STIPULATION TO VACATE
HEARING ON ORAL
ARGUMENT AND HEARING
DATE
On April 22, 2003 , Staff filed a Motion to Strike or in the Alternative to Vacate
Hearing Date following the filing of Qwest's rebuttal testimony and exhibits. A hearing on
Staffs Motion was scheduled for Friday, April 25 , 2003. The parties now stipulate and agree as
follows:
1. Staff withdraws its Motion to Strike or In the Alternative to Vacate the Hearing
Date and the parties agree hearing on such motion may be vacated.
2. The hearing date of April 29-, 2003 should be vacated in order to provide the
parties an opportunity to conduct additional discovery.
3. The parties agree they will respond to additional discovery on reasonable but
expedited time frames
4. Staff reserves the right to seek to file rebuttal testimony and Qwest reserves the
right to object or to seek to file surrebuttal testimony, if appropriate.
5. This matter should be set for hearing for June 4-2003.
STIPULATION TO VACATE HEARING
ON ORAL ARGUMENT AND HEARING DATE
Counsel for the Staff has discussed this Stipulation with attorney John Gannon, who
represents the only other active parties in this case, and Mr. Gannon concurs with vacating and
rescheduling the hearing pursuant to this Stipulation. The parties request that the Commission
approve the Stipulation, vacate the hearing for oral argument and the hearing dates of April 29-
2003.
The parties request that the Commission approve this Stipulation, permit Staff to
withdraw its motion of April 22, vacate the hearing set for Friday, April 25 , 2003, and re-set the
evidentiary hearing for June 4-, 2003.
