IPC-E-11-08 IDAHO POWER COMPANY'S OBJECTIONS TO KROGER CO.'S INTERROGATORY NOS. 3-2 AND 3-4 COMES NOW, Idaho Power Company ("Idaho Powet' or "Company") and objects to Kroger Co.'s ("Kroget') interrogatory Nos. 3-2 and 3-4 dated August 25, 2011, as follows: IDAHO POWER COMPANY'S OBJECTIONS TO KROGER CO.'S INTERROGATORY NOS. 3-2 AND 3-4 - 1 REQUEST NO. 3-2: Please prepare a class cost of service study, similar in all respects to the cost of service summarized in IPC witness Mr. Larkin's Exhibit 35 (as corrected in response to Staff DR No. 31), except treat classes 9S and 9P as a single, consolidated class. Please provide this cost of service study in electronic format with formulas intact. OBJECTION TO REQUEST NO. 3-2: Under the Idaho Public Utilties Commission's Rules of Practice and Procedure and the Idaho Rules of Civil Procedure, discovery may be used to obtain copies of documents in the Company's possession. Idaho Power objects to this production request, which goes beyond the scope of the Rules and asks Idaho Power to perform a new study in the form dictated by Kroger. Moreover, Idaho Power believes the requested study is contrary to generally accepted methods of determining class cost-of-service. Although Idaho Power has not performed the requested study, Mr. Larkin's Exhibit No. 35 has already been provided to Kroger. The information necessary to modify the study wil be provided to Kroger in the Company's response to Krogets Request No. 3-3. The response to this Request was prepared by Lisa D. Nordstrom, Lead Counsel, Idaho Power Company.
