Because based on the current Scheduling Order, Nextel Partners does not expect to receive any universal service funds for its service in Idaho until the first or second quarter of 2004, Nextel Partners believes the question is premature, Person able to answer questions at hearing: Scott Peabody 1561189vl REQUEST NO, 24 Please provide details of Nextel's specific plans to extend its network in each of the requested Designated Areas, RESPONSE: Nextel Partners will meets its obligation as an ETC to expand its network, over time , to meet reasonable requests for service, Nextel Partners offers no specific plans for consideration in this case, Person able to answer questions at hearing: Scott Peabody 1561189vl REQUEST NO. Please describe the analysis that will be undertaken when a customer requests service in an area not currently served by Nextel, but within the requested Designated Area, OBJECTION: Nextel Partners cannot state at this time what that analysis would be, Person able to answer questions at hearing: Scott Peabody 1561189vl REQUEST NO, 30 Please describe specifically how approval of Nextel's application will Increase competition and customer choice, RESPONSE: See testimony of Scott Peabody and Don Wood, Right now incumbent carriers are able to provide universal services at a substantial competitive advantage compared to Nextel Partners, In the long-term, the competitive provision of universal service in rural areas will ensure that market participants innovate, provide high quality service, and cut costs, to the benefit of consumers,An incumbent carrier that has a substantial government-granted subsidy not available to other carriers will have no such incentive, In the long-term, this will hurt consumers and place many rural consumers at the whim of a monopoly provider. This is contrary to the public interest, contrary to federal policy, and contrary to state policy, Person able to answer questions at hearing: Scott Peabody, Don Wood 1561189vl REQUEST NO. 31 Please identify and explain any and all public interests, other than interest in increased competition, that would be furthered by granting Nextel's ETC requests, RESPONSE: See response to Request No, 30, Person able to answer questions at hearing: Scott Peabody, Don Wood, 1561189vl REQUEST NO, 32 Please provide in detail any facts supporting the assertion in paragraph 18 of the Application that the ILECs in the Designated Areas need to improve their existing networks in order to remain competitive, RESPONSE: Nextel Partners does not rely on any specific facts for this assertion, As a matter of generally accepted economic theory, competition encourages monopoly providers to provide new and better services to consumers, Nextel Partners expects that ILECs will continue to upgrade their networks, Person able to answer questions at hearing: Scott Peabody, Don Wood, 1561189vl REQUEST NO, If Nextel is granted ETC status by the Idaho Public Utilities Commission, would the company comply with quality of service, pricing and other guidelines and requirements required by the Commission as a condition of approval of the application, RESPONSE: The federal and state rules governing designation of CMRS providers as federal ETCs do not require compliance with the referenced guidelines and requirements, Person able to answer questions at hearing: Scott Peabody 1561189v I REQUEST NO, 35 Does N extel have interconnection agreements with the incumbent LECs serving the Designated Areas? Please furnish copies of any such agreements, RESPONSE: No, Person able to answer questions at hearing: Scott Peabody 1561189vl REQUEST NO, 36 Does Nextel have reciprocal compensation agreements with the incumbent LECs serving the Designated Areas? Please furnish copies of any such agreements, State the amounts paid and received by Nextel pursuant to such agreements, by month, for 2002 and the first half of 2003, RESPONSE: No formal reciprocal compensation agreements between the incumbent LECs and Nextel Partners have been entered into and approved by the Commission, Person able to answer questions at hearing: Scott Peabody 1561189vl REQUEST NO. 38 Please explain why requiring equal access to interexchange carriers (IXCs) for Nextel customers as a condition of ETC status would not (l) promote competition and (2) serve the public interest. RESPONSE: Equal access is not a supported service, and the imposition of an equal access obligation as to a CMRS provider would be illegal, not technologically neutral, and would stand in the way of competition that would otherwise benefit rural consumers,Requiring equal access to interexchange carriers does not enhance the competition for universal service because it is a mechanism to encourage competition in the long distance industry, not the local service industry, Person able to answer questions at hearing: Scott Peabody 1561189vl REQUEST NO. 39 Does Nextel permit its customers to use dial around calling (1 a-xxx) to reach IXCs? If , what charges do Nextel customers incur for dial around? RESPONSE: Nextel Partners' customers are unable to reach IXCs dialing 10-xxx numbers, Person able to answer questions at hearing: Scott Peabody 1561189vl REQUEST NO, 40 Does Nextel intend to meet its ETC obligations, in whole or in part, by reselling or leasing incumbent LEC loops or unbundled network elements? If so, please describe Nextel' plans, RESPONSE: Nextel Partners has no such plans at this time, Person able to answer questions at hearing: Scott Peabody 1561189vl REQUEST NO. 41 If Nextel is granted ETC status in the Designated Areas, should subsequent applicants also be granted ETC status upon substantially the same showing and on similar terms and conditions? Please explain your answer in detaiL RESPONSE: Every ETC application should be judged based on the rules that apply, Principles of administrative law would suggest the same standards apply to all applicants, Nextel Partners would not anticipate asking that any different standard be applied to a subsequent ETC, Person able to answer questions at hearing: None, legal question, 1561189vl REQUEST NO, 42 Is there any limit to the number of additional ETC designations that should be granted in the Designated Areas? Please explain your answer in detaiL RESPONSE: Federal law applies and contemplates no such limit, but each application would need to be reviewed independently, Person able to answer questions at hearing: None, legal question, 1561189vl REQUEST NO. 43 If Nextel's Application is granted and the ILECs in one or more of the Designated areas thereafter decide to relinquish their ETC designations in the highest cost portions of their service areas, is Nextel prepared to, and willing to, provide carrier of last resort service to all customers in any such relinquished area without exceptions or preconditions, If your answer is anything other than "yes " please explain, RESPONSE: Nextel Partners has no reason to believe that any ILEC in Idaho would relinquish its ETC designation, Any response to this request would be highly speculative, In addition, such action would require Commission action consistent with Idaho Code 62-612, If such an unlikely event were to occur, and the Commission ordered Nextel Partners to provide service to all consumers in the ILEC's area , Nextel Partners would work with the Commission so that facilities would be purchased or built during the transition period so that all consumers would continue to be served, Nextel Partners does not believe it would then be a "carrier of last resort" under state law, Person able to answer questions at hearing: Scott Peabody 1561189vl Respectfully submitted Dated: September , 2003 INC, d~ ill~=TNERSBy: McDEVITT & MILLER, LLP Dean 1.
