On March i, 2010, in response to Commission Order No. 30996, TracFone submitted a Petition for Reconsideration (withdrawn on March i i, 2010) along with a First Amended Application for Designation as an Eligible Telecommunications. Carrier. Please confirm that the Amended Application replaces the initial Application in its entirety. TO FIRST PRODUCTION REQUEST 2 MAY 3, 2010 REQUEST NO.2: On page 4 of the Amended Application, TracFone requests ETC designation statewide in all exchanges to the extent that its underlying carriers (AT&T Mobility, T-Mobile, and Verizon Wireless) have facilties and coverage. Please provide coverage maps of the three underlying wireless service carriers. RESPONSE: Coverage maps are provided in Exhibit 2. TO FIRST PRODUCTION REQUEST 3 MAY 3, 2010 REQUEST NO.3: Please provide a list of complete exchanges in Idaho that TracFone intends to offer Lifeline service. TO FIRST PRODUCTION REQUEST 4 MAY 3, 2010 REQUEST NO.4: On page 5 of the SafeLink Wireless™ Terms and Conditions of Service (Exhibit I 2, Amended Application), it states, "You may also purchase Safelink Wireless airtime cards at selected retail stores." Please provide a list of all Idaho retail and wholesale point of sale locations where an Idaho Lifeline customer can purchase, disconnect, reconnect, pay for, receive customer support for or interact with the Company concerning Lifeline services. Please include name of business and address RESPONSE: Retail vendors are not involved in the Lifeline application process. Neither are retail vendors involved in any aspects of service commencement, termination, or customer support processes. In fact, the FCC, when it granted TracFone forbearance of the facilities-based requirement, stated that TracFone, not a third party, must "distribute its Lifeline service directly to its Lifeline customers" and "deal directly with the customer to certify and verify the customer's Lifeline eligibility." TO FIRST PRODUCTION REQUEST 5 MAY 3, 2010 REQUEST NO.5: Please provide any other agreements, forms, documentation in addition to the Terms and Conditions of Service that wil be required of or provided to the Lifeline customer. Please include any applicable information from the website. RESPONSE: TracFone provides the terms and conditions of its Lifeline service to Lifeline customers in the welcome packet sent to Lifeline customers, which they receive with the free handset. TracFone also provides an enrollment form specific to each state to all Lifeline applicants. A copy of the welcome packet and a sample form from Florida are provided in Exhibit 5. Upon being designated as an ETC in Idaho, TracFone wil develop an Idaho-specific enrollment form based on Idaho's Lifeline enrollment eligibilty criteria. RESPONDENT: Jose Fuentes, Director of Government Relations, (305) 715-3727. RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 6 MAY 3, 2010 REQUEST NO.6: On page 2 of the Amended Application, TracFone states it seeks designation "solely for the purpose of providing Lifeline service, under the trade name SafeLinkCI Wireless, to qualifying Idaho consumers." Please explain TracFone's definition of a qualifying Idaho Lifeline consumer, including the standards that wil be used to determine qualification. RESPONSE: TracFone's SafeLink WirelessCI Lifeline enrollment form includes a place where the applicant must certify by his or her signature under penalty of perjury that the applicant meets the relevant criteria. For program-based eligibility, the form lists each of the qualifying programs for the State of Idaho (i.e., Bureau of Indian Affairs General Assistance; Federal Public Housing Assistance (FPHA) or Section 8; Food Stamps; Head Start; Low Income Home Energy Assistance Program; Medicaid; National School Lunch Program's free lunch program; Supplemental Security Income (SSI); Temporary Assistance for Needy Familes (TANF); and Tribal TANF), and the applicant is required to check off the program(s) in which he/she participates. For income-based eligibility, the applicant is required to certify under penalty of perjury that his/her household income does not exceed the relevant threshold (133% of the Federal Poverty Guidelines per 4 IDAPA 16.04.02.1 00.03) and is required to provide proof of income-based eligibility. In addition, pursuant to a FCC-imposed condition, each applicant is required to certify under penalty of perjury that he or she is the head of the household and that he or she receives Lifeline-supported service only from TracFone. TO FIRST PRODUCTION REQUEST 7 MAY 3, 2010 REQUEST NO.7: On page 5 of the Amended Application, TracFone states it has been designated as an ETC in 24 jurisdictions and is currently