HomeMy WebLinkAbout20110620min.docIDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING JUNE 20, 2011 – 1:30 P.M. In attendance were Commissioners Paul Kjellander, Mack Redford, and Marsha Smith. Commissioner Kjellander called the meeting to order. The first order of business was APPROVAL OF MINUTES FROM PREVIOUS MEETING on Monday, June 6, 2011. The Commission voted unanimously to approve the minutes as written. The second order of business was approval of the CONSENT AGENDA: 2. Carolee Hall's June 7, 2011 Decision Memorandum re: CenturyLink's Petition for a Waiver of FCC Threshold Requirements for Numbering Resources in Idaho's Grandview Rate Center, Case No. CEN-T-11-02. 3. Grace Seaman's June 17, 2011 Decision Memorandum re: Filer Mutual Telephone Company's Broadband Equipment Tax Credit Application for 2007-2010, Case No. FIL-T-11-01. 4. Grace Seaman's June 10, 2011 Decision Memorandum re: Qwest Corporation's Applications for Approval of Interconnection Agreements with Integra Telecom of Idaho, Inc., Dieca Communications, Inc., and Eschelon Telecom, Inc., Case Nos. USW-T-00-05, QWE-T-05-19, and QWE-T-00-13. 5. Grace Seaman's June 17, 2011 Decision Memorandum re: Qwest's Application for Approval of the Interconnection Agreement with Broadvox-CLEC, LLC, Case No. QWE-T-11-06. 6. Kris Sasser's June 17, 2011 Decision Memorandum re: Rocky Mountain Power's Request for a Revised and Restated Power Purchase Agreement Between Lower Valley Energy, Inc., and PacifiCorp, Case No. PAC-E-11-15 7. Neil Price's June 9, 2011 Decision Memorandum re: Application of Resort Water Company for the De-Annexation of a Portion of Its Service Territory, Case No. RES-W-11-01. 8. Neil Price's June 9, 2011 Decision Memorandum re: Application of Windstream NuVox, Inc. for a Certificate of Public Convenience and Necessity, Case No. WNV-T-11-01. There was no discussion and the Commission voted unanimously to approve Staff’s recommendation for items 2 - 8 on the Consent Agenda. The next order of business was MATTERS IN PROGRESS: 9. Don Howell's June 16, 2011 Decision Memorandum re: Idaho Power Rate Case Application, Case No. IPC-E-11-08. Mr. Howell reviewed his Decision Memo. He said Staff has every expectation of processing the case within six months, and if the Commission decided not to suspend the effective date of the tariff, the onus would be on the Company to amend the effective date. Commissioner Smith commented on the Commission’s options and then made a motion to suspend the effective date of the tariff, proceed with the case by issuing a Notice of Application, and establish a 10-day deadline for intervention. A vote was taken on the motion and it carried unanimously. 10. Karl Klein's June 16, 2011 Decision Memorandum re: In the Matter of the Commission's Investigation of Island Park Water Company, Inc.'s Billing Practices, Case No. ISL-W-11-01. Mr. Klein reviewed his Decision Memo and listed Staff’s recommendations that an order be issued directing the company to bill according to its tariff, to not engage in any practices not supported by the tariff, and to refund any amounts collected from customers in excess of the tariff. Commissioner Redford asked if the company meant to charge by lot when it initially filed its tariff or if Staff thought the company was making an attempt to increase its rates without the Commission’s approval. Chris Hecht, Complaint Investigator, replied that the original tariff was set up on a per customer basis, and the company is aware of that fact. He said the company chose to change the tariff in 2011 to a per lot basis upon the recommendations of a consultant brought in by new management. Commissioner Smith made a motion to issue the order and remind the utility that it is a regulated entity. Commissioner Kjellander commented that because Island Park Water has a history of ignoring some of the finer details of some of the Commission’s previous orders, the Commission should not let much time pass between issuance of the order and taking additional measures if the company does not comply with the order. A vote was taken on the motion and it carried unanimously. FULLY SUBMITTED MATTERS: 11. Deliberation re: Investigation of an Appropriate Certification Process for Telecommunications Companies that Do Not Provide Basic Local Exchange Service, Case No. GNR-T-11-01. [Weldon Stutzman, Attorney.] Commissioner Kjellander stated that item 11 would be deliberated privately.
