Availability
This schedule is available for firm retail service of electric power and energy delivered for the operations of Nu-West Industries’ facilities located at Soda Springs, Idaho, as provided in the Power Supply Agreement between the two parties.

Term
Service through December 31, 2004 continuing from year-to-year thereafter for no more than two annual renewal terms subject to thirty days notice of termination.

Annual Adjustment
The Demand Charge and Energy Charge shall be uniformly adjusted annually effective January 1, 2003 and each January 1 thereafter, as defined in the Electric Service Agreement between the two parties. The Customer Charge shall remain at the same level throughout the term of the Agreement and any renewals thereof.
