COMMISSIONER KJELLANDER: We11, good afternoon.
Thj-s is the time and place for a technical hearing in
Case No. IPC-E-L6-01, also known as in the matt.er of
Idaho Power Company's request to transfer titl-e of Mobile
Manor Mobil-e Home Park meter pedestals. I'm Paul-
Kj ellander. I ' l-l- be the Chair of today' s proceedings.
To my right is Commissioner Eric Anderson and to my left
is Commj-ssioner Kristine Raper. Idaho Code provides that
the Commission shal-l conduct a public hearing upon the
application by an electric utility for the sal-e of
property. It's Idaho Code S 6L-328(2), so today's
purpose is to fulfill the requirements of Idaho Code
6L-328 (2) , so if we begin this morning, Iet's take the
appearances of the parties, actually this afternoon, and
l-et' s begin with Idaho Power.
MR. WALKER: Thank you, Mr. Chairman. Donovan
Walker with Idaho Power Company and with me is Courtney
Waites and Matt Larkin from Idaho Power.
COMMISSIONER KJELLANDER: Welcome to the
Commission. Let's move to the Staff, representation from
the Attorney General's Office.
MS. HUANG: Thank you. Good afternoon,

COMMISSIONER KJELLANDER: V{el-come, and l-et' s
move now to the Industrial Customers.
MR. RICHARDSON: Thank you, Mr. Chairman.
Peter Richardson of the firm Richardson & Adams on behalf
of the Industrial- Customers of Idaho Power. To my left
is Dr. Reading.
COMMISSIONER KJELLANDER: Thank you and
we.l-come. Well, these are relatively unusual proceedings,
again, required and mandated by statute, so as we move
forward, there's no prefiled testimony, so there's no
witness l-ist to move to, so why don't we look to if there
are any corTrments or initial issues that need to come
before the Commission. Let's begin with ldaho Power.
MR. WALKER: Thank you, Mr. Chairman, and as
Idaho Power requested in its application, it felt this
case appropriate for modified procedure to be processed
based upon the written submissions in the record. We
continue to belleve this case appropriate for that type
of procedure, ds did the Commission in issuing its Notice
of Modified Procedure, and given subsequent directives
from the FBI Order questioning the applicability of
6L-328 when there's a safe affecting indivlduals as not

being a sale to the public or a portion thereof, f guess
we question the mandatory nature of this very proceeding,
but recognlze the Commission certainl-y has discretion to
proceed wlth the hearing if it so chooses.
With all of that mouthful-, we really have no
further submissions other than what we have on the
written record.
COMMISSIONER KJELLANDER: Thank you, Mr.
Walker. Let's move to Ms. Huang.
MS. HUANG: Thank you, Mr. Chairman. Staff
agrees with these comments provided by Mr. WaIker today
in light of Staff's comments which also refl-ect the same,
that the Commission's recent Order No. 33514 in the Idaho
Power FBI case, this Commission has determined that
6L-328 may not apply in situations and circumstances such
as in this case; nonetheless, this Commission did set
this technical hearing and we see that there's no harm to
proceeding and Staff has fifed its comments. No other
party has fil-ed comments and with that, the Staff has
nothj-ng else to add.
COMMISSIONER KJELLANDER: And, Ms. Huanq, just
as a follow-up question and I don't recal-l and the
question that I have is with regards to establishing this
technical hearlng, did that occur before the Order was
is sued?

MS. HUANG: WeII, timing-wise, the oral ruling
setting the hearing happened first. The FBI Order was
entered second, and then the Order from the oral hearing
was entered third, but, y€S, the actual ruling setting
thls hearing was the first to occur.
COMMISSIONER KJELLANDER: Okay, thank you.
Mr. Richardson.
MR. RICHARDSON: Thank you, Mr. Chairman. We
have nothlng to add.
COMMISSIONER KJELLANDER: WeIl, this leaves us
in a very exciting place as far as the Commission is
concerned. Are there any questions from members of the
Commission? None? Is there anything further that needs
to come before the Commission? If not, then, this
technical hearing is adjourned.
