RE:CENTURYTEL TARIFF ADVICES INTRODUCING LIABILITY
LIMITATIONS FOR 9-1 SERVICE. ADVICE NUMBERS
CENTURYTEL OF IDAHO 2004-1 AND CENTURYTEL OF
THE GEM STATE 2004-
On October 22, 2004, CenturyTel submitted two tariff advices introducing new
language for the provision of Emergency Telephone Service (9-1). The primary purpose
of both tariff advices is to introduce language limiting the liability of the Company in its
provision of 9-1 service. The Company originally requested a November 21 , 2004
effective date.
Staff was concerned that the language limiting CenturyTel's liability was overly
broad, and initiated a conversation with representatives of CenturyTel to discuss the
proposal. During the discussions the Company filed numerous extensions of the effective
date. CenturyTel agreed to include language in the tariffs to clarify that nothing in the
language of the tariffs provides any limitations upon the liability of the Company beyond
those provided by Idaho Code ~ 31.4812.
On June 3 , 2005, the Company submitted a revised proposal that included the
requested language, with a June 13, 2005 effective date. Staff recommends the
Commission approve this revised language for CenturyTel's 911 tariff advices.
