PAC-E-07-14 STIPULATION ON ROCKY MOUNTAIN POWER'S APPLICATION TO CHANGE DEPRECIATION RATES Pursuant to IDAPA 31.01.01.271, 272, and 274 Rocky Mountain Power, a division of PacifiCorp ("Rocky Mountain Power" or the "Company") and the Idaho Public Utiliies Commission Staff ("Staff') (collectively referred to herein as the "Stipulating Paries"), submit this stipulation on Rocky Mountain Power's Application to Change Depreciation Rates ("Stipulation") in resolution of all issues in this docket and request that the Commission approve new depreciation rates for. Rocky Mountain Power as stipulated herein to become effective on Januar 1,2008. I. INTRODUCTION 1. The terms and conditions of this Stipulation are set forth herein. The Stipulating Paries agree that this Stipulation represents a fair, just and reasonable compromise of the issues raised in this proceeding and that this Stipulation is in the public interest. The Stipulating Paries, therefore, recommend that the Idaho Public Utilities Commission ("Commission") STIPULATION Page 1 approve the Stipulation and all of its terms and conditions. See IDAPA 31.01.01.271, 272, and 274. II. PROCEDURAL BACKGROUND 2. On August 31, 2007, Rocky Mountain Power fied its Application for an order authorizing the Company to change depreciation rates effective January 1, 2008. 3. On September 24, 2007 Staff fied a Decision Memo recommending that the Commission issue a notice of application and notice of modified procedure, but without establishing a comment period deadline. Staff also recommended that the notice include a deadline for interventions. Staff also supported Rocky Mountain Power's request to make any changes in the depreciation rates effective as of Januar 1, 2008, even if the order approving such change was issued after that date. 4. On October 3, 2007 the Commission issued Order No. 30449 Notice of Application and Notice of Intervention Deadline wherein the Commission set an intervention deadline of October 24,2007. 5. No petitions to intervene were fied. 6. With a view toward resolving the issues raised in Rocky Mountan Power's Application in this proceeding, representatives of the Stipulating Paries met several times pursuat to IDAPA 31.01.01.271 and 272, to engage in settlement discussions. Based upon the settlement discussions between the Stipulating Paries, as a compromise of the positions in this proceeding, and for other consideration as set forth below, the Stipulating Paries agree to the following terms: STIPULATION Page 2 TERMS AND CONDITIONS Substantive Terms of the Stipulation 7. The Stipulating Paries have engaged in good faith, ars-length negotiations in an effort to resolve this matter. The negotiations have resulted in the agreement of the Stipulating Paries on the terms and conditions as set forth herein. 8. The Stipulating Paries agree that the proposed depreciation rates set forth in Schedule 1 attached hereto and incorporated herein, represent just and reasonable depreciation rates for Rocky Mountain Power in Idaho commencing January 1, 2008. 9. The depreciation rates proposed in Schedule 1 result In a decrease of approximately $4.0 milion in Rocky Mountain Power's anual depreciation expense in Idaho based on December 31, 2006 depreciable plant balances and relative allocation factors. 10. Among significant factors involved in the changes in rates are the following major components: a. the accrual rate for steam production is reduced as a result of a combination of generally increasing depreciation lives of steam plants to 61 years, except the Gadsby and Carbon plants that are increased to 64 years, increasing negative net salvage value from $25 to $40 per Kilowatt and including estimated production plant in service balances through December 31, 20071; b. the accrual rate for hydroelectric production is increased as a result of recognizing the terminal removal costs based on Federal Energy Regulatory Commission 1 2007 plant balances are based on i 0 months of actual additions and 2 months of estimated additions for puroses of updating remaining lives. STIPULATION Page 3 license expiration dates and the probabilty of removal of some of the minor generating units; c. the accrual rate for other production plant is reduced by increasing the depreciation lives of combustion turbine and combined cycle combustion turbine plants to 30 and 40 years, respectively; d. the accrual rate for system transmission plant is decreased as a result of increasing the average service lives by approximately one year and increasing the average negative net salvage values by approximately 0.7%; e. the average accrual rate for Idaho distribution plant is decreased as a result of performing the depreciation study on an Idaho only basis as compared to the previous study which combined both Utah and Idaho; f. the accrual rate for mining operations is reduced as a result of an increase in average service lives by approximately 5.6 years; and g. the average accrual rate for Idaho general plant is decreased as a result of performing the depreciation study on an Idaho only basis as compared to the previous study which combined both Utah and Idaho. 