APPROVAL OF THE FIRST AMENDMENT TO THE ENERGY SALES
AGREEMENT BETWEEN IDAHO POWER AND PICO ENERGY, LLC;
CASE NO. IPC-E-26-22.
BACKGROUND
On September 28, 2026, the Idaho Public Utilities Commission ("Commission") issued
Order No. 37186, requiring Idaho Power Company ("Idaho Power") to file an updated First
Amendment that reflects the correct units and values of the capacity amounts stated in Appendix
B-I and Appendix B-4 of the Energy Sales Agreement ("ESA") between Idaho Power and Pico
Energy, LLC through a compliance filing. Order No. 37186 at 3.
On October 14, 2026, Idaho Power filed a compliance filing that contained a replacement
First Amendment to the ESA("Replacement First Amendment").
STAFF REVIEW
Staff reviewed the Replacement First Amendment and verified that the units and the values
of the capacity amounts described therein were consistent with what was stated in Appendix 13-1
and Appendix B-4 of the ESA. Staff believes that the Replacement First Amendment complies
with Order No. 37186.
STAFF RECOMMENDATION
Staff recommends that the Commission approve Idaho Power's compliance filing that
contained the Replacement First Amendment and was filed on October 14, 2026.
