writing to the Idaho Department of
Environmental Quality (IDEQ) the diagnostic and corrective actions taken to resolve the
inadequate operating pressures for normal and peak flow conditions of the Morning View water
system has past with no response from you (see enclosure). Customer complaints oflow pressure
and no water continue to be log with DEQ, confirming Morning View Acres has not corrected the
below the regulatory minimum pressure of 40 pounds per square inch (psi) issue, therefore
as of August 16 2007 IDEQ has disapproved the public water system that serves your facility.
This action follows a history of non-compliance with the Idaho Rules for Public Drinking Water
System.
Morning View Water Company has violated the Distribution Pressure requirement of the Idaho
Rules for Public Drinking Water Systems. Due to the significant health hazard condition that this
violation presents and your unwillingness to work with DEQ, this office has no choice but to
disapprove the water system and pursue enforcement action. The enforcement action will consist
of a Notice of Violation (NOV), followed by a Consent Order between Morning View Water
Company and the IDEQ. The Consent Order will include a time schedule and plan to b!'ngi:hewater system back into compliance.

Dear Mr. Gneiting:
This letter is a follow up to our July 25 , 2007 correspondence regarding the water pressure
complaints from your customers, We requested you notify this office in writing by August 6
2007 of the diagnostic and corrective actions taken to resolve the inadequate pressure including
operating pressures for nonnal and peak flow conditions,
We have not received any communication from you regarding compliance with IDAPA
5.8.01.08,552., requiring a water pressure investigation in the Morning View water system.
You have a final deadline of August 15 , 2007 to notify this office of the diagnostic and
corrective actions taken to resolve the inadequate pressure. If we do not receive the requested
infonnation, an enforcement referral will be forwarded to the Office of Attorney General.

Dear. Mr. Gneiting:
This letter is a follow up to Rochelle Mason s (DEQ) site visit on July 5, 2007 following a
pressure compliant from one of your customers of the Morning View Acres public water system.
Due to a history of non-compliance with the Idaho Rules for Public Drinking Water System DEQ
is considering disapproving the public water system Morning View Acres. The enforcement
action will consist ofa Notice of Violation (NOV) and Consent Order between Morning Viewand the IDEQ.
The fonowing are significant Health Hazard conditions identified during ~EO's July 5. 2007 site
visit that violate IDAP A rules for drinking water svstems that shan be corrected in order to avoid
enforcement actions taken against the Morning View water system:
1, Distribution pressure was measured at five (5) connections within the Morning View water
system that showed the average system pressure at 30 psi, at 1:45 p,
IDAPA 58.01.08,552,ii.states: Any public water system shall maintain a minimum pressure
of forty (40) psi, throughout the distribution system, during peak hourly demand conditions.
2, Pictures were taken during the July 5th site visit that shows that the second source
is not hooked to the distribution, Our records indicate during a February 23, 2007 phone
conversation with Rochelle Mason you verified that a new variable speed pump was being
installed in Well # 2, Another phone conversation, on July 5, 2007 with Rochelle upon
receiving another pressure compliant, you informed DEQ that the new pump had not yet been
installed due to costs restraints.
mAPA 58,01.08.513.states: Community water systems served by ground water shall have a
minimum of two (2) source is they are intended to serve more than twenty-five (25) home.
DEQ requests you comply with IDAPA 58,O1.08.552,and mAPA 58,01.08,513,within ten
(10) days of receipt of this letter in accordance with the Idaho Rules for Public Drinking Water
Systems, Failure to comply with the Idaho Rules for Public Drinking Water rules will result in
enforcement actions with civil penalties, This may also include new service connection
moratorium,
