HomeMy WebLinkAbout20110131min.docIDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING JANUARY 31, 2011 – 1:30 P.M. In attendance were Commissioners Jim Kempton, Marsha Smith, and Mack Redford. Commissioner Kempton called the meeting to order. The first order of business was APPROVAL OF MINUTES FROM PREVIOUS MEETING on Monday, January 24, 2011. The Commission voted unanimously to approve the minutes as written. The second order of business was approval of the CONSENT AGENDA: 2. Carolee Hall's January 26, 2011 Decision Memorandum re: Application for Approval of an Amendment to the Interconnection Agreement Between Qwest Corporation ("Qwest") and Matrix Telecom, Inc. ("Matrix"), Case No. QWE-T-09-13. 3. Carolee Hall's January 26, 2011 Decision Memorandum re: Application for Approval of an Amendment to the Interconnection Agreement Between Qwest Corporation ("Qwest") and Lightyear Network Solutions, LLC ("Lightyear"), Case No. QWE-T-04-19. 4. Carolee Hall's January 24, 2011 Decision Memorandum re: Application for Approval of an Amendment to the Interconnection Agreement Between Qwest Corporation ("Qwest") and ACN Communication Services, Inc. ("ACN"), Case No. QWE-T-03-26. 5. Carolee Hall's January 26, 2011 Decision Memorandum re: Application for Approval of an Amendment to the Interconnection Agreement Between Qwest Corporation ("Qwest") and OrbitCom, Inc. ("OrbitCom"), Case No. QWE-T-04-13. 6. Carolee Hall's January 24, 2011 Decision Memorandum re: Application for Approval of an Amendment to the Interconnection Agreement Between Qwest Corporation ("Qwest") and Transnational Communications International, Inc. ("Transnational"), Case No. QWE-T-05-09. 7. Grace Seaman's January 24, 2011 Decision Memorandum re: Cancellation of CommPartners, LLC's Certificate No. 443, Case No. CMP-T-04-01. 8. Neil Price's January 28, 2011 Decision Memorandum re: In the Matter of the Application of Rocky Mountain Power Requesting Approval of Revisions to Its Dispatchable Irrigation Load Control Program, Case No. PAC-E-11-06. Regarding items 2 through 7, there was no discussion and the Commission voted unanimously to approve Staff’s recommendations. Regarding item 8, Commissioner Kempton stated that he would like to emphasize that there are contracts already in existence and based on comments the Commission has received, there is some concern that participating irrigators will not be selected to participate in the program in the future. He suggested that the Commission should include specific language in its Notice of Modified Procedure to address contract provisions. Commissioners Redford and Smith expressed their agreement. Commissioner Smith added that she would like commenters to address if the changes should be effective for this irrigation season because many irrigators might have already made decisions and have existing financial arrangements in place. Commissioner Smith made a motion to process the application by modified procedure with a 45-day comment period and to include language in the Notice of Modified Procedure asking for comments on the effective date of the program. A vote was taken on the motion and it carried unanimously. FULLY SUBMITTED MATTERS: 9. Deliberation re: In the Matter of the Joint Petition of Idaho Power Company, Avista Corporation, and Rocky Mountain Power to Address Avoided Cost Issues and to Reduce the Published Avoided Cost Rate Eligibility Cap, Case No. GNR-E-10-04. [Kristine Sasser, Attorney] Commissioner Kempton stated that item 9 would be deliberated privately. Commissioner Redford made a motion to go into Executive Session to discuss the BPA mediation process with the Commission’s general counsel. A vote was taken on the motion and it carried unanimously. (Although there was a motion and a vote to move into Executive Session, there was in fact no Executive Session. The motion and vote were made in error.)
