COMMISSIONER ANDERSON:Okay,here we 4 go. 5 Good afternoon.This is the time and 6 place for a customer hearing in Case Number 7 ISL-W-23-01,also referred to as In the Matter of 8 Island Park Water Company's Failure to Comply with 9 the Idaho Public Utilities Commission Reporting and 10 Fiscal Requirements. 11 The purpose of this hearing is to take 12 testimony from the members of the public in reference 13 to Island Park Water Company. 14 My name is Eric Anderson,and I will 15 chair today's proceedings.I'm joined with 16 Commissioner Hammond to my left,and Commissioner 17 Lodge to my right.The three of us comprise the 18 Commission in this case and will collectively make a 19 final determination on the matter. 20 Today's objective is to take live 21 testimony,which will be added to the underlying 22 record of the case.The commissioners will review 23 the facts and evidence in the record to make a final 24 decision in the proceedings. 25 For those of you wishing to submit PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 5 1 written comments,we have comment sheets available in 2 the back,and if you need a copy of that,get ahold 3 of our public information officer,Adam Rush,over 4 here. 5 We don't have too many people signed up 6 here.I know we had so:me kind of a time limit,so -- 7 I normally have a time restraint,I think we'll put 8 it at three minutes,but we are not gonna hold you 9 fast.But if you go on and you want to write a book 10 and talk for 15 or 20 minutes,we might ask you to 11 speed it up. 12 As far as the procedure goes this 13 evening,I will call your name from the signup list 14 and you will take the stand,and you will be sworn by 15 our attorney,Ms.Sharp,will who will ask you to 16 raise your right hand and swear or affirm that the 17 testimony you are providing is the whole truth.The 18 Deputy Attorney General will then ask you to identify 19 yourself for the record,which will include your 20 name,spelling of your last name,your city of 21 residence,and whether you are a customer of the 22 Island Park Water Company,then you may present your 23 testimony. 24 Please remain seated to see if the 25 parties excused. 3 I want to take this opportunity to 4 remind anyone who plans to offer testimony today that 5 the substance of your testimony should focus on the 6 matters being decided.Any testimony that focuses on 7 policy issues that we,as economic regulators,do not 8 have any control over,we will direct you to the 9 agency that you need to speak to,because we're 10 economic regulators,we are not the DEQ or anything 11 like that. 12 While we invite and encourage anyone who 13 wishes to testify,please respect to the time of 14 others;we kind of already went through that.As you 15 provide your testimony today,please remember that 16 the decorum of this the proceeding is similar to a 17 courtroom;your comments should be directed to the 18 commissioners and not to members of the audience.We 19 don't have a dais,a place to is stand today,so you 20 are allowed to sit down.For those in the audience, 21 we ask you to refrain from reacting to any testimony. 22 Sometimes in these little small quasi judicial role,we must base the decision on the 6 judicial record,of which this is a part of that. 7 That record is also significant in the event that our 8 decision is appealed. 9 I'm going to ask of the attorneys for 10 the parties:Do we have Island Park Water Company 11 here today?We do,and that would be Ms.Dorothy 12 McCarty.And also,Ms.Claire Sharp is our counsel. 13 I think we testified as follows: 10 MS.SHARP:Could you please state your 11 name and spell your last name for the record? 12 MR.WILCOX:Wade Brent Wilcox, 13 W-I-L-C-O-X. 14 MS.SHARP:And what is your city of 15 residence? 16 MR.WILCOX:Full time residence, 17 Blackfoot,Idaho. 18 MS.SHARP:Are you an Island Park 19 customer? 20 MR.WILCOX:Yes,I am. 21 MS.SHARP:Please go ahead. 22 MR.WILCOX:Can everyone hear me?I 23 usually don't need a microphone. 24 COMMISSIONER ANDERSON:You're fine. 25 MR.WILCOX:Am I good? PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 9 1 COMMISSIONER ANDERSON:Yeah. 2 MR.WILCOX:My dealings with Island 3 Park Water Company started in July of 2012,when I 4 purchased my property in the Shotgun area.At that 5 time I was told the water was $280 a year.Okay,no 6 big deal.I believe we paid the water --that's when 7 they were sending the water assessments out in June 8 and July --we paid the water then,and at that point 9 we were notified by Ms.McCarty that the previous 10 owner had not paid water for three years prior to us 11 purchasing the property,absolutely unbeknownst to 12 us.Quite honestly I didn't feel that was my 13 responsibility. 