RE:IDAHO POWER TARIFF ADVICE TO INCREASE THE CITY OF
KE TCHUM' S FRANCHISE FEE.
On December 8 2003 , Idaho Power Company filed a Tariff Advice with the Commission
requesting an increase in the franchise fee within the City of Ketchum. The increase would
allow Idaho Power to collect the franchise fees that Idaho Power is required to collect from
customers and remit to the city beginning January 28 2004. The 3% franchise fee was approved
by voters during the general municipal election held on November 4 2003. City of Ketchum
Resolution No. 03-049 is attached to this Decision Memorandum with the Company s filing.
COMMISSION DECISION
The Staffrecommends that Schedule 95 , Sheet 95-, be "accepted for filing" with an
effective date of January 28, 2004 as proposed by the Company. Does the Commission agree?

Revision to Schedule 95
Dear Ms. Jewell:
Pursuant to the Commission s electronic filing procedures established by
Order No. 28890, Idaho Power Company herewith transmits for filing Twenty-Fifth Revised
Sheet No. 95-1. This tariff revision increases the franchise fee collected by Idaho Power
from customers within the City of Ketchum from 1 % to 3% as adopted by the voters of the
City of Ketchum on November 4, 2003, through Resolution Number 03-049. Also
transmitted are a copy of Schedule 95 in legislative format, a copy of Resolution Number
03-049, and a copy of the letter from Ketchum City Administrator Ron LeBlanc notifying
Idaho Power of the results of the November 4 election.

ADJUSTMENT FOR MUNICIPAL FRANCHISE FEES
PURPOSE
The purpose of this schedule is to set forth the charges such as license, privilege, franchise,
business, occupation, operating, excise, sales or use of street taxes or other charges imposed on the
Company by municipal corporations and billed separately by the Company to its Customers within the
corporate limits of a municipality.
APPLICABILITY
This schedule is applicable to all bills for Electric Service calculated under the Company
schedules and special Contracts in the Company s service area within the State of Idaho as provided
in Rule C of this Tariff.
CHARGE
The rates and charges for Electric Service provided under the Company s schedules will be
proportionately increased by the following charge within the municipality on and after the effective
date of the charge for the applicable municipal ordinance, which charge will be separately stated on
the Customer s regular billing.

RE: Increase in local Franchise Fee
Dear Mr. Harrington:
The voters in Ketchum successfully approved the increase in the Idaho Power franchise
fee from 1 % to 3%. A copy of Resolution 03-049, A RESOLUTION OF THE CITY OF
KETCHUM, IDAHO, CANVASSING AND DECLARING THE RESULTS OF THE
GENERAL MUNICIPAL ELECTION HELD IN SAID CITY ON TUESDAY, NOVEMBER
, 2003, is enclosed.
I have been advised by the local Idaho Power district manager, Jim Bell, that you should
be notified in writing regarding the official election results. The City is anxious to begin
collecting these revenues so that we can address the issue of undergrounding overhead
facilities in our city.
Please advise the timetable for implementing the billing and collection of these new
fees. If you should you have any questions , please contact me. Thank you for your
anticipated cooperation.

RESOLUTION NUMBER 03-049
RESOLlJTION OF THE CITY OF KETCHUM, IDAHO, CANVASSING AND
DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID
CITY ON TUESDAY, NOVEMBER 4,2003.
WHEREAS, all nominees for the offices of Councilmembers for the City of Ketchum
Idaho, have heretofore been nominated as provided by law, said nominees being as follows:

And, a notice for said election having been duly signed by the City Clerk of said City and having
been thereafter published in the Idaho Mountain Express, Ketchum, Idaho, in the manner
provided by law; and
WHEREAS. the clerk of said city has caused ballots containing the names of the
candidates for said offices and ballots for voter approval to answer the question: Should the City
of Ketchum increase the Idaho Power Franchise Fee from one percent (I %) to three percent
(3%)? The franchise revenue wiII be designated for the purpose of undergrounding overhead
electric facilities and be distributed as follows: (1) Not less than 2% dedicated to underground
the Southern entrance and the commercial core areas; (2) up to 0.5% dedicated to the
maintenance, operation, and conversion of street lights to comply with the Dark Sky Ordinance;
and (3) up to 0.5% dedicated to the improvements in residential areas. The franchise fee shall be
collected by Idaho Power from its customers within the City and be submitted to the City for
such undergrounding.
WHEREAS, the judge of election has made her return of said election and the same have
been found to be in proper fonTI, and
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COUNCIL OF THE CITY OF KETCHUM, IDAHO:
The City Council of the City of Ketchum, Idaho, sitting as a canvassing board and having
before it the proceedings and returns from the General Municipal Election held in the City of
Ketchum, Idaho, on Tuesday, November 4 2003 , does hereby canvass and certify the returns of
said election as follows:
The said election was duly held during the hours prescribed at the polling place
designated.
The Official Ballots prepared and distributed by said City were used by the Voters at said
Election for casting their votes. The number of Ballots cast corresponds with the Election
Record and Poll Books of the voters.

Terry A. Tracy, Candidate for the Oftice of Councilmember, four-year ten11, received 383 votes
which number of votes is the highest number of votes cast for such Candidate and she is hereby
declared to be the duly elected Councilmember of the City of Ketchum, Idaho.
Randy Hoffar Hall, Candidate for the Office of Councilmember, four-year ten11, received 306
votes, which number of votes is the next highest number of votes cast for such Candidate and he
is hereby declared to be the duly elected Councilmember of the City of Ketchum, Idaho.
Certificates of Election shall be presented on January 5, 2003 to Terry A. Tracy and
Randy Hoffar Hall, as Council members - four-year term, of the City of Ketchum, Idaho.
