Does the Company currently have plans to update the current CPCN with the Commission to include the new service territory? RESPONSE:

No, not at this time. A CPCN only serves to delineate the electric service territories of jurisdictional utilities, and not Coops, REAs, etc. vis-a-vis jurisdictional utilities such as Avista. Those boundaries are otherwise subject to the Idaho Stabilization Act. (IC 61-332C).

No, Lots 1-5 are subject to a zone change to Residentional (Multi-family) and would fall under the rules set forth in the Avista/KEC Development Agreement.