14 We worked with Ms.McCarty through the 15 red stuff taking property because of nonpayment of 16 water,et cetera.We finally reached an agreement 17 and we paid the back water that was prior to my 18 purchase of the property.Thought,okay,well let's 19 move on from this and keep going. 20 The following spring there was a lot of 21 water out in front of my driveway along the edge the 22 road;it made quite a pond.I talked to people about 23 it,and they said that it was --I had been told it 24 was a spring and it would dry up as the weather got 25 warmer.That year it did get a little bit better and PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 10 1 it did somewhat dry up,but long story short,we 2 could drive over there right now and this spring is 3 running full bore.The spring happens to be right 4 where the water line runs.This --I had spoken 5 to --this lien was dug up to be repaired,my 6 understanding,about 2017,by Island Park Water 7 Company. 8 I talked with --I'm sorry,by Island 9 Park Services.I spoke with Tim Vollweiler,and Mr. 10 Vollweiler told me that when he shut off the water 11 system to do the repair the spring stopped.He then 12 dug it up,fixed everything that he could find that 13 would fix right there.But he also told me that -- 14 at that point he recommended that the entire line be 15 replaced because there was spider cracks everywhere. 16 Long story short,the repair was done. 17 It seemed to get a little bit better for a while, 18 then it started to --approximately two years later 19 it start the leaking really bad again.Multiple 20 calls to Ms.McCarty about this,and I keep just 21 getting told that it was a spring,that it was not 22 the water system,it's a spring.Well,that's kind 23 of become the joke in the neighborhood of the spring. 24 I guess maybe I have waterfront property.I should 25 be happy with that. PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 11 1 And 2019 Valley View Services,that's 2 Pierce's company,Ray Pierce's company,was hired to 3 --I don't know how they finally got it approved -- 4 to dig up the spring to fix it.Once again they dug 5 it up,repaired everything they could find.I spoke 6 with the technicians on site at that time,and they 7 once again confirmed that the spring stopped when 8 they shut the water off to do the repair. 9 It was my understanding in 2019 that it 10 was repaired.In the fall of 2019,before the snow 11 came,I hadn't seen any water.I was quite happy 12 that we had finally had the situation taken care of. 13 January 1 of that winter I went to leave 14 with my snowmobile trailer and had to come into the 15 snowbank just a little bit close to where the spring 16 used to be to get it out and dropped my entire side 17 of my trailer in it,and I've got $10,000 in damage 18 to my snowmobile trailer,along with a wrecker bill 19 to get the truck and trailer out.Anyway,long 20 story,got the truck and trailer out,took care of 21 the repairs. 22 Now I'm starting to noticed that my 23 garage on my property that was built to Fremont 24 County codes,inspected,everything taken care of in 25 2012 and 2013,it started to settle on that side on PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 12 1 that front corner,and the only reasonable reason 2 would be the constant flooding,because it's never 3 not wet there. 4 I guess I have frustrations in the fact 5 that I've always been the person --as far as I'm 6 concerned I need the water.$280 a year is very 7 reasonable,and I paid my bill every year. 8 We'll go on to the next chapter of that. 9 I started in the beginning --sorry I'm jumping 10 around.For the first five years after I purchased 11 the property,every year I would get --we would pay 12 the water bill,the next year we would get a water 13 bill saying that we were in arrears for the year 14 previous,so we owed two years plus all the interest 15 and late fees.We would go through sending canceled 16 checks,et cetera,go through all the motions to 17 prove that it had been paid,and then the next year 18 you'd turn around it and it would be the same thing. 19 Finally on the fifth year Ms.McCarty 20 notified my mother,which handles the water part of 21 this,that she was putting the wrong lot number on 22 her check,that's why it was not getting credited to 23 the correct account.We informed her that along with 24 the check we always send back a copy of the bill that 25 shows that lot number on there.So if there's an PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 13 1 issue with the lot number,it's an accounting issue 2 with the water company,it's not our issue. 