HomeMy WebLinkAbout20160502min.doc IDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING May 2, 2016 – 1:30 P.M. In attendance were Commissioners Paul Kjellander, Kristine Raper and Eric Anderson. Commissioner Kjellander called the meeting to order. The first order of business was APPROVAL OF MINUTES FROM PREVIOUS MEETING on Monday, April 25, 2016. The Commission voted unanimously to approve the minutes as written. The second order of business was approval of the CONSENT AGENDA: 2. Curtis Thaden's April 28, 2016 Decision Memorandum re: Rocky Mountain Power Tariff Advice No. 16-04, Revision to the Electric Service Schedules Index. 3. Grace Seaman's April 29, 2016 Decision Memorandum re: Approval of the 2016 Telecommunications Relay Service Provider Request for Proposal, Case No. GNR-T16-05. There was no discussion and Commissioner Kjellander made a motion to approve Staff’s recommendations for items 2 and 3 on the Consent Agenda. A vote was taken on the motion and it carried unanimously. The next order of business was MATTERS IN PROGRESS: 4. Daphne Huang's April 29, 2016 Decision Memorandum re: Idaho Power's Application for Authority to Transfer Title of Mobile Manor Mobile Home Park Meter Pedestals, Case No. IPC-E-16-07. Ms. Huang reviewed her Decision Memo. Commissioner Raper made a motion to set the comment deadline for June 6, 2016 and the Company’s reply deadline for June 17, 2016. She noted that if the Industrial Customers of Idaho Power (ICIP) want to make a request to the Commission for something outside the ordinary rule then at some point in the future they could to do that. Regarding the matter of holding a technical hearing, Commissioner Kjellander stated that clearly a hearing is not needed but statute states that one has to occur and the word “shall” directs the Commission to hold a hearing. He noted that he would not be opposed if any parties were to go to the Legislature and seek amendment to the statutory language in order to give the Commission some discretion in matters like this. He then amended the motion made by Commissioner Raper to include that the Commission hold a hearing in accordance with Idaho statute. A vote was taken on the motion and it carried unanimously. 5. Don Howell's April 29, 2016 Decision Memorandum re: Staff Application for an Order Approving the Distribution of Tier 2 QPAP Funds, Case No. GNR-T-16-04. Mr. Howell noted that the reason his item was under MATTERS IN PROGRESS was because it is rare for Staff to file an Application and he wanted to be totally transparent regarding this matter. He then reviewed his Decision Memo. He added that in the normal course of serving Applications for Modified Procedure, the Application will be mailed to all counties, cities and chambers of commerce in addition to Title 61 and Title 62 local exchange companies, so notice will be broad at this stage of the proceedings. Commissioner Raper asked if Staff’s Application was also served on any of the parties mentioned or if he anticipated that just the Notice of Application and Notice of Modified Procedure will be broadly distributed. Mr. Howell replied that the Application was served on the Idaho Emergency Communications Commission and on the Idaho Suicide Hotline as well as CenturyLink, the successor of Qwest. Commissioner Raper asked if Staff anticipated that any interventions would occur and Mr. Howell replied that anyone can seek party status but the matter is fairly cut and dry. There was no further discussion and Commissioner Raper made a motion to issue a Notice of Application and Notice of Modified Procedure with a 21-day comment deadline and 7-day reply deadline. Commissioner Kjellander commented that he was grateful to see something moving forward with regard to these QPAP funds and it made good sense to get the money out the door so it can actually be doing something as opposed to just evaporating in some account. He stated he appreciated the efforts of Staff to get it this far. A vote was taken on the motion and it carried unanimously. The final order of business was FULLY SUBMITTED MATTERS: 6. Deliberation re: Application of PacifiCorp dba Rocky Mountain Power for Authority to Modify Regulation No. 9 Deposits and Advance Payments, Case No. PAC-E-16-06. [Neil Price, Attorney] Commissioner Kjellander stated that item 6 would be deliberated privately.
