IPC-E-26-24 COMPANY'S APPLICATION FOR ) APPROVAL OF THE THIRD AMENDMENT ) NOTICE OF APPLICATION TO THE POWER PURCHASE AGREEMENT ) BETWEEN IDAHO POWER COMPANY ) NOTICE OF MODIFIED AND TELOCASET WIND POWER ) PROCEDURE PARTNERS,LLC ) ORDER NO. 37168 On August 25, 2026, Idaho Power Company ("Company") applied to the Idaho Public Utilities Commission ("Commission") requesting an order approving the Third Amendment ("Third Amendment") to the Power Purchase Agreement ("PPA") between the Company and Telocaset Wind Power Partners, LLC ("Seller"), which would extend the term of the PPA and update the pricing schedule ("Application"). The Commission now issues this Notice of Application and Notice of Modified Procedure establishing written comment deadlines. NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that the Commission approved the 20-year PPA between the Company and Seller for the purchase and sale of energy generated at the Elkhorn Wind Park ("Facility") in 2007. Application at 2. The initial term of the PPA is scheduled to expire on December 31, 2027.Id. YOU ARE FURTHER NOTIFIED that, through the Third Amendment, the Company seeks a five-year extension of the term of the PPA to help mitigate capacity deficits beginning in 2028.Id. at 3. YOU ARE FURTHER NOTIFIED that according to the Company, the Third Amendment's updated per megawatt-hour base rate compares favorably to potential alternative resources and to the prices in effect at the end of the PPA's initial term. Id. The Company also believes the fact that the Facility is an existing project without development risks, the operational history, and the Seller's Lifespan Assessment Study add value to the Third Amendment.Id. at 3- 4. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 37168 1 YOU ARE FURTHER NOTIFIED that the Third Amendment provides the Company an option to extend the PPA for an additional five years under terms to be negotiated prior to the scheduled expiration of the Third Amendment on December 31, 2032.Id. at 4. YOU ARE FURTHER NOTIFIED that the Company states that the conditions, performance obligations, rates, and other terms of the PPA would remain intact, except as expressly provided in the Third Amendment.Id. at 4. YOU ARE FURTHER NOTIFIED that the Application and attachments are available for public inspection during regular business hours at the Commission's office. These documents are also available on the Commission's website at www.puc.idaho.gov. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission's jurisdiction under Title 61 of the Idaho Code, and that all proceedings in this matter will be conducted pursuant to the Commission's Rules of Procedure, IDAPA 31.01.01.000 et seq. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter, and that it will proceed under Modified Procedure pursuant to the Commission's Rules of Procedure 201-204,IDAPA 31.01.01.201—.204. The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that persons desiring to state a position on this Application may file a written comment explaining why the person supports or opposes the Application. Persons who would like a hearing must specifically request a hearing in their written comments and explain why written comments alone are insufficient. Persons interested in filing written comments must do so by November 12, 2026. Comments must be filed through the Commission's website or by e-mail unless computer access is unavailable. To comment electronically, please access the Commission's website at www.puc.idaho.gov. ORDER IT IS HEREBY ORDERED that this Application be processed under Modified Procedure. Persons interested in submitting written comments must do so by November 12, 2026.