3 So then I go back and I think,okay,did 4 we really owe that three years of water that was 5 charged to me from the previous owner?She never did 6 give me a name,she just said the previous owner. 7 Well if the lot number was incorrect on my billing 8 for five years after that and I keep getting told I'm 9 not paying the bill. 10 I guess my biggest issue is business 11 that does not seem to be being run as a business. 12 Customers pay for a service,they expect to have that 13 service.And when there's a problem,such as a 14 broken water line in front of your place,you expect 15 it to be repaired.Were ten years in,the water 16 line is still not repaired.And there is absolutely 17 no way possible that Ms.McCarty is not completely 18 aware of that because she's had multiple contacts 19 from myself,when she would take them,as well as all 20 the neighbors around.So it's not a we didn't know 21 about the situation,it's a making excuses situation. 22 Sorry if I'm a little gruff,but that's the way I 23 feel. 24 COMMISSIONER ANDERSON:Thank you,Mr. 25 Wilcox. COMMISSION HEARING -Vol.1 -March 29,2023 15 1 the Company? 2 MR.RUMSEY:Yes. 3 MS.SHARP:Thank you. 4 MR.RUMSEY:Okay.Public speaking is 5 not my line of country,so excuse me. 6 COMMISSIONER ANDERSON:Take your time 7 and don't be nervous. 8 MR.RUMSEY:Okay.Our cabin house is 9 on 5162 Jones Drive,which is in the Valley View 10 Subdivision.And we bought the property in 2018 to 11 remodel it and kind of proceed from there.In the 12 springtime --so paa bought it in the fall,we worked 13 all winter,in the springtime we started having 14 issues with broken lines throughout the --in a 15 couple different areas in the subdivision.To 16 Dorothy and Roger's credit,they answered the phone, 17 they did respond,they seemed concerned. 18 And at first it seemed like it was a 19 quick response.They were actively involved in 20 trying to figure out the leaks.But because they 21 were a hundred miles away,Roger got on the phone 22 with me and said go to the well,here's where the -- 23 I was unfomiliar with it because we just bought the 24 property,but Roger walked me through where the well 25 was,where the disconnects were,where the electrical I PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 16 1 boxes are over the phone. 2 Since we bought the property I've never 3 seen a no trespassing sign,I've never seen a sign, 4 there's never been a lock on Valley View wells since 5 we have owned that property.There's two wells 6 there,they call them the upper and the lower.I've 7 never seen a lock or a sign period,because for 8 one --and I'm not the only neighbor that gets called 9 to go look at the well when there's an issue.If it 10 was locked,how would anybody have access to the 11 well?There's no keys because there's no locks,and 12 there never has been. 13 Mrs.McCarty has said that she has 14 relationships with --because she's a hundred miles 15 away,she has relationships with people,and I'm only 16 speaking for Valley View,but she has relationships 17 for people to go to these wells to check them out and 18 figure out what's going on.And when she says these 19 people,it's homeowners.So homeowners have complete 20 access under the encouragement of Island Park Water, 21 because we're the ones that have no water.And so 22 when we call for the co:mplaint --and from what I 23 understand Roger is in Pocatello,not Idaho Falls,so 24 for him to come up is even a bigger issue because 25 he's in Pocatello.So I strongly disagree with the PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 17 1 testimony that's been given as far as signs and 2 locks,because that is --that's just not true,okay. 3 Every spring the wells are --or every 4 spring there's always an issue with the wells because 5 the lines are so shallow in Valley View.There's 6 always --it's always frozen in every winter.So 7 subsequently in the spring it's whack a mole on 8 trying to find the hole,or trying to find the 9 cracks,because everything's frozen through the 10 winter,and then it's just a patch and repair game 11 every spring. 