COMPANY, INc.
Falls Water Company s response to the first production request ofthe commission staff.
The records are held by Falls Water Company in their main office located at 1770 Sabin
, Idaho Falls, Idaho 83406. Scott Bruce is the contact person for the records and can
be reached at (208) 522-1300. Scott Bruce, Manager, will be the witness who can
sponsor answers at hearing for the responses to the production requests.
Request No.
Scott Bruce, Manager, prepared response to Request No.1. Falls Water Company has
provided its customers with water conservation information in the copy of the ' Spout' ,
the company s information pamphlet (See Request #1 Attachment' A'). The paragraph
entitled 'Sprinkling ' is all the information that the company has provided universally to
all customers, both metered and flat rate, once each year at the end of June. If customers
have contacted our office about ways to conserve water, we have given them additional
verbal instructions about water conservation.

Scott Bruce, Manager, prepared response to Request No.2. Forty-five of forty-seven
meters in Henderson Park were replaced in March - June 2004. Two meters were not
replaced until July 2005. The angle valve in the meter barrel was not functioning and
there was trouble locating one of the meters.

Scott Bruce, Manager, prepared response to Request No.3. In 2004, twelve customers
out of a total of 135 customers, scheduled for shut-off because of non-payment, made
payments at the door when our serviceman came to their door (8.9% of the total). In
2005, ten customers out of a total of 138 customers, scheduled for shut-off because of
non-payment, made payments at the door when our serviceman came to their door (7.
of the total). Although the numbers seem small, the fact is that each customer failed to
make a simple phone call or send in a payment after having received both the required
seven-day notice and the 24-hour notice. The seven-day notice is mailed to each
customer on the collections list and the 24-hour notice is hand delivered and hung on
each customer s door by a serviceman. The issue, we are looking at addressing, is that
the customers that wait to pay until our serviceman is at the door have failed to act
responsibly even after receiving two collection notices. They have created additional
work for our employees and wasted the time of our servicemen that could have been
better used to do the maintenance work around the water system. Copies of the shut-off
work orders are attached (See Request #3 Attachment #1).
Requests No. 4-
Scott Bruce, Manager, prepared response to Requests No. 4-6. Enclosed is a computer
disk with an Excel file containing the information requested. The file contains Customer
Type, Customer Account Number, Customer Usage by month, Identified trailer park
customers, metered trailer park customers, and any customers presently served by a
secondary irrigation system. Total water pumped for 2005 was 954 585 946 gallons (See
Request #4-6 Attachment #1).

Mickie Demitropoulos made copies of 2005 work orders (See Request #7 Attachments
#1). Work orders for normal maintenance and asset installation were not used prior to
2005. Mickie Demitropoulos, Sherry McNett, and Scott Bruce made copies of the asset
invoices for 2004 and 2005 (See Request #7 Attachments #2). Copies are enclosed with
this response.

Request No. 10-
Scott Bruce, Manager, prepared response to Requests No. 10. Enclosed are copies of the
settlement agreement with Twin Falls Canal Company and North Side Canal Company
(See Request #10 Attachment #1) and the Permit Approval Notice from State of Idaho
Department of Water Resources (See Request #10 Attachment #2) for the water right
appropriation for Falls Water Company. One of the stipulations, in the settlement
agreement, requires Falls Water Company to propose an ordinance to Bonneville County.
The ordinance would require that secondary irrigation of landscapes and lawns be used
rather than potable water sources. The draft of the ordinance has not been completed yet.
Our attorney, Kent Foster of Holden, Kidwell, Hahn, and Crapo, is preparing the draft of
the ordinance to be proposed. It will follow the intent of the example ordinances
provided in exhibit 'A' of the settlement letter (See Request #10 Attachment #1). It is
our intent to submit the proposed ordinance to the Bonneville County Commissioners via
letter no later than February 15 , 2006. The letter will contain the invitation to the County
Commissioners to meet with Falls Water Company representatives to discuss any
changes or alterations needed to make the ordinance viable for the County
Commissioners consideration.
Should the Bonneville County not approve the proposed ordinance, secondary irrigation
is still going to be our emphasis for new developments added to Falls Water Company
service area. The impetus for this course of action will be changes to Section 67-6537
Idaho Code, which became effective July 2005 (See Request #10 Attachment #3). The
changes state that when the use of land changes the water rights associated with that land
should be given first consideration when water use is needed for the new use for the land.
It is Falls Water Company s intent to see that land currently irrigated by an irrigation
district continues to use the irrigation district's water right to irrigate lawns and
landscapes in new residential/commercial developments.
Request No. 11 -
The summer rate as proposed would last for only six months with seven-meter readings
being taken during the time. The April meter reading (taken between the 10th to the 21
of the month) would provide the ending reading for the winter rate and the beginning
reading for the summer rate. The meters are read each month between the 10th to the 21
of the month through and including the month of October s meter readings. Six billing
cycles would be included in the summer rate, which historically is the total number of
metered billing cycles the customers have experienced. The six -summer rate billing
cycles include the following time frames (for ease of making the example assume that all
meters are read on the 15th of the month):
1. April 15 to May 15
2. May 15 to June 15
3. June 15 to July 15
4. July 15 to August 15
5. August 15 to September 15
6. September 15 to October 15
The reading in October would end the summer rate and start the winter, rate which would
be composed of six billing cycles as it is currently. The six-winter rate billing cycles
would be:
1. October 15 to November 15
2. November 15 to December 15
3. December 15 to January 15
4. January 15 to February 15
5. February 15 to March 15
6. March 15 to April 15
The seasonal rate structure would extend only to the metered residential customers
without secondary irrigation.
The Commercial customers and Multi-family residential customers currently are read
monthly and will continue to have monthly meter readings taken. If the meters are being
read monthly, it is the company s opinion that the rate for those customers should remain
the same throughout the year. The billings for the wintertime will naturally be less
because of reduced water use consistent with not watering lawns and landscapes.
The customers, who would be in areas using the proposed rate for in-house use only with
secondary irrigation systems, should have a flat usage year round and the proposed rate is
structured to discourage use of Falls Water Company s potable water for uses outside the
home. The 8 000 gallons per month included in the minimum rate is determined from
historical average monthly winter usage in the metered areas of our system.
