Re: Exhibits in Ponderay Appeal
Dear Dennis,
Pursuant to our telephone conversation and my voice mail on Monday, I have enclosed for your information three exhibits. First, I have reproduced your photo Exhibit No. 10 so you can have a copy of it. I anticipate that prior to hearing I will either use the 32" x 22" original that was admitted at hearing or may even have it enlarged for oral argument. If the exhibit is enlarged, I will probably have to have the stipulation of the City and the Court’s approval.
I have also included a copy of the City’s Exhibit 101 but reduced in size. Finally, I have included a copy of Staff’s revised Exhibit 203, also reduced. Exhibit 203 was an exhibit originally introduced in the 1987 proceeding which was revised for last year’s hearing by labeling of streets, identifying the access points, and showing the location and direction of view for the Staff’s exhibits contained in the Appellate Record at pages 40-43.
The Commission has also located the original 1987 case file including the Railroad/City/Bonner Mall agreement and the City’s Petition. The file also contains exhibits, photos, hearing transcripts, and miscellaneous documents. If you have questions, please contact me at (208) 334-0312.