12 It's my opinion that because Island Park 13 Water Company refuses to update and modernize any 14 lines,any wells,any element of technology in those 15 systems,and quite honestly I know it will never 16 happen,again,because if it's been 50 years of 17 neglect,what's going to give anybody one ounce of 18 hope that for the next 50 years it's gonna be any 19 better?It's zero.So until there's a change,it's 20 not going to happen.And I think with the testimony 21 that's been given,it's been proven that physically 22 they are not capable to do it,and financially 23 there's no way in hell it's gonna happen. 24 So as a homeowner that drinks that 25 water,we are advocating that there has to be a PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 18 1 change.Later on as the call would come that there's 2 a break,there's an issue with the well,the quick 3 response that we used to get from Dorothy and Roger 4 turned into bullying and making stuff up that we knew 5 was completely not true as far as what we could and 6 what we couldn't do on our property.So the 7 restrictions had started to come where,well,you can 8 only have one person in the house,you got to pull 9 your washer and dryer out,you got to pull your 10 dishwasher out,you got to do your laundry 30 miles 11 away because you're a drain on the well. 12 Well,yes,we are a short term --we 13 have a permit for a short term rental,but we also as 14 a family,we have our family that comes that we've 15 blocked out and access the cabin and have our time. 16 But,you know,things are being thrown at us that -- 17 Island Park Water Company has no authority whatsoever 18 to dictate to us whether or not we have a washing 19 machine,whether we have a dishwasher,how many 20 people can actually show up and participate in our 21 house.So when we would get back on some of these 22 requests that's when it started turning into the 23 bullying,and,you know,the name calling and the 24 threats and...that's essentially the bulk of it. 25 COMMISSIONER ANDERSON:Thank you very PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 19 1 much,Rees. 2 MS.SHARP:And are you a customer of 7 Island Park? 8 MS.MAROTZ:I am not. 9 MS.SHARP:Please go ahead. 10 MS.MAROTZ:So I as I've just stated,I 11 am not a customer of the Island Park Water Company,I 12 am the city clerk for the City of Island Park. 13 My intent today is just to let you know 14 that because of the closeness of the name,Island 15 Park Water Company,people assume that it is governed 16 by the City of Island Park.Because of that --and 17 let me say also the City of Island Park has no water. 18 Everything in the city is either private or shared 19 wells.We have no water system.So because of the 20 closeness of the name,and people come from other 21 municipalities where there are water systems,they 22 assume that this is our water system.Because of 23 that,I get numerous complaints all times of the 24 year,we have no water,our water is frozen,how do 25 we get our water unfrozen.And my question is always PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 21 1 where is your address so I can see if it's in the 2 city.Very few of the Island Park Water Company 3 customers are within the City of Island Park. 4 We have some very strange and limit -- 5 seek to limit actions on --there may be ten homes in 6 the Valley View area that would fall within the city 7 jurisdiction,but that doesn't limit the calls I get. 8 I'll give a specific example from last summer. 9 As you know,we have several short term 10 rental properties within the Island Park area.A 11 family had come from out of state,parents,six 12 children,arrived at their rental,no water.They 13 had not been informed that there would be no water. 14 They contact the property manager,who was also 15 unaware that there was no water.She told them that 16 normally people aren't at the home during the day,so 17 if they needed to flush the toilet they were going to 18 have to purchase water,and they would have to 19 purchase water to drink for the remainder of their 20 stay.They were here for six and a half days with no 21 water.No attempt was made --this is the 22 conversation that was relayed to me,because they 23 called to complain to me because they thought it was 24 city water.No attempt was made to rectify that 25 situation.I probably get,in a summer,ten calls. PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 22 1 Now I have what I assume is the correct contact 2 information for the Island Park Water Company,which 3 I relay to those people.And that's the last of I 4 hear of it. 5 So there are problems that I hear about 6 that I have no control over,and that was just my 7 commentary today,was that I hear the problems,but 8 I'm not in a position to do anything about em. 9 COMMISSIONER ANDERSON:I thank you. 10 The question I have for you -- 11 THE WITNESS:Yeah. 12 COMMISSIONER ANDERSON:--is do you 13 have the number for the Public Utilities Commission? 