IPC-E-26-25 COMPANY'S APPLICATION FOR ) APPROVAL OF THE THIRD AMENDMENT ) NOTICE OF APPLICATION TO THE ENERGY SERVICES AGREEMENT ) WITH BRISBIE LLC ) NOTICE OF INTERVENTION DEADLINE ORDER NO. 37178 On September 2, 2026, Idaho Power Company ("Company") applied to the Idaho Public Utilities Commission ("Commission") requesting approval of the Third Amendment ("Third Amendment") to the Special Contract for Electric Service ("ESA") between the Company and Brisbie LLC (`Brisbie") ("Application"). The Commission now issues this Notice of the Company's Application and Notice of Intervention Deadline establishing a 21-day intervention period. NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that since March 2025,Brisbie has operated a data center campus that takes service from the Company under the Commission-approved ESA, as required for customers with aggregate power requirements exceeding 20 megawatts ("MW"). Application at 2-4. YOU ARE FURTHER NOTIFIED that the Company and Brisbie entered into the ESA in December of 2021. Id. at 3. The Company states that the rates and terms of the ESA reflect the conditions of that time. Id. The Commission approved the ESA, subject to modification, in May of 2023 and subsequent amendments in October 2023 and November of 2024.Id. at 4. YOU ARE FURTHER NOTIFIED that according to the Company, recent Commission guidance and state legislation (though inapplicable to the ESA) regarding customer-protection principles in large-load service contracts led it and Brisbie to proactively explore strengthening the ESA with terms designed to prevent cost shifting to the Company's other customers.Id. at 5. YOU ARE FURTHER NOTIFIED that the Company and Brisbie executed the Third Amendment to the ESA on August 21, 2026. Id. at 6. The Company states that the Third Amendment is intended to align Brisbie's obligations with the costs, risks, and planning NOTICE OF APPLICATION NOTICE OF INTERVENTION DEADLINE ORDER NO. 37178 1 considerations associated with service under the ESA, thereby protecting the Company's other customers from cost shifting without revising the ESA's pricing structure or altering its approved framework.Id. YOU ARE FURTHER NOTIFIED that the Application and attached Third Amendment are available for public inspection during regular business hours at the Commission's office. The Application and attached Third Amendment are also available on the Commission's website at www.puc.idaho.gov. Click on the "ELECTRIC" icon, select"Open Cases," and click on the case number as shown on the front of this document. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission's jurisdiction under Title 61 of the Idaho Code, and that all proceedings in this matter will be conducted pursuant to the Commission's Rules of Procedure, IDAPA 31.01.01.000 et seq. NOTICE OF INTERVENTION DEADLINE YOU ARE FURTHER NOTIFIED that persons desiring to intervene in this matter to obtain parties' rights of participation must file a Petition to Intervene with the Commission pursuant to this Commission's Rules of Procedure 71-73, IDAPA 31.01.01.071-073. Persons who wish to intervene as a party must file a Petition to Intervene no later than 21 days after the date of service of this Order. Persons desiring to present their views without parties' rights of participation do not have to intervene and may present their comments without prior notification to the Commission or the parties. YOU ARE FURTHER NOTIFIED that the Commission Secretary shall issue a Notice of Parties after the deadline for intervention has passed. The Notice of Parties shall assign exhibit numbers to each party in this proceeding. YOU ARE FURTHER NOTIFIED that once the Notice of Parties is issued, Staff will informally confer with the parties to discuss a schedule to process this case, and other issues as may be raised by the parties. Once the deadline has passed, the Commission Secretary shall prepare and issue a Notice of Parties. IT IS FURTHER ORDERED that, after the Notice of Parties has issued,Commission Staff shall confer with the parties regarding a procedural schedule for this matter including,if necessary, a hearing in this matter. IT IS FURTHER ORDERED that parties comply with Order No. 35375, issued April 21, 2022. Generally, all pleadings should be filed with the Commission electronically and will be deemed timely filed when received by the Commission Secretary. Rule 14.02. Service between parties should continue to be accomplished electronically when possible. However, voluminous discovery-related documents may be filed and served on CD-ROM or a USB flash drive.
