TO AMEND ITS CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY NO. 278 Case No. EAG-O4- STIPULATION COME NOW Eagle Water Company (Eagle Water) and United Water Idaho Inc. (United) by and through their respective counsel of record and stipulate and agree as fol1ows: In this proceeding, the properties to which water service has been requested have been referred to as the "Troutner properties " the "McKay properties" and the "Dry Creek Cemetery. See Hearing Exhibit 1 01. Following the evidentiary hearing held on September 22, 2004, Eagle Water and United Water, through. their counsel, conferred with each other with a view toward achieving a mutually agreeable allocation of the properties in question. Based on those discussions United and Eagle Watc:r have agreed that a reasonable resolution of this matter is for Eagle Water to provide service to the Troutner Properties and the Dry Creek Cemetery and for United to provide service to the McKay properties. Eagle Water and United respectfully request that the Commission enter its Order approving this stipulation and thereafter Eagle Water and United will file amended certificates of public convenience and necessity reflecting the additions of service area set forth above.