14 THE WITNESS:I do. 15 COMMISSIONER ANDERSON:If you ever 16 do --are you here in the capacity as a clerk and 17 personally both? 18 MS.MAROTZ:Yes. 19 COMMISSIONER ANDERSON:In the future, 20 if you do get complaints,could you advise those 21 individuals that they can call the PUC also? 22 MS.MAROTZ:I will. 23 COMMISSIONER ANDERSON:We would 24 appreciate that. 25 MS.MAROTZ:Okay. PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 23 1 COMMISSIONER ANDERSON:And also I would 2 like to personally thank you for taking the time and 3 being a participant and giving us information -- 4 MS.MAROTZ:Yep. 5 COMMISSIONER ANDERSON:It's very nice 6 of you. 7 Do the commissioners have any questions? 8 Thank you very much for your testimony. 9 MS.MAROTZ:You're welcome. 10 (Witness excused.) 11 COMMISSIONER ANDERSON:Marlin Glans? 12 M A RL I N GL A N S, 13 called as a witness,having been first duly sworn, 14 was examined and testified as follows: 15 MS.SHARP:Could you please state your 16 name and spell your last name for the record? 17 MS.GLANS:My name is Marlin Glans, 18 G-L-A-N-S. 19 MS.SHARP:And what is your city of 20 residence? 21 MS.GLANS:Island Park. 22 MS.SHARP:And are you a customer of 23 Island Park? 24 COMMISSIONER ANDERSON:I'm sorry,I 25 called,you Marlin,I didnt mean -- PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 24 1 MS.GLANS:Oh,it's Marlin. 2 COMMISSIONER ANDERSON:Sorry. 3 MS.GLANS:It's all right. 4 In 1996 I moved to Island Park.I live 5 on Aspen Ridge,and we're on the water system there. 6 I can't tell you how long our --at what 7 point I met Dorothy or we had any kind of a water 8 problem;but any time I have called Dorothy,it 9 doesn't matter what time of day or evening it is,I 10 get an immediate response.If she is not there,I 11 leave a message and she calls me back. 12 We --you know,I tell her what the 13 problem is,we have no water.She immediately does 14 something about it.In fact one time I called her, 15 and I believe she was in Arizona visiting a daughter 16 or something,she still responded,and immediately 17 she made contact and had,you know,had the well 18 repaired,whatever the reason was. 19 I think the fee that we pay is more than 20 reasonable,you just simply can't find that in any 21 city I'm sure;very,very reasonable.I know there 22 are some problems because our society has changed and 23 we now have a lot of rentals in Island Park,and I 24 don't know if she co:mpensates for that by an 25 increased fee.I assume she does.I think --I PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 25 1 don't know if she has businesses on her well --on 2 her wells,different wells,I can only speak about 3 Aspen Ridge.But I have never had any time when she 4 has not responded to me.And she follows through, 5 she calls me back to make sure I'm happy that it's 6 back on. 7 The other thing is last year I think we 8 had a boil order in June for some reason.She called 9 me to let me know,and she said she had posted it on 10 the entrances to Aspen Ridge.And she also told me 11 to be sure and call or contact any of my immediate 12 neighbors to let them know in case they didn't know. 13 So the only neighbor on my particular road,on Elk 14 Drive,happened to be home;the only one that was 15 home and on the system was across the road from me. 16 So I went across the road,told him,Joel says,well, 17 it's posted on all the signs,haven't you seen it? 18 Of course I haven't been out of my house,so I didn't 19 see it.But I just want you to know that I feel that 20 she has done her very best to correct any problem at 21 all that we've had on Aspen Ridge. 22 THE COURT:Thank you very much for your 23 testimony. 24 Any questions from the commissioners? 25 Thank you so much. PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 27 1 And when we purchased that,we were charged a $200 2 connection fee,even though it was already connected 3 and the previous owners had already paid the bill;I 4 believe this was in May or June,I can't remember,I 5 would have to pull those up.So that was my first 6 interaction with Dorothy from when we called her 7 about that.And she said that it didn't matter, 8 anybody switching to Island Park Water has to pay 9 that $200 connection fee. 10 And then in 2018 we purchased the house 11 right next door and ended up selling that other one. 12 And the one next door we were not build the $200 13 connection fee and we just had to pay the $280 in 14 April.We moved up to Island Park --oh no,then we 15 purchased another property on Cherokee that we were 16 using for a rental,short term rental.We bought it 17 as an investment property. 