USW-S-96-5 STIPULATION REGARDING THE SUBMISSION OF EXHIBITS COMES NOW the Appellant and Respondent in the above referenced case by their respective attorneys of record and submit the following Stipulation for the Commission’s consideration. Appellate Rule 31 requires that the Commission Secretary lodge all exhibits offered or admitted in a Commission proceeding and subsequently appealed to the Idaho Supreme Court.  As the Commission is aware, the number of exhibits in the above-referenced case are voluminous and in excess of 900 pages.  Moreover, there is only a single issue on appeal—“toll restriction.” A review of the exhibits in this case reveals that there is only one exhibit that is relevant to the issue on appeal.  Consequently, the parties have agreed and stipulated that with the exception of Exhibit No. 126, there is no need or necessity to file the remaining exhibits with the Idaho Supreme Court.  In lieu of filing the other exhibits, the parties suggest that the Commission Secretary file her certificate indicating that the parties have stipulated that there is only one exhibit to be lodged with the Supreme Court.  A copy of this stipulation should be filed with the Secretary’s certificate. PRAYER The parties respectfully request that the Commission adopt the parties’ stipulation that there is only one exhibit that is relevant to the appeal and there is no need to lodge any of the remaining exhibits in the underlying case with the Supreme Court.   RESPECTFULLY submitted this              day of March 1998.
