COMES NOW Bar Circle "s" Water Company ("Bar Circle S", "Applicant" or
"Company") and files this response to the first production request of the Commission
Sta. Questions regarding these responses should be diected to:

Request No.1, Please provide a copy of the šiged water line extension agreement
between the Company and Double Tree Estates, the entity requesting water servce.
Response. The agreement is not yet finalized. A copy of the agreement wil be provided
as soon as it is fmalized. Applicant wil not sign a final agreement until it has included a
contingency clause that voids the agreement absent the approval of the Idaho Public
Utilities Commssion. The Company, its engineering consultat and the development
company are curently in discussion with the Idaho Deparment of Environmenta Quality
(DEQ) regarding required system improvements that may be required in the futue

all of these improvements be required, Applicant would propose a sharng of cost
between the water company and the developer based upon potential customer counts (Bar
Circle S potential customers 215 or 82% and Double T Estates potential customers 47 or
18%.) All other costs to expand the distrbution system into Phase Two of the Double T
Estates subdivision would be borne by the subdivision development company.
