RE:Procedural Schedule for Level3/Qwest Arbitration, Case No. QWE-O5-
Dear Counsel:
On October 13 , 2005, the Commission issued Order No. 29890 in this case to extend the procedural schedule as
set forth in a Joint Motion filed by the parties. The Commission's Order anticipated that a hearing would be
convened prior to November 30, 2005, allowing the Commission adequate time to complete a final Order by
March 1 , 2006. The Order directed the parties, were they unable to negotiate terms for an interconnection
agreement, to propose a new schedule in order to convene a hearing before November 30 2005.
I understand the parties have not yet successfully negotiated terms of an interconnection agreement, nor did the
parties propose a schedule to convene a hearing before the end of November 2005. Given existing scheduling
constraints, it is not possible now to convene a hearing in time for the Commission to complete a final Order by
March 1 2006. It is therefore necessary for the parties to agree to extend the deadlines for completing the case
or to dismiss the proceeding altogether.
Please let me know whether the parties will agree to a new procedural schedule, including waiver of any
statutory deadlines for action by the Commission.