providing Lifeline to nearly 3 milion qualified low-income households in 21 jurisdictions. Please explain why the Company is not providing Lifeline in the remaining 3 jurisdictions. RESPONSE: TracFone is currently designated as an ETC in 28 jurisdictions and is providing Lifeline service in all of those jurisdictions except for Minnesota and South Carolina. In Minnesota, the state commission voted to designate TracFone as an ETC on April 22, 2010, but has not yet issued an order. TracFone will commence Lifeline service in South Carolina on or about May 10,2010. RESPONDENT: Jose Fuentes, Director of Government Relations, (305) 715-3727. RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 8 MAY 3, 2010 REQUEST NO.8: On page 12 of the Amended Application, TracFone states, "TracFone's Lifeline customers wil receive as part of Lifeline service 67 minutes of free wireless service." Please explain how TracFone determined free service would equate to 67 minutes. RESPONSE: In every state where TracFone offers Lifeline service, the Lifeline benefit is calculated based on a direct pass through of one hundred percent of the Lifeline support which TracFone receives from the federal Universal Service Fund ("USF"), plus an additional contribution by TracFone of $3.50 per customer per month. The amount of Lifeline support available to TracFone or any other ETC is determined based upon FCC rules, specifically Section 54.403 of the FCC's rules (47 C.F.R. §54.403). One of the factors which governs the amount of Lifeline support available is the subscriber line charge ("SLC") imposed by wireline incumbent local exchange carriers ("ILECs") pursuant to the FCC's rules. In Idaho, all ILECs, with the exception of Qwest, have a SLC equal to $6.50 - the maximum permissible SLC under the FCC's rules. Qwests SLC is $6.38. TracFone offers uniform Lifeline benefits statewide. In states, such as Idaho, where there is no uniform SLC, TracFone calculates a weighted average of the SLCsbased on how many households are in the service areas of the ILECs. For Idaho, TracFonecalculated the weighted average SLC as $6.40. Under the FCC's Rules, which set forth the tiers of support, TracFone may receive $9.90 in Lifeline support from the federal USF for each customer in Idaho ($6.40 (Tier One) + $1.75 (Tier Two) + $1.75 (Tier Three)). See 47 C.F.R. § 54.403. To receive $9.90 in federal Lifeline support in Idaho, an ETC must provide a Lifeline benefit of $13.40 ($9.90 + $3.50 additional contribution from TracF one). The number of minutes offered in Idaho is calculated by dividing the total amount of the Lifeline benefit to be provided by $0.20 (i.e. $13.40/.20 = 67 minutes). RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 9 MAY 3, 2010 REQUEST NO.9: On page 9 of the Amended Application, TracFone states, it is establishing safeguards to prevent its customers from multiple TracFone Lifeline subsidies at the same address. Please provide a detailed explanation of these safeguards. RESPONSE: TracFone has established safeguards to prevent its customers from receiving multiple TracFone Lifeline-supported services at the same address. The enrollment form requires each applicant to list a primary residential address and a contact telephone number. TracFone's safeguards are incorporated in TracFone's computer system used to process Lifeline applications. TracFone's Lifeline applications require applicants to provide an address. When reviewing completed applications, TracFone's computer system identifies when an address on an application matches an address that is already associated with a Lifeline customer. TracFone relies on a third-pary vendor to validate addresses included on SafeLink WirelessCI Lifeline service applications. If a Lifeline application lists an address that is already associated with a current Lifeline subscriber, both the current subscriber and the applicant wil be contacted to resolve the conflct. If the current subscriber cannot be contacted, the applicant claiming the address wil be asked to provide proof that the applicant resides at the address prior to the Lifeline application being approved. Proof of the address can be a copy of a letter or document that establishes proof of residence, such as a utility bil or a lease agreement. In addition, the applicant wil be asked to provide proof of participation in a qualified program. TracFone also validates that the combination of the last four digits of the social security number and date of birth does not already exist in TracF one's Lifeline database. The date of birth of the applicant is validated to avoid underage applicants. TracFone's process of verifying applicants' RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 