Kroger Petition For Leave to Intervene Out of Time
Dear Don:
Per our recent discussion, this letter will confirm that Idaho Power does
not object to Kroger's Petition for late intervention in this case. Kroger s Petition
indicates that Kroger is willing to accept the record as it currently exists.
I do want to provide one clarification. In its Petition, Kroger indicates that
it was not able to timely respond to Idaho Power s application due to the fact that
Kroger did not learn of the rate case until December 14, 2005. On October 31 , 2005,
Idaho Power sent a letter to Kroger s counsel, both bye-mail and by first-class mail
advising of the filing of the rate case. These notices were sent to the e-mail address
and street address provided by Kroger in the last rate case. Upon review of Kroger
Petition, it appears that both the e-mail address and mailing address for Kroger's
counsel has changed since the last rate case.
With that clarification , Idaho Power hereby confirms that it has no
objection to Kroger s late intervention in this case
