IPC-05- IDAHO POWER COMPANY' OBJECTION TO IDAHO IRRIGATION PUMPERS ASSOCIATION'S THIRD DATA REQUEST In accordance with RP 225.03, with the exception of Request Nos. 36 and , Idaho Power Company hereby objects to the Idaho Irrigation Pumper Association Third Data Request to Idaho Power. This objection is based on the following: The Irrigators' Third Data Request deals exclusively with the Company s Irrigation Peak Rewards Program. The Irrigation Peak Rewards Program was the subject of Case No. IPC-04-26. The final Order in Case No. IPC-04- Order No. 29665 , was issued on December 22 , 2004. Order No. 29665 directed Idaho IDAHO POWER COMPANY'S OBJECTION TO IDAHO IRRIGATION PUMPERS ASSOCIATION'S THIRD DATA REQUEST Page Power to file a report with the Commission no later than December 1 2005, detailing the results of the Irrigation Peak Rewards Program during 2005. The Irrigators' Third Data Request consists of ten individual requests of which only two (Request No. 36 and Request No. 41) are linked to this case. Request No. 41 asks the Company to explain how the expenses and revenues associated with the Irrigation Peak Rewards Program are addressed in the present rate case. The answer is that other than some minor imbedded payroll expenses , all of the incremental expenses associated with the Irrigation Peak Rewards Program are funded through the Energy Efficiency Rider and, therefore, are not included in the current case. Idaho Power will provide formal responses to both Request Nos. 36 and 41 in due course. All of the remaining eight requests seek a detailed analysis of the Irrigation Peak Rewards Program and the Company s December 1 2005 filing made in Case No. I PC-04-26. Providing the information requested in the remaining eight requests within the time frames required in this case will be difficult and unreasonably burdensome. Considering that the Irrigation Peak Rewards Program does not have an impact on revenues and expenses in this rate case, Idaho Power objects to the Irrigators' Third Data Request on the grounds that it is unreasonably burdensome and requests information that is not relevant to this case. Previously Idaho Power offered to discuss the Irrigation Peak Rewards Program and the Company s December 1 2005 , compliance filing with the Idaho Irrigation Pumpers Association. Idaho Power suggests that if the Irrigators desire IDAHO POWER COMPANY'S OBJECTION TO IDAHO IRRIGATION PUMPERS ASSOCIATION'S THIRD DATA REQUEST Page 2 to explore the data contained in the December 1 2005 , report in detail , it would be more appropriate that the discussions take place in a collaborative process in Case No. IPC- 04-26 rather than adding one more item in this case. Trying to insert the analysis of the Irrigation Peak Rewards Program into this case will add unnecessary complexity and will place considerable additional burdens on Idaho Power at the same time it is responding to data requests dealing with rate case issues.
