STIPULATION OF U S WEST AND THE IDAHO PUBLIC UTILITIES COMMISSION
U S WEST Communications, Inc. filed its complaint in US District Court, District of Idaho in this case on October 29, 1998, which included claims against the Idaho Public Utilities Commission (IPUC).  U S WEST and the IPUC recognize and agree that the role of the IPUC in this case should be limited.  Accordingly, U S WEST and the IPUC agree and stipulate as follows:
1.  The IPUC will not attempt to enforce the U S WEST/AT&T Interconnection Agreement during the pendency of this case.  In addition, the IPUC will in the future, in the event that a proper proceeding is presented to the IPUC, enforce the Interconnection Agreement only as modified, if any, by the US District Court in this case.
2.  The IPUC shall have a limited role in this case before the US District Court.  The IPUC will assist and cooperate with the parties and the Court to obtain parts of the record as identified by the Court and the parties, but the IPUC need not otherwise participate as a party in this case, nor will U S WEST pursue any other claims against the IPUC..
3.  U S WEST and the IPUC will be responsible for their costs and attorney fees in this case, and will not make a claim against the other for recovery of fees or costs in this case.