11 MAY 3, 2010 personal information wil ensure that only qualified individuals receive Lifeline service and that only one TracFone Lifeline supported service is provided to each qualified household. RESPONDENT: Jose Fuentes, Director of Government Relations, (305) 715-3727. RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 12 MAY 3, 2010 REQUEST NO. 10: On page IO of the Amended Application, TracFone states, "that it wil verify annually that its Lifeline customers are stil heads of households and that they only receive Lifeline from TracFone." Please advise if TracFone intends to agree to conditions imposed in other states such as: Lifeline customers wil be monitored for inactivity (no conversation minutes and no purchase of prepaid cards). Lifeline customers wil be contacted if the Lifeline services remain inactive over two consecutive months. RESPONSE: TracFone has established and implemented II consultation with other state commissions a non-usage policy. TracFone's non-usage policy covers inactive handsets assigned to customers that are enrolled in its Lifeline program. TracFone enforces its non-usage policy in all jurisdictions in which it offers Lifeline service and wil enforce its non-usage policy in Idaho upon being designated as an ETC. Under the policy, if SafeLink WirelessCI customers go two months without any usage independent of the service end date, their service wil be deactivated and they wil be given a 30 day grace period to reactivate. Usage includes, but is not limited to, making calls, receiving calls, sending text messages, receiving text messages, or adding airtime. Customers who have been deactivated following 60 days of non-usage may participate in the Lifeline program in the future. Customers who advise TracFone during the 30 day grace period following 60 days of non-usage that they wish to continue to receive Lifeline service wil be reinstated as a Lifeline customer. Customers who advise TracFone after the 30 day grace period following 60 days of non-usage that they want to receive Lifeline service wil be re- enrolled as a Lifeline customer, assuming that such customers remain qualified for Lifeline benefits. When a customer is reinstated (during the 30 day grace period) or re-enrolled (after the RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 13 MAY 3, 2010 30 day grace period), that customer's handset wil receive any unused minutes that accrued during the 60 day non-usage period and the 30 day grace period. In addition, after a customer is reinstated or re-enrolled as a Lifeline customer, TracFone will recommence its provision of monthly allotments of minutes to the customer's handset. Once a customer has been deactivated after 60 days of non-usage, TracFone wil cease seeking reimbursement from the federal USF for that customer. However, if a customer is reinstated as a Lifeline customer during the 30 day grace period following 60 days of non-usage, TracFone wil seek reimbursement from the federal USF for the Lifeline benefits that accrued during the 30 day grace period. If a customer is re-enrolled as a Lifeline customer after the 30 day grace period following 60 days of non-usage, TracFone wil resume seeking reimbursement from the federal USF following such customer's re-enrollment. RESPONDENT: Jose Fuentes, Director of Government Relations, (305) 715-3727. RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 14 MAY 3, 2010 REQUEST NO. 11: On page 13 of the Amended Application, TracFone states that it has the ability to remain functional in an emergency through the underlying cariers' state-of-the-ar network. Please provide the three underlying carriers' emergency plans to support this statement. RESPONSE: TracFone does not have access to its underlying carriers' emergency plans. However, those carriers' emergency plans have been provided to the FCC. Throughout TracFone's more than 10 year relationship with each of its underlying carriers, it has not had any concerns about the carriers' abilty to remain functional in the event of an emergency. Each of those carriers has consistently provided reliable service to TracFone customers. RESPONDENT: Jose Fuentes, Director of Government Relations, (305) 715-3727. RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 15 MAY 3, 2010 REQUEST NO. 12: On page 14 of the Amended Application, TracFone states it provides access to operator services. Please explain if these calls are deducted from the 67 free minutes and provide any associated charges. RESPONSE: TracFone's handsets deduct minutes for calls to operator services. However, unlike virtually all other CMRS providers, including TracFone's underlying carriers, TracFone