HomeMy WebLinkAbout20100412min.docIDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING APRIL 12, 2010 – 1:30 P.M. In attendance were Commissioners Jim Kempton and Marsha Smith. Commissioner Mack Redford was absent and excused. Commissioner Kempton called the meeting to order. The first order of business was approval of MINUTES FROM PREVIOUS MEETING on April 5th, 2010. A vote was taken to approve the minutes as written. The second order of business was approval of the CONSENT AGENDA: 2. Carolee Hall's April 7, 2010 Decision Memorandum re: Application for Approval of an Interconnection Agreement Between Qwest Corporation ("Qwest") and Intrado Communications, Inc. ("Intrado"), Case No. QWE-T-10-01. 3. Kristine Sasser's April 6, 2010 Decision Memorandum re: MBC Telecom, LLC Application for a Certificate of Public Convenience and Necessity, Case No. MBC-T-09-01. 4. Weldon Stutzman's April 8, 2010 Decision Memorandum re: Idaho Power's Application for Authority to Implement Fixed Cost Adjustment Rates Effective June 1, 2010, Case No. IPC-E-10-07. Regarding item 2, Commissioner Kempton noted there were two Staff recommendations—one recommending approval of the interconnection agreement and the second recommending that Qwest be reminded that the PAP and PIDS are to be included with its interconnection agreements, and if the parties knowingly negotiate terms to exclude the PAP, a statement signed by the CLEC indicating knowledge of the PAP and its purpose must be included with each Application. There was no discussion and the Commission voted unanimously to accept Staff’s recommendations for items 2, 3, and 4. The next order of business was MATTERS IN PROGRESS: 5. David Hattaway's April 8, 2010 Decision Memorandum re: Calculating the 2010 Regulatory Fee Assessments for Public Utilities and Railroads, Case Nos. F-2010-1 and F-2010-2. Mr. Hattaway reviewed his Decision Memo. Commissioner Smith made a motion to accept the calculation of the 2010 regulatory fee assessments of .2039% for utilities and .9786% for railroads and to agree with Staff’s calculation of the regulatory assessment as shown in the memo. A vote was taken on the motion and it passed unanimously. FULLY SUBMITTED MATTERS: 6. Deliberation re: Firm Energy Sales Agreement -- Riverside Investments LLC, Case No. IPC-E-10-05. [No Memo. Scott Woodbury, Attorney.] Commissioner Kempton stated that item 6 would be deliberated privately immediately following the meeting.
