HomeMy WebLinkAbout20130225min.docIDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING FEBRUARY 25, 2013 – 1:30 P.M. In attendance were Commissioners Paul Kjellander, Mack Redford and Marsha Smith. The first order of business was APPROVAL OF MINUTES FROM PREVIOUS MEETING on Tuesday, February 19, 2013. The Commission voted unanimously to approve the minutes as written. The second order of business was approval of the CONSENT AGENDA: 2. Grace Seaman's February 19, 2013 Decision Memorandum re: 360 Networks (USA) Inc.'s Application to Cancel Certificate No. 453, Case No. WFN-T-05-01. 3. Kristine Sasser's February 20, 2013 Decision Memorandum re: Idaho Power's Application for Determination Regarding the FESA Between Idaho Power and J.R. Simplot Company, Case No. IPC-E-13-02. There was no discussion and Commissioner Kjellander made a motion to approve Staff’s recommendations for items 2 and 3 on the Consent Agenda. A vote was taken on the motion and it carried unanimously. The next order of business was MATTERS IN PROGRESS: 4. Cathleen McHugh's February 21, 2013 Decision Memorandum re: Idaho Power's Annual Compliance Filing to Update Rule H Charges and Credits, Tariff Advice No. 12-14. Commissioner Kjellander stated he had been asked to hold item 4. He asked if there were any objections and hearing none, he made a motion to hold item 4. A vote was taken on the motion and it carried unanimously. 5. Don Howell's February 4, 2013 Decision Memorandum re: Swager Farms and Double B Dairy's Motion to Dismiss Idaho Power's Complaints and Petitions for Declaratory Orders for Lack of Subject Matter Jurisdiction, Case Nos. IPC-E-12-25 and IPC-E-12-26. Mr. Howell reviewed his Decision Memo. Commissioner Smith stated that based on her understanding of the PUC’s jurisdiction, the PUC does have subject matter jurisdiction, and she made a motion to deny New Energy’s Motion to Dismiss. Commissioner Kjellander asked if the motion should include asking the QF to file an answer within fourteen days, and she agreed that should be the response. A vote was taken on the motion and it carried unanimously. The final order of business was FULLY SUBMITTED MATTERS: 6. Deliberation re: Idaho Power's Tariff Advice No. 12-13, Case No. IPC-E-12-28.