does not impose separate charges for operator services calls; it only deducts for the minutes used. RESPONDENT: Jose Fuentes, Director of Government Relations, (305) 7 i 5-3727. RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 16 MAY 3, 2010 REQUEST NO. 13: On page 14 of the Amended Application, TracFone states it provides access to directory assistance. Please explain if these calls are deducted from the 67 free minutes and provide any associated charges. RESPONSE: TracFone's handsets deduct minutes for calls to directory assistance. However, unlike virtually all other CMRS providers, including TracFone's underlying carriers, TracFone does not impose separate charges for directory assistance calls; it only deducts for the minutes used. Most CMRS providers impose charges of $2.00 or more for directory assistance calls. TracFone customers are not subject to separate directory assistance charges, only for the airtime charges. RESPONDENT: Jose Fuentes, Director of Government Relations, (305) 715-3727. RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST i 7 MAY 3, 2010 REQUEST NO. 14: On page 15 of the Amended Application, TracFone states, "Occasional dropped calls and inconsistent coverage depending on atmospheric conditions are a fact of life in the wireless industry." Treatment of dropped calls is also mentioned several times in the SafeLink Terms and Conditions of Service (Exhibit 12). Please explain in detail how these calls wil be treated as it relates to the 67 free minutes and if credit wil be provided to the end-users under any circumstances. RESPONSE: As explained in the Airtime Usage section of the SafeLink WirelessCI terms and conditions, airtime minutes wil be deducted for all time during which a customer's phone is connected to, or using, the wireless system of any carrier. Use of a wireless system typically begins when a customer presses the "send", "call" or other key to initiate or answer a call and does not end until the customer presses the "end" key or the call is otherwise terminated. Consistent with standard CMRS industry practice, TracFone does not provide credits or refunds for dropped calls. RESPONDENT: Jose Fuentes, Director of Government Relations, (305) 7 i 5-3727. RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 18 MAY 3, 2010 REQUEST NO. 15: On page 25 of the Amended Application, TracFone states that Lifeline customers wil be allowed to purchase additional usage cards at $.20 per minute. Please verify if this rate for additional usage cards is the same as in other TracFone jurisdictions. RESPONSE: As is explained in detail in the Response to Request No. 23, TracFone's SafeLink WirelessCI Lifeline customers are able to purchase any available TracFone prepaid airtime card product sold at retail locations or directly from TracFone via the Internet and use those airtime cards to add minutes to their handsets. TracFone's SafeLink WirelessCI Lifeline customers in all jurisdictions except in South Carolina and potentially in Washington, pay a maximum of $0.20 per minute for additional airtime minutes, without regard to the quantity of minutes purchased. In South Carolina, Lifeline customers can purchase additional airtime at a rate of $.1 0 per minute. The lower rate in South Carolina was the result of the settlement between TracFone and the South Carolina Office of Regulatory Staff. TracFone is currently in the process of finalizing a settlement with the Washington Utilties and Transportation Commission ("Washington UTC") that wil include a $0.10 per minute rate for additional minutes purchased by Lifeline customers. That settlement agreement has not yet been approved by the Washington UTC. TracFone is testing the $0. i 0 rate in these states and, depending on the effectiveness of this offering, it wil consider adjustments to its Lifeline offering in other states, including Idaho. Moreover, all SafeLink WirelessCI Lifeline customers may purchase TracFone Double Minute cards at participating TracF one retail vendor locations throughout Idaho and other states. Purchase of Double Minute cards results in Lifeline customers receiving a $0. i 0 per minute rate for the additional minutes they purchase. Therefore, the $0.10 rate wil be available to all customers who elect to avail themselves of the Double Minute cards offering. RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 19 MAY 3, 2010 RESPONDENT: Jose Fuentes, Director of Govemment Relations, (305) 715-3727. RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 20 MAY 3, 2010 REQUEST NO. 16: If Idaho rates (amount of free monthly minutes and cost for additional usage cards) are different from those in other states, please explain