HomeMy WebLinkAbout20090928min.docIDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING September 28, 2009 – 1:30 P.M. In attendance were Commissioners Jim Kempton and Marsha Smith. Commissioner Mack Redford was absent and excused. Commissioner Kempton called the meeting to order. The first order of business was approval of MINUTES FROM PREVIOUS MEETING on September 21, 2009. A vote was taken to approve the minutes as written. The second order of business was approval of the CONSENT AGENDA: 2. Bryan Lanspery's September 25, 2009 Decision Memorandum re: Idaho Power Company Tariff Advice No. 09-09 - Modifications to Schedule 9 and Schedule 19. The Commission voted unanimously to accept the Company’s revision in wording for Schedules 9 and 19 as it relates to calculation of non-salvable cost and directed the Company to file a separate tariff advice to modify the language in Schedules 24 and 46 so all schedules that may face these costs are treated equitably. 3. Chris Hecht's September 24, 2009 Decision Memorandum re: Spirit Lake East Water Company Tariff Advice. The Commission voted unanimously to suspend the effective date of Spirit Lake’s tariff advice and initiate a case to be processed under modified procedure with a 14-day comment period. Commissioner Kempton clarified that the shorter comment period was appropriate in this case rather than the usual 21-day comment period. 4. Kristine Sasser's September 25, 2009 Decision Memorandum re: In the Matter of Avista's 2009 PGA, Case No. AVU-G-09-05. The Commission voted unanimously to process the case by modified procedure with comments due no later than October 16, 2009. 5. Neil Price's September 23, 2009 Decision Memorandum re: Application of Entelegent Solutions, Inc. for a Certificate of Public Convenience and Necessity, Case No. ENT-T-09-01. The Commission voted unanimously to process Entelegent’s Application for a Certificate of Public Convenience and Necessity by modified procedure. The next order of business was RULEMAKING: 6. Don Howell's September 25, 2009 Decision Memorandum re: Amendment of the Commission's Utility Customer Relations Rules (IDAPA 31.21.01) and to Repeal the Commission's Utility Customer Information Rules (IDAPA 31.21.02), Docket Nos. 31-2101-0901 and 31-2102-0901. Mr. Howell reviewed his Decision Memo. There was no discussion. The Commission voted unanimously to adopt its proposal to transfer the three rules to IDAPA 31.21.01 and to repeal the Utility Customer Information Rules found at IDAPA 31.21.02, propose its adoption of pending rule in the next Administrative Bulletin scheduled for publication on November 4, 2009, and submit these rule changes to the 2010 Legislature. The remaining items 7 – 9 were under the category of FULLY SUBMITTED MATTERS and Commissioner Kempton stated they would be deliberated privately.
