HomeMy WebLinkAbout20120730min.docIDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING JULY 30, 2012 – 1:30 P.M. In attendance were Commissioners Paul Kjellander, Mack Redford and Marsha Smith. Commissioner Kjellander called the meeting to order. The first order of business was APPROVAL OF MINUTES FROM PREVIOUS MEETING on Monday, July 16, 2012. The Commission voted unanimously to approve the minutes as written. The next order of business was approval of the CONSENT AGENDA: 2. Grace Seaman's July 17, 2012 Decision Memorandum re: Albion Telephone Company's 2011 Broadband Equipment Tax Credit Application, Case No. ALB-T-12-02. 3. Grace Seaman's July 19, 2012 Decision Memorandum re: CenturyTel of the Gem State, Inc. and CenturyTel of Idaho, Inc.'s Advice Nos. 12-12V and 12-13V to Modify Originating VOIP-PSTN Traffic. 4. Grace Seaman's July 17, 2012 Decision Memorandum re: Qwest Corporation dba CenturyLink QC's Application for Approval of an Interconnection Agreement with Farmers Mutual Telephone Company, Case No. QWE-T-12-05. 5. Neil Price's July 27, 2012 Decision Memorandum re: Avista's Applications to Eliminate the Annual Compliance Filing Requirement for Asset Retirement Obligation (ARO) Established in Order No. 29962, Case Nos. AVU-E-12-05 and AVU-G-12-04. There was no discussion and the Commission voted unanimously to approve Staff’s recommendations for items 2 through 5 on the Consent Agenda. The next order of business was MATTERS IN PROGRESS: 6. Big Wood Canal and American Falls Reservoir Late Petition to Intervene (Idaho Power's Objection and Big Wood's Reply to Objection), Case No. GNR-E-11-03. [Kristine Sasser, Attorney] 7. Mountain Air Projects Late Petition to Intervene (Idaho Power Objection to Intervention and Mountain Air's Reply to Objection) and Acceptance or Rejection of Legal Brief, Case No. GNR-E-11-03. [Kristine Sasser, Attorney] Commissioner Smith made a motion to grant Mountain Air’s Petition to Intervene and also grant Big Wood Canal and American Falls Reservoir’s Petition to Intervene. She stated the Petitions were filed very late; however, she didn’t think they will necessarily detract from, delay or expand the process we have established. She noted that both petitioners had promised not to duplicate efforts at the hearing if they thought the issues were well covered, and she strongly encouraged that because there will be a lot of parties at the hearing. Ms. Sasser asked for clarification regarding Mountain Air’s brief and if the motion included acceptance of the brief filed on Mountain Air’s behalf. Commissioner Smith replied the motion included acceptance of the brief. There was no further discussion. A vote was taken on the motion and it carried unanimously. The final order of business was FULLY SUBMITTED MATTERS: 8. Deliberation re: Spectrotel, Inc. dba One Touch Communications dba Touch Base Communications Application for a CPCN to Provide Local Exchange Telecommunications Service, Case No. SPE-T-11-01. [Don Howell, Attorney] 9. Deliberation re: Application of Capitol Water Corporation for Authority to Increase Its Schedule No. 3 Purchase Power Adjustment Rate, Case No. CAP-W-12-01. [Neil Price, Attorney] 10. Deliberation re: Rocky Mountain Power's Request for Authority to Decrease the Customer Efficiency Services Rate, Case No. PAC-E-12-11. [Weldon Stutzman, Attorney] Commissioner Kjellander stated that items 8, 9 and 10 would be deliberated privately.