the pricing scheme and rationale to support the difference. RESPONSE: TracFone's Response to Request No. 15 explains why there is a lower rate for Lifeline customers' purchase of additional airtime in South Carolina and Washington. As explained in its Response to Request No.8, TracFone calculates the Lifeline benefit at a statewide level based upon a weighted average of the SLCs of the ILECs in each state. As a result, the number of Lifeline minutes provided each month can vary from state to state, although TracFone provides a uniform Lifeline benefit throughout each state. In states in which the weighted average SLC is less than $6.50, the number of free monthly minutes is lower, The number of monthly minutes is greater than 68 in states that require an ETC to provide additional discounts to Lifeline customers. For example, in Massachusetts, TracFone provides 80 minutes each month because, pursuant to a state regulation in Massachusetts TracFone is required to provide an additional $6.00 Lifeline benefit from its own resources to be entitled to receive the full federal Lifeline reimbursement of$10.00. Therefore, in Massachusetts, TracFone provides a Lifeline benefit of $16.00, which results in a Lifeline subscriber receiving 80 minutes each month ($16.00/$0.20 = 80). In all states, TracFone passes through the complete amount of federal USF funding it receives to its Lifeline customers in the form of free minutes of wireless airtime. RESPONDENT: Jose Fuentes, Director of Government Relations, (305) 7 i 5-3727. RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 21 MAY 3, 2010 REQUEST NO. 17: Please explain if TracFone wil begin paying into the Idaho USF, Idaho Telephone Relay Service (TRS), and Idaho Telephone Service Assistance Program (ITSAP) funds. If not, please explain rationale for non-payment. RESPONSE: TracFone wil not contribute to the TRS fund because it is not obligated to do so under Idaho law. Section 61-1305 ofthe Idaho Code provides: All telephone corporations providing basic local exchange service within the state of Idaho ... and those providing local exchange services . ., pursuant to the telecommunications act of 1988, chapter 6, title 62, Idaho Code, ... shall provide TRS .,. and shall pay into the telecommunications relay services fund ... . Section 61-121 of the Idaho Code specifically excludes corporations providing mobile radio telecommunications services from the definition of "telephone corporation" noting that such corporations are "exempt from any requirement of title 6 i, or chapter 6, title 62, Idaho Code." Section 62-603(14) of the Idaho Code similarly exempts corporations providing mobile radio telecommunications services from any requirement of title 61, or chapter 6, title 62, Idaho Code. As a mobile radio telecommunications provider, TracFone is exempt from contributing to the TRS fund, which is a requirement in title 61 of the Idaho Code. TracFone wil not contribute to the Idaho USF fund because it is not obligated to do so under Idaho law. Section 62-6 i 0(2)( c) of the Idaho Code provides that the statewide end user surcharge that fuds the Idaho USF "shall be collected by all telephone corporations, including telephone corporations subject to the provisions of this chapter." Section 62-603(13) of the Idaho Code, which defines "telecommunications service" exempts mobile radio telecommunications service providers from any requirements of title 6 i and Chapter 6, title 62 of the Idaho Code. TO FIRST PRODUCTION REQUEST 22 MAY 3, 2010 telecommunications provider, TracFone is exempt from contributing to the Idaho fund, which is a requirement in Chapter 6, title 62 of the Idaho Code. TracFone also is not required to contribute to the ITSAP fund. Section 56-901(1) of the Idaho Code provides that a statewide monthly surcharge on each end user's business, residential and wireless access service "shall be explicitly stated on end user bilings but shall not be imposed on eligible subscribers." TracFone, as a prepaid provider, does not render bils, and therefore has no "end user bilings" on which to assess the ITSAP charge. Therefore, it is not legally obligated to contribute to the ITSAP fund. RESPONDENT: Jose Fuentes, Director of Government Relations, (305) 715-3727. RESPONSE OF TRACFONE WIRELESS, INC. TO FIRST PRODUCTION REQUEST 23 MAY 3, 2010 REQUEST NO. 18: Please explain if TracFone has been certified by all of the Idaho PSAPs. The emergency communications fee is required to be a uniform amount not to exceed $ 1.00 per month per access line (which is defined to include wireless service in Section 31-4802( I)) and the related enhanced emergency communications fee shall not exceed $0.25 per month.
