SUBJECT: IN THE MATTER OF GW OPERATING,LLC'S NOTICE OF INTENT TO
OPERATE AS AN OTHER TELECOMMUNICATIONS SERVICE
PROVIDER; CASE NO. GWO-T-26-01.
On January 7, 2026, GW Operating, LLC. ("Company") submitted a Notice of Intent
("Notice") with the Idaho Public Utilities Commission ("Commission") to operate as an "Other
Telecommunications Service Provider"within the State of Idaho.
STAFF ANALYSIS
Commission Staff("Staff') reviewed the Company's Notice. In its Notice, the Company
notified the Commission of its intent to operate as an "Other Telecommunications Service
Provider" in the State of Idaho. Notice at 2. The Company intends to offer fiber-based services
to other carriers, municipalities, institutional customers, and enterprise customers. Id.
Staff contacted the Company to determine whether it would be required to obtain a
Certificate of Public Convenience and Necessity ("CPCN") to construct any fiber-based
infrastructure in Idaho. The Company indicated that it does not currently plan to build any
infrastructure or utilize interconnection agreements. Instead, the Company intends to use assets
and infrastructure from its affiliate WANRack, LLC. The Commission has no records of
WANRack, LLC having been granted a CPCN. Staff verified that both the Company and
WANRack, LLC are in good standing with the Idaho Secretary of State's office.
Staff notes that the Company is not requesting a Certificate of Public Convenience and
Necessity or requesting to be an Eligible Telecommunication Carrier in this Notice.

RECOMMENDATION
Staff recommends that the Commission acknowledge the Notice submitted by the
Company.
