Snyder March 3, 2015 At the District’s request for technical support concerning proposed water retention bulkheads at Energy West’s Deer Creek Mine, MSHA Mine Emergency Operations reviewed the bulkhead plan for compliance with the Code of Federal Regulations. Energy West’s submittal proposed the use of boreholes located just inby the proposed bulkhead locations to serve as gas sampling points. As stated in the letter from Mine Emergency Operations, Christopher R. Snyder, dated February 23, 2015, “…this proposed practice does not meet the requirements of the Code of Federal Regulations. Therefore, per the approved seal plan, an atmospheric gas sampling pipe must be installed throughout each bulkhead. Sampling will be required until the design strength of each seal has been reached and it has been approved to serve as a bulkhead.” To comply with this requirement, Energy West will install one atmospheric sampling pipe in each seal as specified in Figure 11 – Atmospheric Gas Sampling Tube.
