Please state the total number of Nextel subscribers in each of the requested Designated
Areas, identifying these customers as either business or residence users.
RESPONSE:
Nextel Partners objects to this request as calling for information that is neither admissible
nor reasonably calculated to lead to the discovery of admissible evidence. To the extent this
request seeks information not previously disclosed in public documents, such information is
confidential, privileged and a Trade Secret. Subject to those objection and without waiver
thereof, Nextel Partners will provide its most recent line count data filed with the Universal
Service Administrative Company ("USAC"(see attachment).

Nextel Partners received an extension of the filing April l5 filing deadline, and will be
filing its 2002 return in September. Nextel Partners will produce a copy of its return once it is
filed,
Nextel Partners will provide this information only subject to a protective order that
prevents its confidential company information from being available to persons with business
responsibility within Citizens or any ITA company, Such information is confidential, privileged
and a Trade Secret.

The obligation to use support as required by federal law is set forth in 47 U,C, ~ 254(e),
and is an obligation of an ETC, not a criteria for ETC designation, Nextel Partners commits to
complying with federal law and will be responsible for ensuring this commitment is met.
Because based on the current Scheduling Order, Nextel Partners does not expect to receive any
universal service funds for its service in Idaho until the first or second quarter of 2004, Nextel
Partners believes the question is premature,

to provide universal services at a substantial competitive advantage compared to Nextel Partners,
In the long-term, the competitive provision of universal service in rural areas will ensure that
market participants innovate, provide high quality service, and cut costs, to the benefit of
consumers,An incumbent carrier that has a substantial government-granted subsidy not
available to other carriers will have no such incentive, In the long-term, this will hurt consumers
and place many rural consumers at the whim of a monopoly provider. This is contrary to the
public interest, contrary to federal policy, and contrary to state policy,

generally accepted economic theory, competition encourages monopoly providers to provide
new and better services to consumers, Nextel Partners expects that ILECs will continue to
upgrade their networks,

Equal access is not a supported service, and the imposition of an equal access obligation
as to a CMRS provider would be illegal, not technologically neutral, and would stand in the way
of competition that would otherwise benefit rural consumers,Requiring equal access to
interexchange carriers does not enhance the competition for universal service because it is a
mechanism to encourage competition in the long distance industry, not the local service industry,

administrative law would suggest the same standards apply to all applicants, Nextel Partners
would not anticipate asking that any different standard be applied to a subsequent ETC,

Federal law applies and contemplates no such limit, but each application would need to

If Nextel's Application is granted and the ILECs in one or more of the Designated areas
thereafter decide to relinquish their ETC designations in the highest cost portions of their service
areas, is Nextel prepared to, and willing to, provide carrier of last resort service to all customers
in any such relinquished area without exceptions or preconditions, If your answer is anything
other than "yes " please explain,
RESPONSE:
Nextel Partners has no reason to believe that any ILEC in Idaho would relinquish its ETC
designation, Any response to this request would be highly speculative, In addition, such action
would require Commission action consistent with Idaho Code 62-612, If such an unlikely event
were to occur, and the Commission ordered Nextel Partners to provide service to all consumers
in the ILEC's area , Nextel Partners would work with the Commission so that facilities would be
purchased or built during the transition period so that all consumers would continue to be served,
Nextel Partners does not believe it would then be a "carrier of last resort" under state law,
