IPC-E-10-61, IPC-E-10-62 -Grouse Creek Wind Park, LLC and Grouse Creek Wind Park II, LLC Dear Commissioner Kjellander: I write regarding the above referenced cases that are currently pending before the Idaho Public Utilities Commission. These matters have been fully submitted and the record closed as of March 7, 2012. We are now into our sixth month since the record has been closed. I understand the Commission has been busy this year. However, my client's power purchase agreement was first brought to the Commission for consideration by Idaho Power in December, 2010. I understand the matter has taken an unusual procedural track in that your initial decision rejecting the contract was appealed to the Idaho Supreme Court. Subsequent to the appeal, the Commission remanded the matter for further consideration in light of recent FERC decisions regarding the IPUC's implementation of PURPA. That said, this matter has been before the Commission for over eighteen months and every day of delay is costing my client both in terms of capital and lost opportunities. I know that it is not typical practice before the Commission for parties to offer to submit proposed orders, but if that would help ease the workload on your staff we would be happy to offer a proposed order and findings of fact for your consideration. Alternatively, if the Commission believes that a meeting between Staff and Grouse Creek Wind Park, LLC might facilitate the resolution of this matter, we of course would be happy to do so at Staffs earliest convenience. Regardless, we would appreciate an indication as to the expected timing of your decision.