18 When I called Dorothy about that,again, 19 we were not charged the $200 connection fee,but I 20 did call her about that to make sure about switching 21 our names and stuff.At that time I was told that it 22 was behind in payments and I was going to be 23 responsibile for paying all of those.We were still 24 working on the closing,so I worked with my title 25 company to make sure that that was all taken care of PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 28 1 and told Dorothy that title would take care of that, 2 and she said,well,well see about that.So I made 3 sure at the end that I got it in writing from title 4 to let her know it was taken care of and that I 5 didn't need to be billed for that and that I would 6 just pay for it going forward.I was also --because 7 it was a rental --or if she found out it was a 8 rental she could turn our water off.That property 9 the water froze up on it,and then,you know,COVID 10 hit all that good stuff.We ended up selling it. 11 And then we moved up here full time in 12 June 1st of 2019.When we came up here our water was 13 frozen,and we didn't have water until June 17th.So 14 we had small --you know,our kids and us up here 15 living full time with no water.We ended up 16 purchasing the lot across from us --we just keep 17 bouncing from house to house on the some road and put 18 a house on that.We got the connection for that and 19 got it approved,paid for that.That water froze up 20 in 2021 because we thought we were safe from where it 21 was located compared to the other house,and we left 22 the water running at our other house,but it ended up 23 freezing and we ended up having like a flood going 24 into our yard and into our crawl space from the pipe 25 bursting. PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 29 1 So Ray Pierce had come over and dug that 2 up and temporarily fixed it,but we had this huge 3 hole in our driveway for 11 weeks.I finally had to 4 send Dorothy pictures via text and threatened her 5 with a lawsuit if one of my kids fell in and hurt 6 themselves.At that point Dorothy was very nice and 7 immediately showed up --or she texted me and said 8 she was actually going to come to Island Park. 9 We met in person.As soon as she walked 10 up,though,she says I never approved a connection 11 for this house.But I was able to immediately go in, 12 grab my paperwork,and show that to her.I had kept 13 my text from her that said,oh yeah,we're all good, 14 because I had a fear that she was going to come back 15 and tell me that we had an invalid connection on 16 that. 17 Let's see.I think --oh,she also told 18 me while she was out there that she recommends that 19 we drill our own well,because if a well would ever 20 go dry she doesn't know if she would be able to fix 21 it and we would be out of luck on water unless we had 22 our own well. 23 I did do a private comment to you guys 24 because the last couple years I haven't been double 25 billed.I've been able to talk with Dorothy on the PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 30 1 phone,and if she knows my water might be going out 2 she will text me and let me know.But my fear was 3 that it will go back to me not being able to have 4 civil conversations with her and that I would start 5 to get threatened again about turning my water off 6 and stuff like that. 7 So this was a hard choice for me to come 8 in and bring this up,because the first several years 9 we lived in Island Park it was very hard to call her, 10 you just didn't know if you were going to get her in 11 a good mood or get her in a bad mood,and it made -- 12 it just made it difficult. 13 I've also been told that we should only 14 have two or three people living in our house,but we 15 are a family of five,so that was an issue.It's 16 also written on our bills that we --that we need to 17 limit our usage to approximately three people per 18 connection.And that's I guess really it. 19 I would really like to be on a water 20 system that I could use year-round.We have moved 21 down to Ashton to get the kids closer to school,but 22 we've had one year since we owned property up here, 23 since 2017,where we were actually able to keep our 24 water running year-round.And we run a hose from our 25 house out to our yard so it can run,but if the power PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 31 1 goes out the water goes out;and if it's cold,the 2 pipes freeze;and then once it freezes on the road, 3 all seven cabins on our road lose water. 