After further communication with DEQ,we understand that the administrative change we were seeking will not be approved at this time. Accordingly,we are withdrawing that notice while our attorney works through another avenue for addressing the underlying issues. As noted in the attached letter, this does not change or waive the HOA's position regarding Lot 16, our 2015 deed, the recorded subdivision documents, or the chronology of the water-right and water-system transactions.Those matters are now being reviewed more formally with counsel, and we will provide additional information as appropriate. For now, we simply wanted to promptly correct the record with the Commission and withdraw our earlier notice. Thank you for your understanding and assistance. Cristina Jacuzzi President Southshore Subdivision No. 2 Homeowners Association Dear Commission Staff, Southshore Subdivision No. 2 Homeowners Association respectfully withdraws its previously submitted Notice of HOA Administrative and Financial Transition concerning Southshore 2 Water Company and PWS #3140254. Dated 9/2/2026 The HOA had submitted that notice based upon its understanding that it could proceed with the proposed administrative transition. DEQ has since advised that it will not approve the requested change at this time. Accordingly, the HOA is not proceeding with the transition described in our prior notice while our attorney works through the appropriate process. We want to make clear that this withdrawal should not be interpreted as a withdrawal, waiver, or concession regarding the HOA's underlying property or ownership position. The HOA remains the recorded owner of Lot 16, where the community water system is located, pursuant to the deed recorded in 2015. The HOA also continues to evaluate the significance of the recorded documents and the chronology of the water-right and water-system transactions, including the fact that the HOA's deed predates the later transaction involving Southshore 2 Water Company. Our attorney is now working through these issues and the appropriate avenue for resolving them. We expect to provide a more formal explanation and supporting documentation once that review is complete. For the present time, we simply ask that our previously submitted Notice of HOA Administrative and Financial Transition be withdrawn from consideration and that the status quo remain in place while this matter is being addressed.
