STAFF TO DIAMOND BAR WATER
COMPANY
COMES NOW Diamond Bar Water Company, (the "Company ) by and through
its attorneys, WETZEL & WETZEL P.C. hereby provides the documents and
information requested by the Idaho Public Utilities Commission in it's First Production
Request of the Commission Staff to Diamond Bar Water Company.
Request No.1: Diamond Bar s filing in this case introduces the concept of
interruptible service. Please demonstrate that Diamond Bar Water System currently has
adequate facilities, source supply, and water rights to provide uninterrupted service to
the proposed service area expansion. Please include an analysis for domestic,
irrigation, and back-up supply.
DIAMOND BAR WATER COMPANY'S ANSWER TO
IPUC FIRST PRODUCTION REQUEST
Response: The Company has sufficient water and facilities to provide water
service. Please see Exhibit "A" attached hereto and by this reference made a part
hereof.
Request No.2: Please provide a map of suitable scale showing the location of
the construction or expansion and it's relation to other public utilities, corporations, or
persons with whom the expanded utility is likely to compete and the location of public
utilities in the area that offer or provide similar utility service. Reference IDAPA
31.01.01.112.02 and .03.
Response: The nearest public utility, the City of Rathdrum Idaho, is 1.5 miles to
the west. Adjoining on the east is the Stepping Stones subdivision which is supplied
water through the homeowner s association. Also see Exhibits "B" and "C" attached
hereto and by this reference made a part hereof.
Request No.3: Please explain how the existing Diamond Bar system will be
interconnected to the propose Boekel Estates service area and a full description of the
propose construction and expansion. Reference IDAPA 34.01.01.112.02.
Response: Please see Exhibits "B" and "C" attached hereto and by this
reference made a part hereof.
Request No.4: Please provide estimates of the cost to the Company of the
construction or expansion and the effects of the construction or expansion on Diamond
Bar s revenue requirement. IDAPA 34.01.01.112.05.
Response: Please see Exhibit "D" attached hereto and by this reference made a
part hereof which is an engineers estimate. The estimate will be updated as of the start
of construction as the materials for this project is market volatile.

IPUC FIRST PRODUCTION REQUEST
Request No.5: Please provide the proposed method of financing and the
anticipated construction schedule for the proposed construction or expansion. IDAPA
34.01.01.112.04.
Response: Developer will pay all costs incurred. The start date of the project is
set for July 15, 2004.
Request No.6: Regarding water rights:A. Will Diamond Bar Water be receiving any additional water rights
related to the expanded service area?
If so, in what quantity and under what conditions.
If not, please explain why not.
Response: A.
B. N/AC. The developer wishes to keep the water rights filed with the
Department of Water Resources.
Request No.7: Please describe the type and size of services anticipated for the
expansion area ego 1.5" metered domestic service, 1" metered domestic with 2"
metered irrigation service, etc.
Response: The services will be a 1" meter with a 2" line stubbed off of the main
line going from the meter to the house for irrigation
Request No.8: Regarding water charges for fighting fires:
A. Does the Company intend to submit a fire protection tariff?

B. Please explain why the Company requests that each customer
be responsible for the cost of all water used for tire fighting on
the customer s lot.
C. What is the proposed rate for fire fighting water and how was it
determined?
D. Please indicate whether a similar fire fighting charge is
requested for existing Diamond Bar customers?
Response:
The water used to fight a homeowner fire result in additional
electric demand billings that the Company now absorbs
without reimbursement. This electric demand billing can be
as high as $500.00 per incident.
The fire department has an estimated amount of water
usage per fire.
Per IPUC determined rate for Diamond Bar Estates Water --
45 per 1000 gals.
Not at this time.
Request No.9: Regarding the proposed restriction on using water for
commercial purposes:
Please define water used for commercial purposes.
Please explain why the Company is requesting that
Diamond Bar Water not be used for commercial purposes.
Please indicate whether a similar restriction is requested for
service to existing Diamond Bar Customers.
Response: Boekel Estates is zoned residential which does not allow
commercial business/usage in a residential zoning. The present customers of Diamond

Bar Estates are also zoned residential and the CC&RS back up that there is to be no
commercial business usage in this zoning.
Request No.1 0: Hook-up Fees:
Is the Company opposed to a hook-up fee for services in the expanded
service area?
Please provide a detailed estimate of the cost for installing a water service
line (from mainline tap to meter stub installation) to each lot in the
proposed service area expansion.
Will the service line be installed to each lot as part of the subdivision
development?
Please provide an estimate of the cost for installing a water meter in the
propose service area expansion.
Response: There is no opposition.
Please see attachment "E" attached hereto and by this
reference made a part hereof.

Request No. 11: Please explain why Diamond Bar Water has proposed different
General Rules and Regulations for the Boekel Estates development customers than
those already approved and on file with the Commission for the existing customers of
the Company.

Response: The General Rules and Regulation for Boekel Estates submitted to
date are intended to be a contract between the developer and the water supplier. The
rules on file with the IPUC will apply to the new customers as well as the existing
customers.
