GNR-E-11-03 IDAHO POWER COMPANY'S FIRST PRODUCTION REQUEST TO EXERGY DEVELOPMENT GROUP OF IDAHO, LLC COMES NOW, Idaho Power Company ("Idaho Powet'), by and through its attorneys, and hereby requests that Exergy Development Group of Idaho, LLC ("Exergy") answer the following production requests and provide the following information and documents in accordance with the Idaho Public Utilties Commission's ("Commission") Rules of Procedure and applicable scheduling orders and notices issued by the Commission in this proceeding. Idaho Power requests responses to these production requests be provided as soon as possible, but no later than March 2, 2012. IDAHO POWER COMPANY'S FIRST PRODUCTION REQUEST TO EXERGY DEVELOPMENT GROUP OF IDAHO, LLC - 1 This production request is to be deemed continuing in nature and Exergy is requested to provide, through supplementation, additional documents or information that are responsive to this request that it, or any person acting on its behalf, may later come into possession or become aware of. REQUEST FOR PRODUCTION NO.1: Please provide a list of all qualifying facility projects Exergy or any of its Affiliates owns, developed, is currently planning or developing, and/or has or had any type of ownership or control of in the state of Idaho. For the purposes of these production requests, the term "Affilates" shall mean any entity, corporation, person, joint venture, partnership, or joint development agreement in which Exergy has any ownership or control. REQUEST FOR PRODUCTION NO.2: For each project listed in response to Request for Production No.1, please identify the point of interconnection and provide a copy of the firm energy sales agreement and/or power purchase agreement Exergy or its Affiliates has with the public utility. REQUEST FOR PRODUCTION NO.3: For each project listed in response to Request for Production No.1, please describe whether Exergy and/or its Affliates retain the environmental attributes, including any and all renewable energy credits ("RECs") or green tags resulting from the generation of energy from the project. REQUEST FOR PRODUCTION NO.4: Please provide all studies, analyses, reports, and any other documentation whether electronic or in writing in Exergy's and/or its Affilates' possession relating to the value, marketability, creation, title, and/or existence of RECs.