4 So that's all I have.I don't know if I 5 can read a statement from somebody else,Neil Hamann 6 Property Management? 7 COMMISSIONER ANDERSON:Could I call you 8 back up so that we can go in order? 9 MS.MICKELBERRY:Sure. 10 COMMISSIONER ANDERSON:Before you 11 leave,do we have any questions from the 12 commissioners? 13 COMMISSIONER KAMMOND:I just have one. 14 If its from somebody else,I think the 15 appropriate thing to do is to like submit it,like if 16 you submitted a written comment. 17 MS.MICKELBERRY:Okay.I work for them 18 as a property manager,and it's from the office that 19 they have had dealings with them.I mean that's 20 fine,too,they will submit it during public comment 21 online if they want. 22 COMMISSIONER KAMMOND:Do you have the 23 written statement with you? 24 MS.MICKELBERRY:It's in my jacket, 25 yes. PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 34 1 MS.VOLLWEILER:It's Kelli,and the 2 last name is Vollweiler,V-O-L-L-W-E-I-L-E-R. 3 MS.SHARP:And what is your city of 4 residence? 5 MS.VOLLWEILER:Island Park. 6 MS.SHARP:And are you a customer of 7 Island Park? 8 MS.VOLLWEILER:I am a customer,and I 9 also do work for Island Park Water Company. 10 MS.SHARP:Okay,thank you. 11 MS.VOLLWEILER:You're welcome. 12 So I had lived on Chootaw Road for 13 probably a little over twelve years,and I have never 14 had any problems with my water freezing or not 15 freezing,never had a bad water test come back. 16 My husband ran Island Park Water 17 Services for about 30 years,he passed away two and a 18 half years ago,and I've been running the Company 19 since them.I've done quite a bit of work for 20 Dorothy;easy to work for,pays her bills. 21 The water system is old.The lines in 22 the roads are shallow in some spots and deep in 23 others,and I'm assuming it was put in the 60s into 24 the 70s,and as summer use only is what I was told by 25 my husband. PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 35 1 We have worked in every one of these 2 areas that she's got wells.And $280 a year for 3 water,it probably takes four or five homes just to 4 pay my bill for working on them,every time I work on 5 them.It's not enough to maintain the water system 6 as far as I'm concerned. 7 It's expensive,every part and piece 8 that I put in the ground is expensive.The labor she 9 has to pay is expensive.And I don't think I run a 10 company that is overcharging.The water in the 11 ground and the roads,the way they are plowed,has a 12 lot to do with the water lines freezing.So you do 13 have homeowners that plow across their water lines 14 and drive over them,they're gonna freeze;you've got 15 water running down one side the road,somebody comes 16 in and plows on it,they freeze. 17 I don't think this is all Dorothy's 18 fault.A lot of it is old,and the cold --I mean 19 you guys it's 20,30 below zero here,water's gonna 20 freeze.And my concern with everybody leaving their 21 hoses on to keep it fro:m freezing is now she's got to 22 pay an astronomical power bill,because the well that 23 sits in my yard just never quits.This just isn't 24 fair.And I don't know why Dorothy keeps her water 25 running.It's hard to work and run a company when PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 36 1 you've got so many people after you,is my thoughts. 2 As a ho:meowner,my water's never gone 3 off,never been frozen,never tested bad.My husband 4 died of cancer.For three and a half years I had my 5 water tested to make sure it wasn't causing his 6 illness.The state came back and said,Kelli,your 7 water is perfect;you've got no problem with your 8 water. 9 That's all I've got to say. 10 COMMISSIONER ANDERSON:Thank you,Ms. 11 Vollweiler. 12 MS.VOLLWEILER:You're welcome. 13 (Witness excused.) 14 COMMISSIONER ANDERSON:Ann Anthony? 15 MS.ANTHONY:That was easy to 16 pronounce. 17 A NN A NTHON Y, 18 called as a witness,having been first duly sworn, 19 was examined and testified as follows: 20 MS.SHARP:Could you please state your 21 name and spell your last name for the record? 22 MS.ANTHONY:Ann Anthony, 23 A-N-T-H-O-N-Y. 24 MS.SHARP:And what is your city of 25 residence? PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 37 1 MS.ANTHONY:Island Park. 2 MS.SHARP:And are you a customer? 