RE; CALCULATING THE 2011 REGULATORY FEE ASSESSM l TS FOR
PUBLIC UTILITIES AND RAILROADS, CASE NOS. -2011-1 ~ND F-2011-2
In April 2010, the Legislatue passed Senate Bil 1140 appropriating $5,090,500 to
the Commission for Fiscal Year 20 i 2 operations. The total appropriation consists of $116,500
from fees assessed on railroad corporations; $4,651,700 from fees assessed on public utilties;
$ 1 0 1 ,900 expenditures for pipeline safety activities reimbursable by the federal government; and
$220,400 expenditures for American Reinvestment & Recovery Act activities reimbursed by the
federal govermnent. Attachment 1 shows the calculations to arrive at the budget amounts and
the calculations to al'ive at the assessment rates for utilties and railroads, respectively.
1. Utilty Assessment. The utilties do not have an adjusted carry-over balance from
Fiscal Year 2010 expenditures because of the one-time $1,000,000 reduction to theii' 2009
assessment. Thus, Staff calculates that the 201 1 assessment for public utilties to fund Fiscal
Year 2012 is $4,651,700.
For calendar year 2010, Tite 61 and Title 62 utilties repol'ed gross intrastate
operating revenues from utilty operations in Idaho totaling $2,025,086,090. This is a reported
revenue decrease of $66,955,002 from the prior year, or a 3.2% decrease. Accordingly, Staff
determined the proportionate share of each utilty's fee should be assessed at .2297% (.002297)
of each utilty's gross intrastate operating revenue. Pursuant to Idaho Code § 61-1004(3) the
minimum regulatory fee assessed is $50.
DECISION MEMORANDUM
2. Railroad Assessment. Estimated railroad expenditures for FY 2011 are $116,500.
The gross intrastate operating revenue from railroad operations in Idaho was $ 1 1,656,622 for
calendar year 2010. This is a decrease of $2,118.213, down 15.38% from the prior year.
Accordingly, the proportionate share of each railroad's fee is to be assessed at .9994% (.009994)
of each railroad's gross iiiti'astate operating revenues. No railroad shall be assessed less than
$50, Idaho Code § 61-1004(3).
COMMISSION DECISION
1. Does the Commission agree with Staffs calculation of the regulatory assessment
for utilties of $4,651,700 and for railroads of$ 11 6,500?
2. Does the Commission agree with Staffs calculation of the regulatory assessment
of utilties of .2297% (.002297)?
3. Does the Commission agree with Stafts calculation of the regulatory assessment
of railroads of .9994% (.009994)?
