"XRG" or "Complaiants") hereby provides the following responses to the Second Set of
Production Requests of Rocky Mountain Power, served on December 22,2010. Each response
was prepared by James Carkulis and Colln Rudeen ofXRG, in consultation with attorneys Peter
Richardson and Greg Adams. Mr. Carkulis or Mr. Rudeen can sponsor the responses at a
hearng.

As indicated in the 2007 leases provided in XRG's Response to Request No. 24, XRG's
objective has been, and remains to be, to enter into long term agreements with Rocky Mountan
Power. To date, Rocky Mountain Power has been less than receptive. XRG has not engaged in
discussions to sell the power to other utilities.

XRG RESPONSE TO REQUEST NO. 31
Exergy sufered setbacks in its development of the projects in 2009 due to Rocky Mounta
Power's resistace to enterig into PPAs. Exergy had first submitted BPA interconnection
requests on November 1, 2006 (BPA Queue Nos. G0245, G0246, G0247, G0248). XRG paid for
and received feasibilty studies in November 2007, and continued though the study process
retaiing those queue numbers until March 2009, when BPA deemed XRG's requests withdrawn
due to å misunderstanding regarding payment of an additional $20,000 for an additional
environmental study for each project - a tota of $80,000. At that time, Rocky Mountain Power
had expressed its resistace to executing PPAs for all 4 projects, and XRG had to bear the futilty
of its PP A effort in mind when committng additional fuds to the interconnection process.
Rocky Mounta Power's delay was certnly a factor in XRG's inabilty to remai in the queue
under those prior interconnects requests.
Despite Rocky Mountain Power's resistace to PPAs in 2009, XRG did continue to work on the
projects in 2009. That work included:
. Engaged in landowner negotiations, and maintaned XRG's good stading on its leases.
. Engaged a thd par to complete title and surey work on the lease sites to plan
constrction, tubine and road layouts.
. Continued wind data monitoring and analysis, which was initially commenced July 2006
with erection of met towers.
. Continued Sodar monitoring and analysis of wind, which commenced initially in 2008.
. Resubmitted Interconnection requests to BPA -- Queue Nos. G0388 (XRG-DP7
submitted 11/02/09), G0395 (XG DP8 submitted 11/23/09).

XRG RESPONSE TO REQUEST NO. 32
Despite Rocky Mountan Power's continued resistace to executing PPAs in 2010, XRG did
continue to work on the projects in 2010. That work included:
. Engaged third pary environmenta consultants who completed investigation into likely
endangered species impacts.
. Engaged in landowner negotiations, and maitaned XRG's good stading on its leases.
. Continued wind data monitoring and anlysis, which was initially commenced July 2006
with erection of met towers.
. Continued Soda monitoring and analysis of wind, which commenced intially in 2008.
. Resubmitted Interconnection requests to BPA -- G041 1 (XG-DP9 submitted 3/12/10),
and G0412 (XRG-DPlO submitted 3/12/10). Due to BPA's rejection of these submittals,
XRG resubmitted the requests to comply with BPA's concerns. BPA accepted the
submittal for XRG-DP9, which now has a Queue No. G0445 effective on 12/6/10. XRG
is stil awaiting confrmation from BPA on the submittal and deposit for the XRG-DPI0
interconnection, which it signed and sent to BPA on 11/24/10.
. Received completed interconnection system impact studies from BPA for Queue Nos.
G0388 (XRG-DP7), G0395 (XRG DP8) and executed Facilities Study Agreements for
same.
. Engaged a thrd par consultat to complete a microwave bean study for all 4 projects, to
ensure the projects will not interfere with any microwave tower operations.
. Engaged a third par consultat to complete a study coordinating with the National
Telecommunications and Information Administration to ensure all 4 projects will avoid
interference with governent systems.
. Initiated formal TSR process in order to become a BP A transmission customer and
engaged in discussions with BP A transmission personnel regarding PTP trsmission
from the XRG projects to Brady substation.

to obligate itself to PP As, and the risks inherent therewith, prior to securng interconnection
rights and transmission rights for the entire output. Reference, e.g., IPUC Order No. 32144.
XRG fuer objects on the ground tht the request is ambiguous as to the meanng of "rights."
Without waiving these objections, XRG states as follows.
See XRG's Response to Request Nos. 31 and 32 for XRG's efforts and rights obtaned regarding
interconnection. The timing of the interconnection process with the PP A process has been
diffcult, and has been made no easier by Rocky Mountan Power's reluctace to execute PPAs
for thes.e projects since the PPA requests submitted Januar 21,2009. XRG has initiated and
paid for several interconnection applications and studies since 2006. Each interconnection
application requires a $2,SOO deposit, and each system impact study deposit is $S,OOO. Each
Facilties Study deposit is $7,000. BPA additionally requested a $20,000 deposit for an
environmental study for each project in Janua 2009, which would have been an $80,000
deposit at a time when Rocky Mountan Power maintained it could not accept the output of all 4
projects. XRG has incured substatial interconnection study costs, and, largely as a result of the
delay in securing PPAs, has been bumped out of its initial queue positions for these projects.
Neverteless, XRG has continued to proceed through BPA's interconnection process and has
curent rights to interconnection proceeding through BPA's study processes.
In preparing this response, XRG discovered additional correspondence with BP A not provided in
XRG's initial response to Request No.6. XRG has omitted confidential study materials for the
reasons explained in XRG's Response to Request No. 49. XRG hereby provides that additional
correspondence as XRG Attachment to RMP Request No. 37.

14,2010, XRG is confdent that transmission to Rocky Mountain Power will be achievable and
cost-effective. Ths is paricularly so if Rocky Mountan Power agrees to accept conditional firm
transmission, which it stated it was able to do when the paries met on December 7, 2010.

Yes. XRG ha no formal schedules for development of these projects. Thus far, XRG has self-
financed the projects as the need for ea.ch development step approaches. Any thd-pary
financing schedules are put in place afer a PP A is secured. Based on Exergy's past experience
and contacts as well as the several years of wind data for the sites, it expects no trouble receiving
finacing for the projects once PPAs are executed. Given Rocky Mountan Power's reluctace
to execute PP As, constrction and development schedules would be premature at ths stage.

proposed delivery point - Brady substation - was insufficient for accepting more than 23
megawatts of net output from XRG's proposed qualifying facilities." Reference Answer il 8.
Indeed the very correspondence referred to in this request from May 1 1, 2009, stated,
"PacifiCorp does not have sufcient transmission at Borah or Brady to accept any project greater
than 23 MW and you selected one project, XRG-DPI0, that would be developed into a PPA."
Reference Rocky Mountan Power First Production Request, Exhibit A-15. XRG intended to
develop all 4 projects. Rocky Mountain Power stated it would only accept 1 project for a PP A.
To submit PPAs for all 4 projects therefore seemed to XRG to be an act of futilty.

See XRG's Response to Request Nos. 31, 32, 37, and 38. To the extent this request calls for
interconnection and transmission studies, XRG wil not provide the same. These studies are
generally confidential between BPA and XRG, as stated in the July 15,2010 BPA letters
providing system impact studies. XRG has provided the interconnection queue numbers for the
projects where Rocky Mountain Power can view the public inormation on BPA's OASIS
website. For on-system PUR A projects, Rocky Mounta Power C&T may not demand such
transmission studies due to FERC's requirement for fuctional separation of the merchant and
tranmission sides of the Company. Rocky Mountain power has provided no reason why XRG's
off-system QFs must provide more inormation than on-system QFs to obtan a PPA. Therefore,
XRG objects to providing confidential interconnection studies.