11. The Stipulating Paries agree that Rocky Mountain Power shall complete a new depreciation study, including a review and analysis of net salvage values, within five years of the date of the Commission's order in this matter or prior to the Company's next request for a change in depreciation rates, whichever comes first. 12. The Stipulating Paries agree that, effective January 1, 2008, when the Company is reimbursed by a third pary for a retirement of plant, the amounts the Company is reimbursed shall first be treated as credits against removal costs on the related project; to the extent there are STIPULATION Page 4 excess reimbursed amounts beyond the amount of removal cost incured in connection with the project, the excess reimbursement shall then be credited against the cost of replacing the plant and shown as contributions in aid of construction. 13. The Stipulating Paries agree that, if this Stipulation is approved by the Commission, the depreciation rates set forth on Schedule 1 should become effective on Januay 1,2008. 14. The Stipulating Paries agree that this Stipulation is in the public interest and that all of its terms and conditions are fair, just and reasonable. General Terms and Conditions 15. All negotiations related to this Stipulation are privileged and confidential and no Stipulating Pary shall be bound, benefited or prejudiced by any position asserted in the negotiation of this Stipulation, except to the extent expressly stated herein, nor shall this Stipulation be construed as a waiver of the rights of any Stipulating Pary unless such rights are expressly waived herein. Execution of this Stipulation shall not be deemed to constitute an acknowledgment or agreement by any Stipulating Pary of the validity or invalidity of any particular method, theory or principle of regulation or cost recovery employed in ariving at this Stipulation is appropriate for resolving any issues in any other proceeding in the future. No findings of fact or conclusions of law other than those stated herein shall be deemed to be implicit in this Stipulation. 16. The Stipulating Paries each agree to present testimony of one or more witnesses to explain and support this Stipulation, if necessar. Notwthstanding the admission of pre-filed testimony, the Stipulating Paries shall support the Commission's approval of the Stipulation. STIPULATION Page 5 17. The Paries submit this Stipulation to the Commission and recommend approval in its entirety pursuant to IDAPA 31.01.01.274. The Paries shall support this Stipulation before the Commission, and no Stipulating Party shall appeal any portion of this Stipulation or Order approving the same. The Stipulating Paries fuher agree that if any person challenges the approval of this Stipulation or requests rehearing or reconsideration of any order of the Commission approving this Stipulation, each Stipulating Pary wil use its best efforts to support the terms and conditions of the Stipulation. In the event any person or pary seeks judicial review of a Commission order approving this Stipulation, no Stipulating Pary shall tae a position in that judicial review opposed to the Stipulation. 18. Except with regard to the obligations of the paries under the three preceding paragraphs of this Stipulation, this Stipulation shall not be final and binding on the Stipulating Paries until it has been approved without material change or condition by the Commission in an order that is no longer subject to any fuher reconsideration or appellate review. 19. In the event the Commission rejects any part or all of this Stipulation, or imposes any additional material change or condition on approval of this Stipulation, or in the event the Commission's approval of this Stipulation is rejected or conditioned in whole or in par by a cour, each Stipulating Par reserves the right to withdraw from this Stipulation. If such an order is issued, the Stipulating Paries agree to meet and discuss the applicable Commission or cour order within five business days of its issuance and to attempt in good faith to determine if they are willng to modify the Stipulation. No Stipulating Pary shall provide notice of withdrawal prior to complying with the foregoing sentence. In the event that no modified stipulation is reached, any Stipulating Party may withdraw from this Stipulation by giving written notice of withdrawal to the Commission and the other Stipulating Paries. Any such STIPULATION Page 6 notice shall be given within five business days after reaching impasse in any discussions regarding modifying the Stipulation. If any Stipulating Pary withdraws from this Stipulation pursuant to this paragraph, no Stipulating Party shall be bound or prejudiceø by the terms and conditions of this Stipulation, which have been accepted by the parties in consideration of this Stipulation and which may have been contested but for this Stipulation, and each Stipulating Part shall be entitled to undertke any step or to assert any position it deems appropriate without regard to this Stipulation. i20. The Parties agree that this Stipulation is in the public interest and that all of its terms and conditions are fair, just and reasonable. BASED ON THE FOREGOING, the Stipulating Parties request that the Commission o issue an order approving this Stipulation and adopting the terms and conditions of this Stipulation.
