Dear Joe:
Today I filed, on behalf of Bypass Limited, a California
Limited Partnership, an Application with the Idaho Public
utilities Commission for approval of the Firm Energy Sales
Agreement for Hazel ton lIA.lI Thank you for your assistance in
bringing these difficult negotiations to fruition. Prior to your
intervention it seemed that our negotiations had becomeinterminable.
During our last negotiating session, I informed you thatsithe had yet to reach a conclusion as to whether Hazelton lIBlI and
wilson Lake are economic given the lapse of time and related
inflation for equipment since the Settlement Agreement was
executed. I also noted that as soon as sithe reach~d a conclusion
as to whether to proceed with the latter two projects we would
inform you of that decision. Late last week sithe determined, due
to changed economic conditions, not to proceed with the Wilson
Lake and Hazelton liB" projects at this time.
Pursuant to our Stipulation and Settlement Agreement we have
filed simultaneously with our Application for Approval of the
Hazelton "A" contract, a Notice of withdrawal of our Petition for
Reconsideration in IPUC Case No. 1500-170. In addition, Idaho
Power has filed a Notice of Withdrawal of its Cross-Petition for
Reconsideration in the same proceeding. It is our understanding,
from the date the Commission approves the Firm Energy Sales
Agreement for Hazelton "A," Wilson Lake and Hazelton "B" will
thereafter be subj ect to the vagaries of the Commission regarding
rates and other Commission mandated contract terms.
