On August 28, 2000, the Commission initiated a rulemaking proceeding to update its Pipeline Safety Rules contained in the Commission’s Safety Rule 201, IDAPA 31.11.01.201. In its proposed rules, the Commission was adopting the federal Gas Pipeline Safety Regulations contained in the Code of Federal Regulations dated October 1, 2000.
On September 8, 2000, the U.S. Department of Transportation issued a final rule which amends two parts of the federal Gas Pipeline Safety Rules. See 61 Fed. Reg. 54, 440 (September 8, 2000). The Federal Register changes concern the abandonment of underwater pipeline facilities. See attached Notice. The Federal Register Rule becomes effective October 10, 2000, which would not be published in the Code of Federal Regulations until October 2001.
To avoid a rulemaking docket next year, Staff suggests that the Commission modify the existing rulemaking case to incorporate the changes to the Gas Pipeline Safety Rules contained in the Federal Register Notice. This would eliminate the need for a rulemaking docket next year to incorporate the Federal Register Notice.
Staff recommends that the Commission incorporate the Federal Register changes.
