HomeMy WebLinkAbout20140519min.doc IDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING May 19, 2014 – 1:30 P.M. In attendance were Commissioners Paul Kjellander, Mack Redford and Marsha Smith. Commissioner Kjellander called the meeting to order. The first order of business was APPROVAL OF MINUTES FROM PREVIOUS MEETING on Monday, May 5, 2014. The Commission voted unanimously to approve the minutes as written. The next order of business was approval of the CONSENT AGENDA: 2. Don Howell's May 12, 2014 Decision Memorandum re: Idaho Power's Application for an Accounting Order for the Recovery of Overpayments Made to Simplot Under a Terminated PURPA Contract, Case No. IPC-E-14-08. 3. Grace Seaman's May 16, 2014 Decision Memorandum re: Idaho Telecommunications Relay Service Contract Extension with Hamilton Telecommunications, Case No. GNR-T-10-05. There was no discussion and Commissioner Kjellander made a motion to approve Staff’s recommendations for items 2 and 3 on the Consent Agenda. A vote was taken on the motion and it carried unanimously. The next order of business was MATTERS IN PROGRESS: 4. Beverly Barker's May 16, 2014 Decision Memorandum re: Intermountain Gas Tariff Advice No. 14-01; Proposed Changes to General Service Provisions and Certain Non-Recurring Charges. Ms. Barker reviewed her Decision Memo. There was no discussion and Commissioner Smith made a motion to adopt the proposed changes to the Tariff Advice effective May 26, 2014. A vote was taken on the motion and it carried unanimously. 5. Discussion re: Idaho Power Company's Petition to Temporarily Suspend Its PURPA Obligation to Purchase Energy Generated by Solar-Powered Qualifying Facilities (QFs), Case No. IPC-E-14-09. [Kristine Sasser, Attorney. No Memo.] Ms. Sasser reviewed the Petition filed by Idaho Power on May 13, 2014. Commissioner Kjellander stated that his main concern is due process and he asked Ms. Sasser how Rule 256 applies in this case. She replied that Rule 256 speaks to expedited requests and the notice the Commission needs to provide. She stated that the procedural nature of this case is a bit awkward, given there are no parties yet but there are people who might be impacted and deserve a chance to be heard. Commissioner Kjellander asked what kind of timeline the Commission is looking at in order to expedite the case. Ms. Sasser replied that a Notice of Public Hearing would need to be issued with no less than two days’ notice. Commissioner Smith stated that it is important that the Commission allow all those interested an opportunity to be heard and that the Commission move quickly to set a hearing on the procedural aspects of the case and establish a scheduling process. She suggested setting an early evening hearing in two days in order to get feedback. She said she doubted there would be much support for the petition, and she personally hoped that the developers and Idaho Power will continue to negotiate. She said the whole idea of having an IRP (integrated resource plan) process is to have rates and contracts reflect the individual circumstances of each project. Commissioner Smith made a motion to schedule a public hearing in two days and see what feedback is received. Commissioner Kjellander clarified that written comments would be accepted as well as testimony at the public hearing. A vote was taken on the motion and it carried unanimously. The final order of business was FULLY SUBMITTED MATTERS: 6. Deliberation re: Idaho Power Company's Motion for Approval of a Settlement Stipulation, Case No. IPC-E-13-25 [Kristine Sasser, Attorney] 7. Deliberation re: Idaho Power's Petition for Reconsideration of Order No. 33016 -- Capacity Deficiency, Case No. IPC-E-13-21. [Kristine Sasser, Attorney] Commissioner Kjellander stated that items 6 and 7 would be deliberated privately.
