How many bids were updated and how many new bidders chose to participate as a result. Response to IPUC Production Data Request 3 RFP 2003-B was re-opened to new bidders and to allow previous bidders to update their bids to allow PacifiCorp to review renewable resource proposals from the entire pool of bidders then currently available. PacifiCorp has not created a tabulation of updated bids or a tabulation of new bidders as a result of the re-opened RFP 2003- (Mark R. PAC-07-05/Rocky Mountain Power August 2, 2007 IPUC Production Data Request 7 IPUC Production Data Request 7 Please provide all analysis performed to evaluate and compare short-listed bids including bids for the Leaning Juniper, Marengo, and Goodnoe Hills projects. The analysis may include computations of PVRR, energy cost and capacity cost; comparisons between bids and against wind cost assumptions included in the 2003 IRP; and risk analysis. For spreadsheet analysis, please provide electronic copies of all spreadsheets with formulas intact. Response to IPUC Production Data Request 7 To the extent the request asks for "all" analysis performed to evaluate and compare short-listed bids, PacifiCorp objects on the basis that the request is overly burdensome. Notwithstanding PacifiCorp s objection, the following information is provided. The "RFP 2003-B Summary Report" prepared for the Oregon PUC is provided as Attachment IPUC Production 4; that report includes an analysis and evaluation comparing the PVRRs of all short-listed bids, including Leaning Juniper Marengo, and Wolverine Creek. Also see the discussion in response to IPUC Production Request 6 regarding short-listed bids not selected. The Goodnoe Hills project was not a bid into RFP 2003- (Mark R. Response to IPUC Production Data Request 8 The cost analysis for the Wolverine Creek wind project is extremely confidential price and transaction sensitive, and commercially proprietary. Disclosure of this material may give an undue advantage to competitors and therefore requires the highest level of confidential treatment. In the summary, include at least the name and location of the wind facility, the nameplate capacity and capacity factor for each project, the quantity of annual energy purchased, the term of the PP A and all pertinent purchase price information. IDAHO P AC-O7- ROCKY MOUNTAIN POWER IPUC PRODUCTION DATA REQUESTS 1- ATTACHMENT IPUC PRODUCTION ON THE ENCLOSED CD P AC- E-07 -05/Rocky Mountain Power August 2, 2007 IPUC Production Data Request 14 IPUC Production Data Request 14 What are the contractual Guaranteed Operation Dates for the Lake Side, Leaning Juniper, Marengo, and Goodnoe Hills projects? Please provide a construction schedule for each of these projects and discuss whether the construction is on schedule for each project. Response to IPUC Production Data Request 14 Lake Side The contractual Guaranteed Operation Date for the Lake Side Project would refer to the Guaranteed Provisional Acceptance Date, or May 15 , 2007 as adjusted pursuant to any Change Order. The project is currently behind schedule to meet the provisional acceptance date. The Project is currently producing test energy and is expected to be fully dispatchable and available for commercial operation by August 31 , 2007. Please see Attachment IPUC Production 1.14a for the construction schedule which has not been updated for recent changes. Leaning Juniper The "Guaranteed Final Completion Date" has the meanIng set forth in Section 7.9 of the agreement. The Leaning Juniper Wind Project (LJWP) warrants that Final Completion shall be achieved not later than six (6) months after the date of Project Substantial Completion ("Guaranteed Final Completion Date ) except for Punch List Items that, by their nature, cannot be completed because of factors beyond the control ofLJWP. The "Guaranteed Project Substantial Completion Date" means September , 2006, as such date may be extended pursuant to this Agreement. There is no construction schedule in the Project Completion Agreement due to the short remaining duration of construction at the time PacifiCorp acquired the project. Construction was completed on time on September 14 2006. Marengo The "Guaranteed Final Completion Date" has the meaning set forth in Section 6. of the agreement, which is shown below. P AC-07-05/Rocky Mountain Power August 2, 2007 IPUC Production Data Request 14 Completion Guarantees Contractor warrants that Final Completion shall be achieved not later than six (6) months after the date of Substantial Completion ("Guaranteed Final Completion Date ) except for Punch List Items that, by their nature cannot be completed because of seasonal weather conditions. The "Guaranteed Substantial Completion Date" means July 23, 2007. Construction anticipated substantial completion is August 3, 2007. Please see Attachment IPUC Production 1.14 -2 for the construction schedule. Goodnoe Hills The contractual guaranteed initial wind energy converter commissioning date is November 15 2007. The "Guaranteed Final Completion Date" has the meaning set forth in Section 6. The "Guaranteed WEC Commissioning Date" means December 31 , 2007, as such date may be modified in accordance with Section 5.5 and Article 9 of the agreement. Completion Guarantees Contractor warrants that Final Completion shall be achieved not later than six (3) months after the date of Project Substantial Completion Guaranteed Final Completion Date ), except for Punch List Items that by their nature, cannot be completed because of seasonal weather conditions. 2 Project Substantial Completion Contractor has achieved substantial completion of the Project ("Project Substantial Completion ), which shall include achievement of WEC Substantial Completion with respect to all the WECs, and the following other items: (a) The requirements set forth in the Commissioning Procedures have been met or exceeded; (b) all WECs have been properly assembled, erected, installed, adjusted tested and commissioned, are mechanically, electrically and structurally sound as set forth in the Technical Specifications, and can be used safely in accordance with the Contract Documents, Applicable Law and Applicable Standards; PAC-07-05/Rocky Mountain Power August 2, 2007 IPUC Production Data Request 14 ( c) Contractor has completed all of the Work for all of the Infrastructure Facilities, other than the Performance Tests and any Punch List Items and has delivered to Owner copies of all test reports and electrical schematics related to the Infrastructure Facilities; (d) Contractor has prepared and submitted to Owner the final and complete list of Punch List Items; (e) Contractor has delivered draft copies of the Turnover Packages and O&M Manuals in accordance with Section 2.11; (f) Contractor has delivered to Owner all Partial Lien Waivers and Final Lien Waivers, as the case may be, from all Subcontractors for Work completed through such date; (g) drafts of As-Built Drawings and Documentation shall have been delivered to, and accepted by, Owner in accordance with Section 2. (h) all quality assurance documentation has been provided to Owner accordance with the Project Quality Assurance Plan and all non- conforming quality assurance issues have been resolved in accordance with the Project Quality Assurance Plan; and (i) Owner has accepted a Project Substantial Completion Certificate pursuant to Section 6. Notwithstanding achievement of Project Substantial Completion Contractor shall remain obligated to complete the Punch List Items in accordance with this Agreement. Contractor shall give Owner written notice at least ten (10) Business Days prior to declaring that it has achieved Project Substantial Completion with respect to all of the Infrastructure Facilities and WEC and shall provide on such date a written list of Punch List Items. Owner shall be entitled to verify and, if necessary, correct or add to, the list of Punch List Items provided by Contractor; provided that, the only Punch List items for the WECs shall be the Punch List prepared in accordance with the Turbine Contract.