3 MS.ANTHONY:I am. 4 MS.SHARP:Thank you. 5 THE WITNESS:I agree with everything 6 Kelli said by the way.Maybe not everybody else 7 feels this way,but the reason we have a lot of 8 problems with this system is,number 1,it's too 9 shallow,and there's no money to do any remediation 10 to that.So maybe that needs to change. 11 I don't know who sets up how much the 12 shares are per lot,but that needs to be looked at, 13 because we need to bury these lines deeper.And I 14 know that's an issue in some of the areas because the 15 bedrock is so shallow in some areas,but as of right 16 now I'm without water. 17 I bought this property a year ago 18 January.No problems last winter.I bought it from 19 former resident Connie Carter,but I've been without 20 water almost a month now.And I know part of it is 21 the lines are shallow,and we've been plowing the 22 road,but to me that's,that's something that we need 23 to remedy.So I don't know who makes the decision to 24 raise fees or to let us do some remediation on those 25 lines,but that needs to happen. PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 38 1 I do have a suggestion for Dorothy.My 2 water was off,I want to think at least five times 3 last summer for repairs,but we don't get a 4 notification that it's gonna happen. 5 I also publish the Island Park Newspaper 6 here,and I would be glad to help her set up email 7 accounts for each of these subdivision so she can 8 send out a broad email saying,hey,your water could 9 be off in this subdivision tomorrow do to repairs. 10 And I know they do the repairs as quickly as they 11 can,but it's always four or five hours. 12 And I have neighbors that have called 13 and said,is your water out?Yes,my water is out. 14 Well,I need a shower before I go to work.Well, 15 you're SOL.So we really need a system for you 16 that's easy to let people know that their water is 17 going to be out in your subdivision for repair.That 18 could be sent out the night before.That would help 19 you tremendously on the front,and that would help 20 all of us know in advance.And I would be glad to 21 help you with that.I have a lot of email addresses. 22 MS.MCCARTY:Can I answer your 23 question?Ann,every time we -- 24 COMMISSIONER ANDERSON:Excuse me.No. 25 MS.MCCARTY:Okay. PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 41 1 MR.THOMPSON:Rigby,Idaho. 2 MS.SHARP:And are you a customer? 3 MR.THOMPSON:Yep. 4 MS.SHARP:Thank you,go ahead. 5 MR.THOMPSON:I guess I would like to 6 start out with I've had three cabins up here,and the 7 last one I bought is on Jones Drive.Excuse me. 8 We bought the cabin I believe in 9 November I believe of '19,and didn't get a water 10 bill until the following year from Dorothy,and the 11 water bill was $480 dollars.I guess I didn't really 12 think anything about it.I did call Dorothy and I 13 said,okay,what's going on here?My bill is 14 supposed to be $280.And she says,well,the people 15 didn't pay the following year.And I'm just 16 thinking --I'm sorry,I don't want you shaking 17 heads,but that's exactly what you said.And so I 18 let it fly,I did pay her. 19 The next year,that winter in between 20 March and May,I called Dorothy up in March,I says 21 hey Dorothy,we have no water.And she didn't answer 22 the phone right away,but she did call.I said 23 Dorothy,we have no water,we need to do something 24 about this.Nothing I can do.It's froze.Okay.I 25 let that one slide because we were working on it. PUBLIC UTILITIES COMMISSION HEARING -Vol.1 -March 29,2023 42 1 And last year same thing again.About 2 March froze up again.I called Dorothy.She did not 3 respond.I did call her two weeks later.She 4 finally did respond to me and says same thing, 5 there's nothing I can do,the water's froze. 6 And in about May one of the neighbors 7 calls me up and says,hey,there's some water leaking 8 just below your house.And,yes,we pulled it out 9 with ropes,but where the water line was broke was 10 about 10,15 feet further.And this leaked for a 11 while,and they did take care of it pretty quickly,I 12 think it was in within a week. 13 The thing that bothers me just a little 14 bit is we had this cabin sold last year,and one of 15 the comments on the thing for the people to buy this 16 cabin was make sure the water was okay.Well,the 17 water didn't come out so we lost the sale of our 18 cabin. 19 That's pretty much all I got to say. 20 COMMISSIONER ANDERSON:Thank you,Mr. 21 Thompson for your testimony. 22 Is there any questions from the 23 Commission? 24 Thank you very much. 25 (Witness excused.)
