Dear Jean
Thank you doubly, for your call yesterday afternoon alerting me to the problem with the
formatting ofthe written testimony of Tim Shurtz, which I had already e-mailed (and, in fact
mailed hard copy) to all parties. I was grateful for your friendly reminder to review Rule 231
again. (You apologized to me, leaving open the possibility that I would "blame" you for not
pointing that out to me when we first talked. I hate to admit a "failing in front ofthe court"
my terms-but in fact you did remind me, in that first call, that I needed to review Rule 61 and
Rule 231. That means that the mistake was mine and only mine-and that is why I am so
grateful that you (and Scott Woodbury) pointed out to me my need to comply formally with the
format requirements of Rule 231.
The enclosed testimony is identical in content to the draft which was mailed to you
yesterday (September 27); only the formatting is changed. The CD-ROM disc copy that is
enclosed is ofthis revised/properly formatted version of his testimony.
